BOARD OF COUNTY COMMISSIONERS

The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial
Center, Greeley, Colorado, September 12, 2001, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were
present, constituting a quorum of the members thereof:

READ ORDINANCE BY TAPE: Read Code Ordinance#2001-6 by tape. Commissioner Vaad moved to
read Code Ordinance #2001-6 by tape. Commissioner Masden seconded the motion, which carried
unanimously.
MINUTES: Commissioner Masden moved to approve the minutes of the Board of County Commissioners
meeting of September 10, 2001, as printed. Commissioner Long seconded the motion, and it carried
unanimously.
ADDITIONS TO AGENDA: There were no additions to the agenda.
CONSENT AGENDA: Commissioner Masden moved to approve the consent agenda as printed.
Commissioner Jerke seconded the motion, and it carried unanimously.
COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports.
PUBLIC INPUT: There was no public input.

WARRANTS: Claud Hanes, Comptroller, presented the following warrants for approval by the Board:
All Funds $276,904.36
Commissioner Vaad moved to approve the warrants as presented by Mr. Hanes. Commissioner Masden
seconded the motion, which carried unanimously.
BIDS:
PRESENT SNOW PLOW FOR PICKUP BID - DEPARTMENT OF PUBLIC WORKS: Pat Persichino,
Director of General Services, presented the bids received from three vendors. Said bid will be considered
for approval on September 26, 2001.
PRESENT SALT AND SAND SPREADER BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino
presented bids received from five vendors. Said bid will be considered for approval on September 26,
2001.
PRESENT AND EMERGENCY APPROVAL ON ACCESS ROAD - SOUTHWEST WELD COUNTY
SERVICE CENTER-FINANCE DEPARTMENT: Mr. Persichino presented the three bids for consideration
and stated emergency approval is requested. Staff recommends acceptance of the bid from T & T
Concrete, Inc., a local vendor who, pursuant to the Weld County Home Rule Charter, should be given
preference when said bid is competitive in price and quality. Responding to Commissioner Vaad, Mr.
Persichino stated the emergency basis is because the Center will be turned over to the County mid or late
October and construction needs to be completed prior to that time. Commissioner Vaad moved to accept
the bid from T &T Concrete, Inc. Seconded by Commissioner Jerke, the motion carried unanimously.
APPROVE 100,000 LB HYDRAULIC WINCH BID- DEPARTMENT OF PUBLIC WORKS: Mr. Persichino
stated the Department of Public Works recommends acceptance of the low bid from Kois Brothers
Equipment Company, in the amount of $17,192.00. Commissioner Masden moved to accept the low bid
as recommended by staff. Commissioner Vaad seconded the motion, which carried unanimously.
APPROVE NORTH JAIL EXPANSION AND LAW ENFORCEMENT ADMINISTRATION BUILDING BID-
GENERAL SERVICES DEPARTMENT: Mr. Persichino stated staff solicited requests for proposals, nine
of which were received. A committee reviewed the proposals and recommends acceptance of the bid
submitted by Roche Constructors, Inc. Commissioner Long moved to accept the low bid as recommended
by staff. Commissioner Masden seconded the motion, which carried unanimously.
NEW BUSINESS:
CONSIDER TEMPORARY ROAD CLOSURE OF WCR 64 CUL-DE-SAC EAST OF WCR 45; AND WCR
4 BETWEEN WCRS 49 AND 53: Frank Hempen, Jr., Director of Public Works, stated the first closure is
of the Weld County Road 64 cul-de-sac to provide storage and use by the airport of the runway area; and
Weld County Road 4 is a routine closure for repair work. Commissioner Jerke moved to approve said
temporary closure. Commissioner Vaad seconded the motion. Responding to Commissioner Masden,
Mr. Hempen said on Road 4 they are doing culvert work in preparation for the work planned in the area.
The motion carried unanimously.
CONSIDER CONTRACT FOR COMMUNITY CORRECTIONS SERVICES AND AUTHORIZE CHAIR TO
SIGN - THE VILLA AT GREELEY, INC.: Jan Zuber, Community Corrections Board, stated this is the
standard contract, on which the only change is the dollar amount. Commissioner Vaad moved to approve
said contract and authorize the Chair to sign. Seconded by Commissioner Long, the motion carried
unanimously.

CONSIDER CONTRACT FOR COMMUNITY CORRECTIONS SERVICES AND AUTHORIZE CHAIR TO
SIGN - CORRECTIONAL MANAGEMENT, INC.: Ms. Zuber stated this contract is for people placed out
of county, and presently they have two clients. Responding to Commissioner Masden, Ms. Zuber stated
the program only includes adults, and explained the circumstances under which an offender might be
placed in another county. Commissioner Vaad moved to approve said contract and authorize the Chair
to sign. Seconded by Commissioner Masden, the motion carried unanimously.
CONSIDER LICENSE AND EXCHANGE AGREEMENT FOR GEOGRAPHIC DATA AND AUTHORIZE
CHAIR TO SIGN-TOWN OF SEVERANCE: Bruce Barker, County Attorney, stated this and the next item
of business are both standard contracts with entities,and the County benefits from certain GIS information
which they share with us. Commissioner Long moved to approve said agreement and authorize the Chair
to sign. The motion, which was seconded by Commissioner Jerke, carried unanimously.
CONSIDER LICENSE AND EXCHANGE AGREEMENT FOR GEOGRAPHIC DATA AND AUTHORIZE
CHAIR TO SIGN - NORTHERN COLORADO WATER CONSERVANCY DISTRICT: Commissioner
Masden moved to approve said agreement and authorize the Chair to sign. The motion, which was
seconded by Commissioner Jerke, carried unanimously.
PLANNING:
CONSIDER REQUEST FROM PLATTE SAND AND GRAVEL,LLC,TO PRE-ADVERTISE SUPPLEMENT
TO SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1306: Kim Ogle,
Department of Planning Services,stated the applicant has requested preadvertisement for a Board hearing
on October 10, and the case is scheduled for Planning Commission on October 2. Responding to
Commissioner Masden, Mr. Barker stated we handle five to ten preadvertisement requests per year,when
applicants are anxious to get started on their project,or financing requirements,etc.require an earlier start.
Carol Harding, Deputy Clerk to the Board, explained there is approximately a three-week difference in the
date of the Board hearing when the notice is published prior to the Planning Commission hearing. She
also stated in this case, Clerk to the Board staff will also notify anyone at the first Board hearing who
signed the Attendance Sheet. Commissioner Jerke moved to approve said request. Commissioner Vaad
seconded the motion, and stated he is hesitant because proper notification is important and public interest
is high on this case. He stated he is comfortable with those efforts to notify those who had attended the
hearing. Chair Geile stated he wants to expedite the process and it has been dragging on long enough.
Commissioner Masden stated it appears the public will be notified with due process, so he will support the
motion. The motion carried unanimously.
FIRST READING OF CODE ORDINANCE #2001-6, IN THE MATTER OF ENACTING CHAPTER 21,
AREAS OF ACTIVITIES OF STATE INTEREST (§1041 REGULATIONS), OF THE WELD COUNTY
CODE: Mr. Barker stated he was asked to establish a procedure to handle Major Facilities of Public
Utilities, and on April 16, 2001, the Board held a hearing to designate them as areas of state interest. In
addition,the Board directed staff to set regulations in order to regulate electrical public utilities. Mr. Barker
recommended this to be a new chapter of the Weld County Code, and Code Ordinance #2001-6 is his
draft. Chapter 21 would include three Articles; one describing the administrative regulations, or method;
two describing dealing with permit regulations, or how permits would occur; and three describing site
selection and construction of Major Facilities of a Public Utility, or being specific as to Major facilities of
large electrical public utilities and allowing specific areas for the Board to look at in the area of mitigation.
Mr. Barker stated notice was mailed to individuals who appeared at the April hearing who provided
addresses;however,no written comments were received. Responding to Commissioner Vaad, Mr. Barker
stated he could solicit a response from the Colorado Public Utilities Commission prior to second reading.
John Byer, Tri-State Electrical Company, a provider for United Power, stated his company has a
transmission line in the area of Firestone, and they are currently reviewing the draft regulations and will
provide comments before the next reading, either in writing or speaking on the issue at that time. He

stated there are some minor modifications they may request, and he is familiar with the basis and reason
for doing this. Chair Geile summarized these regulations are under consideration because currently, if a
Major Facility of a Public Utility is denied locally, the appeal goes to the Public Utilities Commission. Weld
County's applications, therefore, go from the Planning Commission to the Public Utilities Commission
without ever being heard by elected officials. The addition of these regulations allows the Board of
Commissioners to be the body which hears those requests,therefore,elected officials are making the final
decision for the local body, instead of an appointed body. Mr. Byer restated that his comments will appear
before the next reading. Commissioner Vaad reiterated he would like a letter sent to the Public Utilities
Commission. Commissioner Jerke questioned the distance of 50 miles required to be included in the area
shown on the sketch plan, indicated in Section 21-3-330.B.5.a.ii. Mr. Barker indicated the intention is to
show the site in relationship to other plants, etc., and the number of miles may be lowered by the Board.
After further discussion, Chair Geile stated he would like to hear other comments before amending. Chair
Geile also ascertained Section 21-2-220 regarding consultants enables the County to charge the applicant
for costs incurred by engaging consultants. Mr. Barker responded it does, as well as a provision for the
applicant to request any decision regarding engagement of a consultant may be reviewed by the Board
of County Commissioners. Commissioner Jerke asked for an informal work session before second reading
to allow staff time to incorporate any changes for Board review prior to second reading. Mr. Barker stated
extra time was built into the schedule to allow a work session to be scheduled. Mr. Byer stated he would
be happy to participate in that type of process; and indicated south Weld County mainly has transmission
lines to serve other areas,although Tri-State is unique since it usually serves local customers. Chair Geile
indicated other companies should be solicited for a response, in order to help the Board understand the
more technical aspects of this issue. Mr. Barker indicated he will schedule a work session and invite
appropriate participation. Commissioner Vaad moved to approve Code Ordinance #2001-6 on first
reading. Commissioner Masden seconded the motion, which carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent
agenda. Ordinance #2001-6 was approved on first reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Acting Clerk to the Board.
There being no further business, this meeting was adjourned at 9:55 a.m.
