Dear Board of County Commissioners:
As a landowner in Weld County, we would like to address the St. Vrain Sanitation District's
(District) request for a revision to their service area. With several properties served by the
District located south of State Highway 52, we are supportive of their revised service area
boundaries. Unfortunately, we do have some concerns with the limits of the currently defined
service area.
We have requested that the District take a more regional service approach to their service plan.
Specifically, that they provide service to entire properties where a majority of the property lies in
their service boundary, either through a 208 boundary revision or an IGA with the applicable
municipality or district. We believe that this methodology for determining service
responsibilities to properties is in line with the North Front Range Water Quality Planning
Agency, the State of Colorado and we assume Weld County's desire to minimize the duplication
of wastewater treatment collection and treatment.
The attached maps and letter's represent two properties, for which the District is currently
considering providing service. In both cases the local provider is in favor of the revision. We are
concerned that an approval of the District's service area that leaves these parcels split between
providers will perpetuate the duplication of wastewater services in this region.

Dear Mr. Peterson,
The attached request represents the portion of Section 10, which is currently not in the St.
Vrain Sanitation District's 208 boundary. Weld County Land Company, LLC is the
owner of this property and has currently filed for zoning and annexation with the Town
of Erie for this propety. Previous St. Vrain Sanitation District engineering reports
identify this area as property, which could be served by gravity flow to the existing St.
Vrain Wastewater Treatment Plant.
We look forward to working with the district and the town to determine the District's
ability to provide contiguous sanitary sewer service to this contiguously owned property. _

208 Boundary Revision and Petition for Inclusion
Dear Mark,
Dacono Properties, LLC (also known as Community Development Group) on behalf of
Union Pacific Land Resources Corporation annexed a portion of Section 14, Township 1
North, Range 68 West into the City of Dacono, Colorado, on June 29, 2000. On Friday,
August 25, 2000 Gary Bever, Bill Reilly and myself presented you with the preliminary
sanitary sewer plan and profile for this property, indicating the viability of a gravity
system., which appeared acceptable from an engineering prospective.
In general the site consists of 497 acres more or less located southwest of the intersection
of Weld County Roads 10 and 11. This letter is an official request for the inclusion of the
portions of this property north and west of Stanley Ditch, which is a part of the St. Vrain
Sanitation District 208 Service Boundary. In addition, this letter request a revision of the
St. Vrain Sanitation District 208•Service Boundary from the Dacono Sanitation District
208 Service Boundary to include the balance or Section 14 located northwest of Weld
County Roads 8 and 11 south and east of Stanley Ditch. -
As we discussed we are proposing a mixture of residential and commercial development
on this site. We are currently gathering all of the information for the Petition for
Inclusion, which delineates the current land use statistics.

The City of Dacono has beef working with Community Development Group on the ammitation
and proposed development for the above referenced project since early this year.•Although the
majority of the project lies'Within the service area of St Vrain Sanitation District(SVSD),
certain portions of the development,approximately 100 acres south and east of the Stanley Ditch,
are currently within the service area of the Dacono Sanitation District(DSD). We understand
that.rhe developer will be formally requesting a revision to the 208 boundary at your next • .
meeting on October 11 that Would allow for the entire project to be saved by SVSD.
Dacono City Council,at their meeting held this date,unanimously stated their support for having
the entire Swtxxgrass projec4 served by SVSD. Council further demonstrated their desire to have

subdivision filings for Planing Areas 2,3 and 15 as shown in the Master Plan previously

Dear Mr. Burns,
At the regular meeting of the Board of Directors of the Saint Vrain Sanitation District,
October 11, 2000, the Board resolved that expansion of the District's 208 service area
boundary was not in the best interests of the District at this time. Further, the Board
resolved to hear requests to change the District's 208 boundary annually in May with the
request due in the District's administrative offices by February 1.
Therefore, I must inform you that the District has declined to move its boundary to include
the southeast portion of your property, referenced above, in the District's 208 service area.
The District will hear the inclusion request for that portion of your property which presently
lies within the District's 208 boundary at its next meeting,November 15. Thereafter, the
District will hear requests to include quarterly with requests due in the District's
administrative offices 60 days prior to hearing.
In order to process your request to include that portion of your property which presently lies
within the District's 208 boundary, the District will need a legal description of that portion
before the first of November. Also, the application fee will change. I am enclosing the
application fee that you previously submitted. The new fee will be based on 1905 SFEs
presently served, i.e.
fee= 1905 x .05 x acres included.

Gentleman,
The St. Vrain Sanitation District Board is scheduled to hear an inclusion request for our
Sweetgrass project, on November 15th. Dacono Properties, LLC's ability to proceed with this
highly anticipated development in the City of Dacono is affected by your recently adopted 208-
boundary revision policy. Approximately 110 acres of the project lie south of the Stanley (Bull)
Ditch in the Dacono Sanitation District's 208-boundary. The entire site has been designed to
gravity flow to St. Vrain's Godding Hollow extension,which is under design with approximately
3500,000 of the funding coming from Dacono Properties, LLC. Therefore we, with the City of
Dacono and the Dacono Sanitation District, are requesting an interim solution for sanitary sewer
service which will allow the project to move forward, with a formal 208-boundary revision in
May of 2001.
The project construction phasing and.timing is based on southerly access to the site from the
existing I25 interchange at Weld County Road 8, which is scheduled for improvements next
summer. The improvements include the construction of a full-access interchange as part of the
CDOT I25 widening program, an upgrade of WCR 8 adjacent to the Dacono Outlet Mall and
location of a 1 million gallon water storage tank on the outlet mall property. The Sweetgrass
Master Plan and several preliminary plats for the project are currently approved based on this
phasing.
As we worked through the technical issues associated with sewering our site to St. Vrain, we
were advised that a lift station would not be acceptable. To accommodate this, the entire site was
re-engineered for gravity flow northerly to the proposed Godding Hollow extension. In addition,
St. Vrain's Godding Hollow extension is the only potential sewer provider for our site, which
does not require a lift station and/or extensive duplication of trunklines.

Dacono Properties, LLC is eager to pursue an inter-governmental agreement between the St
Vrain Sanitation District and the Dacono Sanitation District, allowing Sweetgrass to proceed with
development in Dacono,utilizing St.Vrain as its wastewater treatment provider. The purpose of
this agreement would be to provide long term and short term solutions to St. Vrain's concerns
regarding collection and treatment capacity.

Sweetgrass - Dacono, Colorado
Dear Mr. Peterson,
Dacono Properties LLC is filing a formal petition for collection and treatment of
wastewater for 110 acres of the Sweetgrass Project, which is currently part of the Dacono
Sanitation District. The remaining 385 acres of the Sweetgrass project has been included
in the St. Vrain Sanitation District. We are currently participating in the Godding Hollow
Line Extension to serve this property.
The Dacono Sanitation District is currently processing a Site Application for a Lift
Station to serve the 110 acre portion of Sweetgrass, which is in their district. The Dacono
Sanitation District has expressed willingness to enter into an IGA with the St. Vrain
Sanitation District for collection and treatment of the sewage from this lift station. This
proposed IGA would significantly reduce the redundancy in wastewater infrastructure,
which is required if the sewage from this portion of Sweetgrass were forced to go to the
Tri Area Sanitation District.
I have attached a letter of support for this project from the City of Dacono. Please call
