RE: ACTION OF BOARD CONCERNING PROBABLE CAUSE HEARING FOR USE BY
SPECIAL REVIEW#1198 FOR AN OIL AND GAS SUPPORT AND SERVICE
FACILITY (BRINE WATER DISPOSAL) - ENVIRO-CYCLE, LLC, CIO MIKE CERVI
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on the 15th day of January, 2001, a Probable Cause Hearing was held
before the Board to consider setting a Show Cause Hearing to determine whether or not Enviro-
Cycle, LLC, do Mike Cervi, P.O. Box 117, LaSalle, Colorado 80645, was in compliance with
certain Conditions of Approval and Development Standards contained in Use by Special Review
Permit#1198 for an Oil and Gas Support and Service facility (brine water disposal) in the A
(Agricultural) Zone District, and
WHEREAS, the alleged violations were said to be occurring on property described as
part of the N1/2 NW1/4 of Section 32, Township 4 North, Range 65 West of the 6th P.M., Weld
County, Colorado, and
WHEREAS, after hearing testimony from the Departments of Planning Services and
Public Health and Environment, the Board deemed it advisable to continue said matter for two
weeks at the request of the applicant to allow Enviro-Cycle, LLC, c/o Mike Cervi, adequate time
to address and resolve the violations, and determine authority on the fract tank cleaning at the
site.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the abovementioned matter be, and hereby is, continued to
January 29, 2001, at 9:00 a.m.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 15th day of January, A.D., 2001.
