HomeMy WebLinkAbout20010867.tiff RESOLUTION RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR BIG SKY ESTATES PLANNED UNIT DEVELOPMENT, S#489 - DALE AND LORETTA BURMAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, August 6, 1999, the Department of Planning Services did approve the application of Dale and Loretta Burman, 25815 Weld County Road 48, Kersey, Colorado 80644, for a Planned Unit Development Final Plan, S#489, for four (4) E (Estate) zoned lots, and one (1)A (Agricultural) zoned lot on the following described real estate, to wit: Lot B of Recorded Exemption #1805; located in the E1/2 of the SE1/4 of Section 5, Township 4 North, Range 64 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on May 19, 1999, the Board of County Commissioners of Weld County, Colorado, did approve an Improvements Agreement According to Policy Regarding Collateral for Improvements (Privately Maintained Roads) for Big Sky Estates Planned Unit Development, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Dale and Loretta Burman with terms and conditions being as stated in said agreement, and accepted Irrevocable Standby Letter of Credit#1000115000, drawn on the New Frontier Bank, 2425 35th Avenue, Greeley, Colorado 80634, in the amount of$18,600.00, and WHEREAS, on February 28, 2000, the Board of County Commissioners of Weld County, Colorado did cancel and release said Irrevocable Standby Letter of Credit #1000115000 drawn on the New Frontier Bank, 2425 35th Avenue, Greeley, Colorado 80634, in the amount of $18,600.00, and accepted personal check #1402 from Dale and Loretta Burman, dated February 23, 2000, in the amount of$650.00, to be held for the period of one year, and WHEREAS, upon recommendation of staff, the Board deems it advisable to release said collateral. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Personal Check #1402, from Dale and Loretta Burman, in the amount of$650.00 be, and hereby is, canceled and released. I recommend the release of collateral in the amount of$650 that has been retained for a period of one year. The Clerk to the Board is holding a personal check (PL1273 2000-04 88). It was deposited on February 23, 2000. There is a landscaping item identified in Exhibit "A" of the Improvements Agreement. The applicant has landscaped the entrance.
