Easton Dear Mr. Morrison: This office represents Mr. Richard Bucklen, Personal Representative of the Estate of Charles W. Easton, deceased. As you are aware from discussions with Mr. Anthony Mello, pursuant to Charles W. Easton's Will and a subsequent Settlement Agreement between the devisees of the Estate, it is proposed that the decedent's real property, consisting of a contiguous parcel located at 23482 WCR 48, I aSalle, Colorado, be partitioned into three separate parcels. A copy of the proposed Petition to Partition Real Estate is attached hereto. It is my understanding that your office has taken the position that pursuant to C.R.S.§ 30- 28-101 (10)(c)(II), the Board of County Commissioners for Weld County is entitled to object to the Petition for Partition, on the grounds that the smaller (6 acre) parcel is not a "legal" parcel under Title 30, Article 28 et seq. Colorado Revised Statutes and/or the Weld County Zoning Ordinance. The Weld County Planning Department has been provided all of the information that would be provided in support of an Application for a Recorded Exemption. We understand that the Planning Department has reviewed all of the documentation and has no substantial objection to the proposed partition other than resolving certain "pending" P.U.D. zoning issues related to the property. It is my understanding that as a condition to the Board of Commissioners non-objection to the Petition to Partition, the Estate must vacate any existing P.U.D. Zone Districts that may exist with respect to the subject real property. According to Gloria Dunn at the Weld County Planning Department, the following P.U.D. Zone District "cases" were initiated by Charles W. Easton with respect to the subject real property (none of which have been pursued to completion): (1) Z374, (2) Z464, and (3) Z421. In consideration of the Board of County Commissioners non-objection to the Petition for Partition, the Personal Representative agrees to and hereby does vacate each of the above- described P.U.D. Zone District "cases," and agrees to and does hereby wave any rights the Estate may have as a result of the decedent having initiated and partially prosecuted such cases. Each of the devisees of the Estate concurs and joins the Personal Representative with respect to the vacation and waiver.
