RE: Use by Special Review Permit for Proposed Expansion Mining Operation
To Whom it May Concern:
On behalf of CAMAS Colorado, Inc., this letter and accompanying information constitute
a request for an amendment to the Weld County Use by Special Review (USR) Permit No.
877 for expansion of the Longmont Distel Operations (Distel Farm Project). A Weld
County USR permit amendment application is enclosed. A copy of the report entitled
Application for Amendment to Regular 112 Permit for Construction Materials and Weld
County USR Permit is also provided as Attachment 1 to this application for informational
purposes. The submittal package also includes a List of Attachments and Responses to Use
by Special Review Application Requirements and Questionnaire. Additional information
is provided in the Addendum to Attachment 1.
An amendment to the current USR Permit No. 877 is requested to allow the mining of sand
and gravel resources on approximately 240 acres of leased land adjacent to the Distel Farm
Project, currently operated by CAMAS Colorado, Inc. The existing operation and
proposed expansion area are located in Sections 7, 8, 17 and 18, Township 2 North, Range
68 West, in southern Weld County, as shown on the attached Vicinity Map (see Exhibit
B, Attachment 1). The proposed expansion area is located south of County Road 119,
southwest of the convergence of St. Vrain Creek and Boulder Creek and just north of
County Road 20 1/. The only municipality within three miles of the proposed operation
is the City of Longmont, Colorado.

The parcels of land proposed for expansion include the Peschel property, located to the
west of existing operations, and the Longmont property, located to the northeast of existing
operations (see Exhibit B, Attachment 1). These properties are currently used for livestock
grazing and agriculture. A 10-acre area of the Distel property will also be mined. This
area was previously permitted by CAMAS but was not included in the mine limits.
The property will be divided into two phases for mining. Phase 1, the Peschel property,
consists of approximately 142 acres of land and will take approximately 3 to 4 years to
mine. Phase 2 includes the Longmont property (approximately 98 acres) and the Distel
Expansion (approximately 10 acres). The Longmont property will take approximately 3
to 4 years to mine and the Distel Expansion will take approximately 0.5 years to mine. The
total mining operation proposed in this permit application is expected to commence around
January 2001 and be completed by 2007 to 2009. The limits of the expansion areas are
shown in on Exhibit B, Attachment 1. The mine plan is presented in Exhibit D,
Attachment 1.
The mined pit areas will be reclaimed as parklands, including wetlands, ponds and upland
meadow. The proposed reclamation plan is presented in Exhibit F, Attachment 1.
The requested amendment proposes no changes to the mining methods, work force,
equipment or transportation requirements previously permitted under USR 877. The
mining rate will be increased from 660,000 tons/year to 800,000 tones/year. Material in
the expansion area will be loaded on an existing movable overland conveyor and
transported to the previously permitted area for processing. Access roads required to
develop the expansion have previously been constructed to access existing mining areas
that lie on the east and south boundaries of the proposed mining area.
The proposed use is compatible with current land uses and Weld County planning goals
and policies. The proposed mine area may be characterized as having "limiting site
factors"due to its location in the 100-yr flood plain of St. Vrain Creek. Post-mining land
uses include wildlife habitat and recreation. These uses are compatible with surrounding
land uses and are consistent with minimum density development and other Mixed Use
Development Area planning goals and policies.

RESPONSE TO USR APPLICATION REQUIREMENTS
1. A completed, signed original USR application form, 24 copies and the required applicati on

2. A detailed discussion of the mining plan is contained in Exhibit D,Attachment 1 (copy of
Division of Minerals and Geology 112 (DMG) Permit Application).

CAMAS Colorado,Inc. has a Weld County Road Maintenance and Improvements
Agreement for current operations. A copy of the agreeme_tt is provided in Addendum 1 of
the attached DMG Permit Application.
e) The size of the individual mining areas is discussed in Exhibit D, Attachment 1.
Approximately 142 acres of land on the Peschel Property will be mined in Phase 1. At the
completion of mining in this area, approximately 98 acres on the property will be mined in
Phase 2. Approximately 10 acres of land in the Distel property, an area that was previously
permitted,will be mined in conjunction with or at the completion of the Longmont property.
f)Phase 1,the Peschel property will begin at the completion of current mining operation;in
the Bigelow property, in early 2001, and is expected to lake approximately 3 to 4 years.
Mining of the Longmont property will begin at the completion of the Peschel property. It is
expected to take approximately 3 to 4 years. Mining of the Distel expansion is expected to
take approximately 0.5 years. This area will be mined in conjunction with or at the
completion of the Longmont property. The total expansion operation proposed in this
permit application is expected to take approximately 7 to 9 years and to be completed by
2007 to 2009.

g) The commodity of interest is commercially saleable sand and gravel. The deposit co.asists
of alluvial sand and gravel overlain by topsoil and overburden. The topsoil layer and
overburden layer range from 0 to 5 feet in thickness,while the sand and gravel deposit is 5 to
18 feet thick. The deposit is underlain by shale.
h)Post reclamation land use will be suitable for wildlife habitat and recreation. A
reclamation plan and reclamation map are provided in Exhibits E and F, respectively,
Attachment 1.
i) The proposed reclamation measures presented in Exhibit E of the 112 Permit Application
are based on the current USR-877 and from SCS guidance for properties in the immediate
vicinity of the Longmont Distel Operations.
3. A listing of property owners within 500 feet of the expansion areas is attached to this
application. The source of this list is the Weld County Assessor's Office and the Boulder
County Land Use Office. This list was complied in September 2000.

5. Documents to be submitted by the Applicant:
a) The reclamation plan, as submitted to the Colorado Die lion of Minerals and Geology,is
provided in Exhibit E, Attachment 1. The Reclamation.Plan Map is provided in Exhibit F,
Attachment 1.
b) The water augmentation plan for operational and post closure periods will be submitted to
the State Engineers Office.
c) Cross-sections for drainage structures to be constructed for reclamation are provided in
Exhibit F.4,Attachment 1. No modifications of county or local access roads will be required
as part of this amendment.
d) No new haul roads will be required to develop the expansion. Haul and access roads that
have been constructed for the existing operations adjacent :o the amendment areas will be
adequate for the proposed operation.

6. The proposed use is consistent with the Weld County Comprehensive Plan.
Historically,the proposed expansion areas have been used primarily for livestock grazing.
Soils are suitable for pasture land. The extraction of mineral resources will not result in a
significant loss of prime agricultural land.
The properties are located within Weld County's Mixed-Use Development(MUD)area.
Post-mining conditions will be suitable for urban open space and recreation areas. This is
compatible with surrounding post-mining land use. A 100-foot buffer will be left along St.
Vrain Creek, leaving riparian habitat undisturbed by the mining operations. Following
mining,the area will enhance the quality of the MUD by providing open space for wildlife
movement and visual qualities.
Weld County encourages industrial development that is appropriately located in relation to
surrounding land uses. Mining is currently a major local land use. The operator will extend
existing industrial operations and continue to contribute tax revenues and employment
opportunities to the area. The development is self-supporting and will provide local relief
with respect to county road maintenance expenses.
7. The proposed expansion areas are located in Weld County's MUD area along I-25 that will
be developed in response to urban growth pressures. Because the majority of the site is
located within the 100-year flood plain of St.Vrain Creek. Weld County classifies the area as
having "limiting site factors"due to flood hazard potential. Weld County Department of
Planning Services considers land with limiting site factors to be suitable for agriculture,
recreation and wildlife uses. The site will be reclaimed as open space with wetlands,ponds
and upland meadows. The post-mining land use includes recreation and wildlife habitat. The
final reclamation plan has been developed in conjunction with Longmont Parks and
Recreation to ensure compatibility of the post-mining land-use with the long term planniig
goals of the area.
In response to urban growth in the area,the southern sections of the Peschel and Bigelow
properties may potentially be developed as residential areas by the landowners after the
completion of reclamation.
8. Presently, the proposed mining area is used for agricultural production and pasture.
9. The applicant will secure the site during non-working. All mining and processing operations
will be carried out in accordance with applicable permits. The project is not anticipated to
pose risks to the health and safety of local residents or Weld County.
10. Current local surrounding land uses includes agriculture, livestock grazing, oil and gas
production,mining and residential. The permitted use will be compatible with existing cases,

11. The expansion areas are located in the MUD area. The post-mining uses include wildlife
habitat and recreation. These uses are compatible with MUD goals and the limiting site
factors. The final reclamation plan has been developed in conjunction with Longmont Parks
and Recreation to ensure compatibility of the post-mining land-use with the long term
planning goals of the area.
In response to urban growth in the area,the southern sections of the Peschel and Bigelow
properties may potentially be developed as residential areas by the landowners after the
completion of reclamation
12. The majority of the site is located within the 100-yr flood plain of St. Vrain Creek. The area
is designated as Zone A corresponding to Floodprone Zone FP-1,base flood elevations and
other flood hazard factors undefined. However,mining activities in the expansion area; are
not anticipated to have adverse impacts on local flood hazard potential. Mining activities are
not expected to impact flood levels in the reach of the Saint Vrain Creek above the mining
area. The open pit will be located within the 100-year flood plain, The post-mining lake will
increase local flood storage capacity and reduce downstream flood hazards.
Only small temporary topsoil and overburden stockpiles will be constructed around the
periphery of the pit near Saint Vrain Creek. These stockpiles will be used to reclaim the
open pit slopes. Reclamation of the pit slopes will be progressive and the temporary
stockpiles will be removed when mining in each area is completed.
A permanent overburden stockpile will be developed in the southern portion of the Peschel
property, approximately 2,000 feet south of Saint Vrain Creek, at the southern limit of the
FEMA designated 100-year flood plain (as shown on the FEMA Flood Insurance Rate Map
Panel 850). It is anticipated that the area will be raised approximately 3 feet above current
ground level, Because the permanent overburden stockpile is located near the limit of the
flood plain and outside the portion of the floodway that will carry high velocity flood flows
and debris, the stockpile is not expected to affect flood levels. There is a slight potential for
standing floodwaters to extend to the stockpile area; however, the stockpile will not be
located in an area that will experience high velocity flood flows. As such, the permanent
stockpile is not expected to impact the 100-year flood level or present a flood hazard.
If required by Weld County, a Flood Hazard Development Permit will be obtained before
mining activities commence on the Peschel property.
No other permanent structures will be created in flood-prone areas in the proposed expansion
areas. The proposed expansion areas do not lie in airport overlay or geologic hazard overlay
districts.
13.Mine production will be increased from the current rate of 660,000 tons/year to 300,000
tons/year. No change in the type of processing is proposed as part of this amendment. The
water supply plan during operations is being updated to reflect the change in production rate
and will he submitted to the State Engineers Office

14. Required legal right-to-enter documentation for the expansion properties are provided in
Exhibit N, Attachment 1.
15. No increases in equipment usage or changes in mining method are proposed as part of this
amendment. The noise study that was previously submitted with the current USR 877 permit
is applicable for this amendment.

f)There will be no change in the equipment fleet from the existing USR 877 Permit. Loaders
and scrapers will be used in the mining operations, On-road haul truck will be used to
transport material off of the existing plant property.
g)Fire protection is provided by Mountain View Fire Protection District, located at 9119
County Line Road, Longmont, CO.
h) A water supply plan is in place for the existing permitted operations. The source of
replacement water is Consumptive Use credit from the Coffin-Davis Ditch during the
irrigation season and a lease from the City if Longmont for the non-irrigation season. The
water supply plan will be updated to reflect the change in production for the expansion
operations.
i)The sewage disposal system at the plant and office site is a septic vault.
j) No storage of items or warehouse facilities are proposed for the property,

10, Extracted resources are temporarily stored in stockpiles on the previously permitted plant
site. Topsoil and overburden will be temporarily stored in stockpiles on the permitted
properties. Reclamation includes the construction of a permanent overburden stockpiles at
the south ends of the Peschel property. This stockpile is expected to be built to 3 feet above
the current topography. The location of stockpile is shown on Exhibit f.1, Attachment 1.

1.0 INTRODUCTION
CAMAS Colorado, Inc. proposes to expand the existing Longmont Distel Operations
sand and gravel operation within Sections 7 and 8, Township 2 North, Range 68 West in
Weld, County, Colorado.
This document provides supporting information for application to the State of Colorado,
Division of Minerals and Geology (DMG) for amendment of the Construction Material
Regular 112 Operation Mining and Reclamation Permit M-89-029. Concurrently, an
application to the Weld County Planning Commission and Board of County
Commissioners for amendment of Use by Special Review (USR) Permit 877 has been
prepared and issued.
The Longmont Distel Operations are located south of County Road 119, southwest of the
convergence of St. Vrain and Boulder Creeks, just north of Weld County Road 20`/2.
Previously permitted areas include the Sherwood, Distel and Bigelow properties. The
proposed expansion includes the development of three parcels of leased land. The
locations of the properties are located on Exhibit B.
Parcel A, the Longmont property, is approximately 98 acres of land located within the SE
'/4 quadrant of Section 8, south of St. Vrain Creek. Parcel B, the Peschel property, is
approximately 142 acres of land located within the SW '/4 quadrant of Section 7. Parcel C
is approximately 10 acres of land located along the northern boundary of the previously
permitted Distel property, within the SE `/4 of the SW `/4 of section 8. This area was not
included in the original mine limits of the Distel property because it was forested.
However, because trees in this area have since died, CAMAS Colorado now proposes to
mine the area. The area will be regraded at the completion of mining and trees planted.
The projected mining rate for the expansion properties is approximately 800,000
tons/year. This is an increase of 140,000 tons/year over the current production rate of
660,000 tones/year. Mining of the Peschel property will begin at the completion of
current mining operations in the Bigelow property, in early 2001, and is expected to take
approximately three to four years. Mining of the Longmont property will begin at the
completion of the Peschel property and is expected to take approximately three to four
years. Mining of the Distel expansion is expected to take approximately 0.5 years. This
area will be mined in conjunction with or at the completion of the Longmont property.
The total proposed expansion operations are expected to take approximately seven to nine
years and to be completed in 2007 to 2009.

2.0 EXHIBIT A - LEGAL DESCRIPTION
Longmont Property
The proposed expansion of the Longmont Distel Operations includes the development of
two parcels of leased land with a total area of approximately 240 acres. The Longmont
property consists of approximately 98 acres, located south of St. Vrain Creek. This
property is located to the east and northeast of the Distel property, an existing permitted
mine property. The south end of the Longmont property has already been permitted for
future development with a previous amendment to Regular 112 Operation Mining and
Reclamation Permit M-89-029 and Regular 112 Operation Mining and Reclamation
Permit M-89-029.
The legal description of the Longmont property follows:
Parcel 30 and 31: The East half(E1/2) of the Southeast quarter (SE1/4), and
the Southeast quarter (SE1/4) of the Northeast quarter (NE1/4) of Section
eight (8), Township two (2) North, Range sixty-eight (68) West of the 6th
P.M., Weld County, Colorado;
AND, that portion of the Southeast quarter (SE1/4) of the Northeast quarter
(NE1/4) of the Northeast quarter (NE1/4) of said Section eight (8), lying
Southeasterly of the right of way for ingress and egress hereinafter described.
Parcel 32: The Northwest quarter (NW 1/4) of the Southeast quarter (SE1/4)
and the Southwest quarter (SW1/4) of the Northeast quarter (NE1/4) of
Section eight (8), Township two (2) North, Range sixty-eight (68) West of
the 6t' P.M., Weld County, Colorado, together with all of SELLER's right to
existing rights of way and easements for ingress and egress to the property.
Peschel Property
The Peschel property consists of approximately 142 acres. This property is located to the
west of the Sherwood property, an existing permitted mine property. The legal

4.0 EXHIBIT C - PRE-MINING INFORMATION OF AFFECTED
LANDS
4.1 Immediately Adjacent Land Owners of Record
Property ownership information for immediately adjacent surface landowners of record
and of owners of record within 500 feet of the proposed expansion properties is listed on
Exhibit C.1.
4.2 Surface Features and Man-made Structures
Longmont Property
No residences are located on the Longmont property or within 200 feet of the property
boundary. The nearest residences are located approximately 1500 ft south of the
proposed mining area limits. Residences within one half mile of the proposed expansion
properties are shown on Exhibit C.1.
An abandoned and plugged crude oil well and associated tank and meter house, are
located in the northeast section of the Longmont property. The sales line from the well
runs southwest from this well to the property boundary, then west along the property
boundary where it crosses the St. Vrain Creek and terminates at the tank battery located
north of the creek. This site is currently used as a drilling practice site. The site is
accessed by a dirt road that runs north from CAMAS Colorado' plant site on Weld
County Road 20%z. The locations of these structures and ownership information are
shown on Exhibit C.1.
A buried electric utility line runs to a utility pole located south of the oil well and meter
house. A temporary overhead electric utility line runs from this pole and travels west,
along the northern Longmont property boundary, to the current mining operations in the
Bigelow property. No other electrical, communication lines or easements exist on this
property.
Peschel Property
Two residences exist on the Peschel property, both owned by the surface landowner of
record of the Peschel property. A house is located on the western boundary of the
Peschel property, adjacent to Weld County Road 1. The owner will demolish this house.
A second house is located along the east edge of the Peschel property, adjacent to Dry

Creek. Electric and communication lines, a gas line and a water line to this residence run
along the access road from Weld County Road I. An agreement will be finalized
between the owners of the utilities and the operator for the relocation of all utilities. An
agreement will be finalized between the operator and the surface landowner that limits the
distance of mining from the residence. No other structures or utilities exist within the
property boundaries.
A residence is located south of the Peschel property boundary, on Weld County Road 1,
within 200 feet of the proposed mine limit. Mining will be limited to within 200 feet of
the residence unless a different agreement of the buffer zone is reached between the
operator and the surface landowner. No stability problems or impact to the property or
residence are expected as a result of mining activities. Water is supplied to this house
from a water main running adjacent to County Line Road 1..
Weld County Road 1 is located along the western boundary of the Peschel property. This
road will not be disturbed during mining or reclamation activities. An agreement will be
finalized between the appropriate agencies and the operator that limits the distance of
mining from the road. No other structures are located within 200 feet of the Peschel
property boundary. Residences within one half mile of the proposed expansion properties
are shown on Exhibit C.1.
Distel Property Expansion
Information related to the Distel property was submitted with the original Distel property
permit application. There are no structures located within 200 feet of the property
boundary.
Surface Water Features
Local surface water features are shown on Exhibit C.3. The primary surface water
features within 200 feet of the proposed expansion areas include St. Vrain Creek, located
adjacent to the north boundary of the Longmont and the Peschel properties and Boulder
Creek, located a minimum of 250 feet to the east of the Longmont property. A 100-foot
buffer will be maintained adjacent to St. Vrain Creek to prevent impact to the riparian
areas located next to the creek. Dry Creek, an ephemeral stream, runs through the
Peschel property. A 25-foot buffer will be maintained adjacent to this creek to preserve
the natural channel.

The Coffin-Davis Ditch, an irrigation tailwater ditch, crosses the Bigelow property from
south to north and discharges to St. Vrain Creek. A lateral branches off of the main ditch
to the south of the mine area and intersects the Bigelow property approximately 1000 feet
east of the main ditch. A second irrigation ditch, the Bonus Lateral Ditch, is located
along the western boundary of the Peschel property, along Weld County Road 1.
A FEMA Flood Insurance Study was published for St. Vrain Creek. Most of the
Longmont and Peschel properties are located within the estimated 100-year floodplain
area for St. Vrain Creek, as shown on Exhibit C.1. Topography
Topography may be characterized as flat to very gently sloping over the areas proposed
for mining. Surface slopes are generally to the northeast, toward St. Vrain Creek. Current
site topography is shown on Exhibit B and on the Mine Plan Map, Exhibit D.
4.3 Area of Affected Lands
The proposed areas to be permitted include 98 acres in the Longmont property and 142
acres in the Peschel property. A 10-acre parcel of land in the Distel property will also be
mined. This area has previously been permitted but was not included in the original mine
limits for the Distel property. The total area expected to be disturbed, including the mine
pits, permanent and temporary overburden and topsoil stockpiles, and access roads will
be limited to these areas.
4.4 Vegetation
Vegetation in the expansion areas consists primarily of an upland mixed grass vegetation
community, dominated by herbaceous grasses and forbs, with a few subshrubs.
Dominant grasses identified on the Longmont property include inland saltgrass, western
wheatgrass, alkali sacaton and cheatgrass and the forbs include whitetop, ragweed,
horseweed, kochia and Canada thistle. Subshrub include winter sage and snowberry.
Intermediate wheatgrass has been planted in the southern half of the Longmont property
and flourishes in this area.
Savage and Savage, Inc. conducted jurisdictional wetland delineations for the Longmont
property (October 1999) and the Peschel property (February 1998). Five small
jurisdictional wetlands were identified on the Longmont property. The total area of these
wetlands is 1.14 acres, including 0.88 acres of cattail marsh vegetation and 0.26 acres of
wet meadow vegetation. The wetlands are located within relict alluvial meanders and
swales and on an alluvial terrace adjacent to the St. Vrain Creek. Two jurisdictional

wetlands, with a total area of 0.46 acres, were identified on the Peschel property. These
wetlands exist in topographic lows and consist of a cattail marsh and a cattail fringe
vegetation.
The proposed mining of the Longmont property includes the excavation of jurisdictional
wetlands. If required, an appropriate U.S. Army Corps of Engineers (COE) permit will
be obtained prior to the disturbance of these areas. Mining of the Peschel property is not
expected to disturb any jurisdictional wetlands.
Riparian woodland areas are found adjacent to St. Vrain Creek outside the proposed
mining area. The approximate extent of these vegetative zones is shown on Exhibit C.3.
4.5 Water Resources
Surface water features are identified in Exhibit C.3. Water information, including
potential impacts, consumptive water use and the water augmentation plan, are discussed
in Exhibit G.
Waters of the United States were identified during the delineation of jurisdictional
wetlands. Two flooded historic sand and gravel pits located near the east boundary of the
Longmont property were identified as Waters of the United States. Proposed mining
activities in the Longmont property include the excavation of the area containing these
pits. If required, an appropriate COE permit will be obtained prior to disturbance of these
waters.
Two areas within the Peschel property were also identified as Waters of the United
States. These include a flooded historic sand and gravel pit located south of St. Vrain
Creek and Dry Creek, an ephemeral stream. It is not anticipated that these areas will be
disturbed during mining or relamation activities.
Information on the location and ownership of groundwater wells located within one-half
mile of the proposed mining area is provided in Exhibit C.4.
4.6 Soils
The distribution of soils in the expansion areas is shown on Exhibit C.2. Surficial soils
consist of aquolls, aquepts and Bankard sandy loam over the majority of the site, with
lesser amounts of Vona sandy loam occurring in the southern portion of the Peschel
property. These soils are described in Soils Survey of Weld County, Southern Part

5.0 EXHIBIT D - MINING PLAN AND MINE PLAN MAP
5.1 General
The proposed expansion activities are anticipated to disturb approximately 214.8 acres of
leased land located south of St. Vrain Creek. This includes 88.6 acres in the Longmont
property, 116.2 acres in the Peschel property and 10 acres in the Distel property. The
commodity of interest is commercially saleable sand and gravel. The deposit consists of
alluvial sand and gravel overlain by topsoil and overburden. The deposit is underlain by
shale. The sand and gravel deposit is cataloged in the report Sand, Gravel and Quarry
Resources, Colorado Front Range Counties (Colorado Geologic Survey, 1974).
The maximum depth of excavation will be approximately 20 feet, to the shale bedrock
underlying the sand and gravel resource. The alluvial groundwater level lies 2 to 5 feet
below natural ground level. The deposit is therefore classified as a wet alluvial deposit.
Dewatering will be required to facilitate mining operations.
The limits of the proposed mining areas are shown in Exhibit D.
5.2 Mining Method
Dry mining techniques will be used. Initially, a dewatering ditch will be excavated
around the perimeter of the mining area. Groundwater recovered in the dewatering ditch
will be discharged in accordance with Colorado/NPDES discharge permit requirements.
Topsoil and overburden will be salvaged and stockpiled separately. These materials will
be placed in temporary stockpiles located within the mining limits, around the perimeter
of the mining area or on previously permitted areas. Topsoil and overburden stockpile
areas are shown on the Mine Plan Map in Exhibit D.
The deposit will be mined using scrapers and front-end loaders. Mined material will be
loaded on a conveyor system for transport to the previously permitted processing area.
Sections of the conveyor system are in place for current mining operations. Additional
conveyors may be constructed inside the expansion areas to facilitate transport of the
resource. All processing of mined material will be accomplished in the previously
permitted processing area located south of the Distel property(see Exhibit B).
The majority of access and haulage roads required for the proposed operations have
already been constructed for access to the previously permitted mining areas. Less than 2

acres of land may be disturbed within the permit limits to extend the existing roads into
each of the two expansion areas.
5.3 Mining Schedule
The projected production rate is 800,000 tons/year. Mining of the Peschel property is
expected to begin in early 2001, at the completion of current mining operations in the
Bigelow property. Mining will be completed in approximately three to four years from
the start of operations.
Mining of the Longmont property will commence at the completion of resource
extraction in the Peschel property. Mining in this property will be completed in
approximately three to four years from the start of operations.
Mining of the Distel property expansion will be completed in conjunction with, or at
completion of, mining of the Longmont property. Mining will be completed in
approximately 0.5 years from the start of operations.
The total expansion operation proposed in this permit application is expected to take
approximately seven to nine years and be completed in 2007 to 2009.
5.4 Surface Water Management
All mine areas will drain internally. Uncontrolled releases of surface water and sediment
from mining areas will not occur. Stormwater collected in the open pit will be managed
in accordance with Colorado/NPDES discharge permit requirements. Sediment generated
from localized stormwater runoff and surface drainage will be detained in the ponds
created by the proposed mining operation or in mined out areas in currently permitted
areas.
5.5 Disturbance Areas
The maximum area that will be disturbed by the expansion operations, at any point during
the operation, will be 214.8 acres.
Previously permitted and disturbed areas that will be reclaimed in conjunction with these
areas include 74.9 acres in the Distel property and 92.5 acres in the Bigelow property.

6.0 EXHIBIT E - RECLAMATION PLAN
The reclamation plan includes reclaiming previously permitted Longmont Distel
Operations (the Distel and Bigelow properties) along with the proposed expansion areas
(the Longmont and Peschel properties and the Distel Expansion) as a greenbelt containing
wetlands, ponds and upland meadows. The final land use and layout of the reclaimed
areas has been developed in conjunction with Longmont Parks and Recreation and the
land owners to ensure compatibility with the long term planning goals of the area.
The reclamation plan presented in this amendment includes a revised reclamation plan for
the Distel and Bigelow properties. Reclamation of the Sherwood Property is not included
in this plan.
6.1 Reclaimed Landform
Reclamation of the combined Longmont, Distel and Bigelow properties will include
creation of two 15-acre ponds and three wetland areas with a combined size of 20 acres.
The remainder of the disturbed area, approximately 216 acres, will be reclaimed as
upland meadows. The Distel property expansion area will be regraded and replanted with
trees. A total of 266 acres will be reclaimed in the Longmont/Distel/Bigelow area.
Reclamation of the Peschel property will include creation of two ponds, 35 and 10 acres,
and three wetland areas with a combined size of 14 acres. The remainder of the disturbed
area, approximately 57 acres, will be reclaimed as upland meadows. A total of 116 acres
will be reclaimed in the Peschel property.
The proposed layout of the wetlands and ponds to be constructed during reclamation is
illustrated on Exhibit F.1. The final location of these units is dependent on the post-
mining topography of the disturbed area.
An alternative reclamation plan for the Peschel property is to backfill the south section of
the property for future residential development. The central and north sections of the
property will be developed as a pond and possibly as a wetland area. The northwest
corner of the property will be backfilled for potential future commercial development.
Greenways and trails will be incorporated into the development along St. Vrain Creek
and Dry Creek. The proposed layout of this alternative reclamation plan is illustrated on
Exhibit F.2.

This application is for the permitting of the main reclamation option. At such time as the
alternative reclamation plan for Peschel should be selected, appropriate technical
revisions will be submitted and zoning changes will be obtained, if necessary.
6.2 Post-Mining Land Use
Historically, the Longmont and Peschel properties have been used primarily for
livestock grazing. Because the majority of the site is located within the 100-year flood
plain of St. Vrain Creek, Weld County classifies the area as having "limiting site factors"
due to flood hazard potential. Weld County Department of Planning Services considers
land with limiting site factors to be suitable for agriculture, recreation and wildlife uses.
The post-mining land use includes recreation and wildlife habitat. These uses are
compatible with the surrounding land uses and with the Weld County planning goals.
The properties are located within Weld County's Mixed-Use Development area along I-
25, which will potentially be developed in response to urban growth pressure. The
southern portions of the Peschel and Bigelow properties will potentially be developed as
residential areas by the landowners after the completion of reclamation.

6.3 Regrading
Site grading will be performed to create stable topography that will be consistent with
post-closure land uses. Highwalls and pit bottoms in upland meadow areas will be
regraded to a slope no steeper than 4H:1 V in the Longmont/Distel/Bigelow properties
and 3H:1 V in the Peschel property. Slopes of pond shores will be regraded to a slope no
steeper that 3W1 V within 5 feet above to 10 feet below the post-mine water level.
Where feasible, highwalls will be cut back to the property line to achieve the final slope.
Along St. Vrain Creek and Dry Creek the final topography will be achieved by
backfilling highwalls. The highwall crest will not be cut back in order to protect the
buffer zones along the creeks.
Six inches to 12 inches of topsoil, taken from topsoil stockpiles, will be spread over all
regraded surfaces above the post-mining pond levels and the areas revegetated as
wetlands or upland meadows.
Concurrently with mining activities, the southern portion of the Bigelow property will be
backfilled with overburden to near current ground level. A permanent overburden
stockpile will be developed in this area for excess overburden, as shown on Exhibit F.1.
The elevation of the permanent stockpile is anticipated to be approximately 2 feet above
current ground level; however, the volume of excess overburden may necessitate an
increase or decrease in the final elevation of the permanent stockpile. Slopes of the
overburden stockpiles will be graded to a stable maximum slope of 4H:1 V. A berm will
be constructed along the eastern edge of the permanent stockpile to provide a partial
visual barrier between the reclaimed area and the plant site. Slopes of the berm will be
graded to a stable maximum slope of 2H:1V. The area will be covered with topsoil and
revegetated.
Concurrently with mining activities, the southern portion of the Peschel property will be
backfilled with overburden to near current ground level. A permanent overburden
stockpile will be developed in this area for excess overburden, as shown on Exhibit F.
The elevation of the permanent stockpile is anticipated to be approximately 0 to 3 feet
above current ground level; however, the volume of excess overburden may necessitate
an increase or decrease in the final elevation of the permanent stockpile. It is anticipated
that this area may be developed as residential housing at some future date by the
landowner. Slopes of the overburden stockpiles will be graded to a stable maximum
slope of 3H:1 V. The area will be covered with topsoil and revegetated.

Access roads and the conveyor corridors will be scarified to a depth of 12 inches, covered
with topsoil and revegetated.
Estimated quantities of overburden and topsoil that will be stockpiled during mining and
regrade volumes required for reclamation are summarized in Table 6.1. The costs of
reclamation activities are discussed in Exhibit L.
6.4 Reclamation Schedule
Whenever possible, the operator will progressively or concurrently reclaim areas where
• mining has been completed. Reclamation, including regrading, seeding and wetlands
construction activities, will be completed in 2 to 5 years following the completion of
mining operations.
6.5 Water
Overburden and mine materials will be inert and impacts to local surface water or
groundwater quality are not anticipated to occur as a result of mining or reclamation
activities in the proposed expansion areas. The applicant's Colorado/NPDES discharge
permit will be updated to incorporate discharges from the proposed expansion area. The
applicant will comply with all applicable State water quality laws and regulations.
The creation of wetlands and ponds at the end of mining will result in an increase in
surface evaporation. A water augmentation plan will be developed and submitted to the
State Engineer's Office, Colorado Division of Water Resources, to address post-mining
consumptive use of water.
Any temporary facilities for surface water management that are constructed during the
mining operation will be removed, stabilized and revegetated during site reclamation.
6.6 Reconstruction of the Drainage Pattern
Reclamation of the combined Bigelow/Distel/Longmont area includes the construction of
a series of two ponds and three wetlands along a single flow path. Inflow to the wetlands
and ponds will be from indirect groundwater flow. Water from the Coffin-Davis
irrigation ditch will also flow into the first wetland at a point along the western edge of
the Bigelow property.. The system discharges to St. Vrain Creek, to the northeast of the
Longmont Property, via a spillway and protected outflow channel.

Typical sections of a wetlands area and pond are illustrated in Exhibit F.3. The rate of
inflow to the system from the Coffin-Davis ditch will be controlled by a flow control box,
as is illustrated in Exhibit F.4. This structure also includes a bypass to St. Vrain Creek,
along the original irrigation ditch, that will allow the flow into the wetlands to be
controlled during periods of high flow. The flow control box was designed to operate the
same as existing flow control structures currently in place in irrigation ditches in the area.
Reclamation of the Peschel property includes the construction of three wetlands
connected in series, located along the northern section of the mined-out area. Inflow to
the wetlands will be from indirect groundwater flow. Water from the Bonus Lateral
irrigation ditch will also flow into the first wetland at a point along the western edge of
the Peschel property. The wetlands discharge to St. Vrain, to the north of the Peschel
Property via groundwater outflow. Two ponds will be constructed in the central and
southern sections of the property. Flow into and out of these ponds will be alluvial
groundwater.
The location of the wetlands and ponds is shown on Exhibit F.1. The final location of
these units is dependent on the topography of the bottom of the mine pits at the
completion of mining. Where feasible, wetlands and ponds will be positioned in
topographic lows to minimize material movement and excavation of the bedrock. The
final drainage pattern and shape of the ponds and wetlands will be constructed by the
placement of overburden fill and regrading of the pit bottom.
Wetlands and ponds will be connected by grass—lined channels constructed with side
slopes of 4H:1 V to minimize erosion of the channels. The design of a typical channel is
illustrated in Exhibit F.4. Six inches to 12 inches of topsoil will be spread over the
graded channels, the surface revegetated with grass and covered with mulch to control
erosion. Hay bale barriers will be constructed every 200-300 feet along the channels to
minimize erosion and the movement of sediment until the vegetation is established.
The depth of water in the wetlands will be controlled by a series of check dams (see
Exhibit F.I). The depth of the substrate in these wetlands typically varies from 0 to 3
feet. The check dams will be constructed of overburden material and the flow paths and
spillways protected with riprap. The design of a typical check dam is illustrated in
Exhibit F.4.
The post-mining pond located on the Longmont property discharges to St. Vrain Creek
via a spillway and protected outfall channel approximate 100 feet in length (see Exhibit
F.1). A typical design of a spillway and outfall channel is illustrated in Exhibit F.4.

Channels and spillways will be sized to pass surface runoff from a 25-year storm event
plus the baseline groundwater flow. Further hydrologic analysis is needed to evaluate
groundwater flows and finalize sizing of control structures. The majority of the
reclaimed areas are in the FEMA flood plain of St. Vrain Creek and Boulder Creek.
However, the reconstructed drainage pattern is confined to the excavated pit areas. All
flow control structures are constructed below the current topography. Therefore the risk
of downstream damage due to storm events and subsequent flooding is negligible.
In case of severe flooding of St. Vrain Creek, water may spill over the south bank of the
creek and flood the reclaimed pits, causing potential severe erosion of the slope between
St. Vrain Creek and the reclaimed areas. This may potentially lead to rechanneling of St.
Vrain Creek through the reclaimed area. In order to prevent washout of the slopes and
creek bank, the points where floodwater will likely enter the pits (the low points along the
St. Vrain bank) will be protected with trenches constructed along the pit crest, parallel to
the creek. These trenches will be filled with riprap, covered and revegetated. In the event
of flooding, the trenches will act as energy dissipaters and aid in preventing erosion of the
slopes. The locations of the trenches will be determined by the topography at the
completion of mining.
6.7 Wildlife
Some indigenous wildlife species may be temporarily displaced by the proposed mining
activities. Following reclamation, it is anticipated that the native species will reestablish.
Existing riparian habitat areas will be undisturbed by the operation.
A wildlife questionnaire has been completed and submitted to the Colorado Division of
Wildlife (DOW). This questionnaire is included in Exhibit H.
6.8 Topsoiling
Topsoils in the proposed expansion area are predominantly aquolls, aquents and sandy
loam. These soils will be stripped and stockpiled during overburden removal and
retained for replacement during site reclamation. Topsoil stockpiles will be protected
from erosion and other damage by best management practices. At reclamation, topsoil
will be spread over prepared areas in a 6- to 12-inch thick layer.
6.9 Soil Amendments
Replaced topsoil will be subjected to agricultural testing for the major plant nutrients
(nitrogen, phosphorus, and potassium) prior to revegetation to assess the need for the

addition of fertilizer. If test results show a need for amendments, fertilizer with the
appropriate ratio of major nutrients will be applied prior to reseeding. NRCS soil
fertilizer recommendations, if any, will be followed.
6.10 Revegetation
The focus and goal of revegetation at the site will be the establishment of effective
vegetation cover in the area that will provide a transition area from the hydric area along
the St. Vrain River and ponds to the more mesic upland areas to the south. To this end,
replacement of vegetation will focus on placement and establishment of scattered shrub
clumps, trees, and a vigorous herbaceous community.
Seed Mixture and Seeding Rate
Herbaceous revegetation of the reclaimed area is proposed to minimize impacts to the
physical environment by reducing wind and surface water erosion, and impacts to the
biologic community by providing wildlife habitat, food and shelter in the immediate area.
Currently, the area is dominated by inland saltgrass (Distichlis spicata), western
wheatgrass (Agropyron smithii), cheatgrass (Bromus tectorum), and weedy species
(Kochia and Crisium spp.). Many of these species are generally not suitable for
revegetation of the area.
Revegetation of the reclaimed area is proposed with three seed mixtures, one for upland
mesic areas, one for cattail marshes, and one for wet meadow areas. The proposed seed
mixtures for each of these environments are listed in Tables 6.2, 6.3 and Table 6.4. All of
the species included in the seed mixes currently exist on the property, are palatable for
wildlife, or are proven revegetation species. All of the species included in the seed mixes
are native to Colorado. The seed mixes include representatives of cool and warm season
species to maximize cover and seed production throughout the summer months.
The seeding rates listed in Tables 6.2 to 6.4 will ensure the placement of a minimum of
40 seeds per square foot, consistent with Natural Resource Conservation Service
recommendations for reclamation of disturbed sites.
Seeding will be conducted employing broadcast or drill seeding methods, with seed being
covered using machine methods or raked in by hand. Planting and seeding of vegetation
will occur during the first normal planting season after completion of backfilling,
regrading, and topsoil replacement, but no later than November 15 of the year in which

the prior activities are completed. To take advantage of climatic fluctuations, two
seeding windows are proposed, March 15-July 1 and September 1 to November 15.
Tree and Shrub Planting
The proposed setback of 100 feet during mining will enable preservation of tree- and
shrub-covered areas adjacent to St. Vrain Creek. To promote development of wildlife
habitat within the property and to provide additional species diversity, planting of trees in
natural groupings around the reclamation is anticipated. As mature trees cannot be
successfully or feasibly replanted, the replacement trees will be smaller in caliper than
those currently on site. Replaced trees will be of a maximum three-inch caliper. Tree
species to be replanted will include plains cottonwood (Populus deltoides), narrowleaf
cottonwood (Populus angustifolia), and Saskatoon serviceberry (Amelanchier alnifolia).
In order to establish a more native tree overstory and community, the majority of the trees
replanted will be the cottonwoods. Trees will be planted in clumps or in association with
other woody vegetation to maximize overstory near standing water and maximize
survival through proximity to alluvial groundwater. The Distel expansion area will also
be planted with trees to replace the original vegetation in this area. Tree transplanting is
most successful when undertaken during tree dormancy; therefore it is anticipated that all
transplanting will occur after leaf fall and dormancy onset in the autumn.
To provide a varied structure and species composition to the revegetated area, seeding of
several woody shrub species is proposed in areas within the reclamation. The shrub
species selected are native to Colorado, are found in the general vicinity of the project,
and represent species adapted to a wide variety of environmental conditions. These
species are also commonly used in the revegetation of disturbed lands. The species
selected are skunkbush sumac (Rhus trilobata), Arkansas rose (Rosa arkansana),
snowberry (Symphoricarpos montanus), and buffaloberry (Shepherdia canadensis). In
general, skunkbush sumac and buffaloberry will be seeded in small more xeric areas (less
than 0.1 acre) subject to full sun. Arkansas rose and snowberry will be seeded
immediately adjacent to tree clumps. Within the areas to be seeded to the shrubs, no
other species will be seeded, to minimize competition.
Additionally, in selected areas adjacent to ponds or cattail marshes, coyote willow (Salix
exigua) stakes will be planted to encourage development of willow copses. Six to twelve
willow stake planting locations are proposed, with each planting comprising from 50 to
100 willow stakes.

6.11 Mulch
In order to minimize impacts from wind and water erosion and to protect newly
revegetated areas, a native hay or straw mulch is proposed. Mulch will be applied at a
rate of 2000 lb/acre. Only mulch certified as weed and pest free will be employed.
Mulch will not be used in the cattail marsh or wet meadow revegetation areas.
6.12 Maintenance
Revegetated areas will be inspected 1 year after seeding and after major storm events,
until vegetation is established and bonds are released. Erosional features will be repaired
and the areas reseeded, as needed.
6.13 Buildings and Structures
No buildings will be constructed during the expansion operations. Processing and
administrative functions will be carried out in existing structures located in previously
permitted areas. Only mobile equipment will be used in the mine area. A portable
overland conveyor system required for transport of sand and gravel to the process area is
in place for the previously permitted areas. Additional portable conveyors may be
constructed inside the mine areas to facilitate transport of the resource.
Oil and gas pipelines in the Longmont and Bigelow properties will be relocated and
buried at the base of the reclaimed pits. Access to the oil well located on the Longmont
property will be reestablished across the reclaimed area. Assess to the Peschel house will
be maintained during mining. Electric and communication lines and water and gas lines
will be maintained along the access road. The lateral to the Coffin-Davis Ditch running
through the Bigelow property will be relocated to feed the post-mining pond constructed
on the Bigelow property. A flow control structure will be constructed at the conjunction
of the Coffin-Davis Ditch and the lateral to control the inflow to the Bigelow wetlands
and the Bigelow pond.

8.0 EXHIBIT G- WATER INFORMATION
8.1 Introduction
The proposed expansion areas are located in the alluvial plain of St. Vrain Creek. The
alluvial deposit averages approximately 15 feet in thickness, overlain by approximately 3
to 5 feet of overburden material. The alluvial groundwater level is from 2 to 5 feet below
the current ground level and extends to the bedrock, approximately 20 feet below the
surface.
Mining of the sand and gravel will necessitate dewatering of the alluvial material in the
area of the pits. The potential exists for impacting the shallow groundwater level in the
immediate vicinity of the excavation. However, the operation is not expected to
materially impact groundwater rights. It is anticipated that water wells in the area will be
able to withdraw their permitted amounts. Suitable mitigation procedures will be
instituted if water rights are materially impacted.
8.2 Surface Water System
The proposed Longmont and Peschel expansion areas are located adjacent to, and to the
south of; St. Vrain Creek, mainly in the 100-year floodplain of the creek. Boulder Creek
lies a minimum of 250 feet to the east of the Longmont property. This creek discharges
into St. Vrain Creek approximately 3,000 feet downgradient of the northeast corner of the
Longmont property. Dry Creek, an ephemeral watercourse, flows through the Peschel
property and discharges into St. Vrain Creek. Local surface water features are shown on
Exhibit C.3.
A 100-foot buffer will be maintained adjacent to St. Vrain Creek and Boulder Creek and
a 25-foot buffer maintained adjacent to Dry Creek to prevent disturbance to these
watercourses and the adjacent riparian areas. No impacts to St. Vrain Creek or Boulder
Creek are expected as a result of mining due to the large size of the catchment areas.
The area historically consists of irrigated farmland. The Coffin-Davis Ditch, an irrigation
tailwater ditch, crosses the Bigelow property from south to north and discharges to St.
Vrain Creek. A lateral branches off of the main ditch to the south of the mine area and
intersects the Bigelow property approximately 1000 feet east of the main ditch. A second
irrigation ditch, the Bonus Lateral Ditch, is located along the western boundary of the
Peschel property, along Weld County Road 1.

The area is interdispersed with existing and historic sand and gravel mining operations.
Local ponds include the wash ponds and pit lakes in the currently permitted area operated
by the applicant. Historic pit lakes also exist on the Peschel and Longmont properties
and to the southeast of the Longmont property, east of Boulder Creek. These surface
waters are not expected to be influenced by dewatering activities in the proposed mining
area. Existing dewatering operations have not impacted pond levels located close to the
operations.
Surface drainage from the property will be rerouted to existing sedimentation ponds and
discharged in accordance with Colorado/NPDES discharge permit requirements.
The reclamation plan for the combined Longmont, Distel and Bigelow properties
includes the construction of two unlined ponds and three wetland areas, connected along
a single flow path. The total area of open water in the ponds is approximately 30 acres
and the total area of the wetlands is approximately 20 acres (wetland sizes are 12, 5 and 3
acres). Inflow to the wetlands and ponds will be from indirect groundwater flow. Water
from the Coffin-Davis irrigation ditch will also flow into the first wetland at a point along
the western edge of the Bigelow property. Water from the irrigation ditch will be fed to
the system when needed during dry periods. A flow control box will be constructed to
control the inflow from the ditch to the wetlands system and to allow by-pass of water to
St. Vrain Creek (see Exhibit F.1). When needed, the Bigelow pond will also be fed
directly from the Coffin-Davis lateral ditch. Water will discharge to St. Vrain Creek to
the northeast of the Longmont property. The proposed placement of the ponds and
wetlands is shown in Exhibit F.1. Final placement of the ponds and wetlands is
dependent on the post-mining topography of the pit bottom.
The main option for the reclamation of the Peschel property includes the construction of
three wetland areas, located in the northern half of the property, and two ponds, located in
the central and southern portion of the property. The ponds are 35 and 10 acres in size,
with a combined area of 45 acres. Proposed wetlands are 3, 2 and 9 acres in size, with a
combined total of 14 acres of wetlands. Inflow to the wetlands and ponds will be from
indirect groundwater flow. Water from the Bonus Lateral Ditch, along the western edge
of the Peschel property, will also be used to feed the system when needed during dry
periods. Flow into the system and by-pass to St. Vrain Creek will be controlled at a flow
control box at the inlet. Water will discharge to St. Vrain Creek at the northeast of the
Peschel property. The proposed placement of the pond and wetlands is shown in Exhibit
F.1. Final placement of the ponds and wetlands is dependent on the post-mining
topography of the pit bottom.

The alternative reclamation plan for the Peschel property includes the construction of a
45-acre pond, located on the northern half of the property. A portion of this area may
alternatively be developed as wetlands. Flow into and out of the pond and wetlands will
be alluvial groundwater. The proposed layout of this alternative reclamation plan is
illustrated on Exhibit F.2. Final placement of the ponds and wetlands is dependent on the
post-mining topography of the pit bottom.
Upon completion of reclamation, all ponds and wetlands will be flooded utilizing senior
and junior water rights. Thereafter, the post-mining water level will typically be
maintained by groundwater inflow to the reclaimed area. During dry periods, water to the
system will be supplied from the irrigation ditches. A water augmentation plan will be
developed for submission to the State Engineer's Office, Colorado Division of Water
Resources, to address post-mining consumptive use of water.
Approximately 1.14 acres of jurisdictional wetlands will be excavated in the Longmont
property during mining. If required, an appropriate COE permit will be obtained prior to
excavation of these areas and the wetlands will be mitigated in accordance with the
permit conditions.
Construction of the final outfall from the Longmont pond to St. Vrain Creek will require
the placement of a limited amount of fill into St. Vrain Creek. If required, an appropriate
COE permit will be obtained prior to disturbance of this area.
8.3 Ground Water System
The mine operations will be dewatered by excavating a series of dewatering ditches
around the perimeter of the active mining area. In accordance with Colorado/NPDES
discharge permit requirements, groundwater recovered in the pit dewatering activities
will be passed through on-site ponds for sedimentation prior to discharge or use in the
• processing operation. The alluvial groundwater table will be drawn down approximately
15 feet, to the bottom of the sand and gravel deposit.
The mine area is underlain by shales and sandstones of the Laramie Formation, forming
an aquitard overlaying the deeper bedrock aquifer, the Laramie-Fox Hill aquifer. This
aquifer will be unaffected by the mining operation because of the shallow depth of
excavation.
The potential exists for impacting the shallow groundwater level in the immediate
vicinity of the excavation and extending to the south and west of the development area.

St. Vrain Creek serves as a groundwater divide to the north of the development area and
Boulder Creek serves as a groundwater divide to the east. Therefore, no alluvial
groundwater drawdown is expected in these directions.
Based on past and current mining operations in the area, the impact to the local
groundwater level is expected to be limited to distance of one-quarter mile from the
mining operations. Only limited groundwater table drawdown has been observed in area
water wells due to past operations.
Approximately 31 water wells exist with one-half mile radius of the proposed expansion
operations. Of these, 21 wells are located north of St. Vrain Creek or east of Boulder
Creek. These wells are not expected to be impacted because of the groundwater divides
provided by these watercourses. Of the remaining wells, five are well permits for current
gravel mining operations. Five wells are located greater that 2,500 feet from the
proposed expansion on the Longmont property. These wells are closer to past and current
mining operations than to the proposed expansion. The remaining two wells are located
in the center of the Peschel property. These wells will potentially be affected by mining
operations.
8.4 Surface Water Management Plan
A surface water management plan is in effect for the currently permitted operations. The
plan will be updated to incorporate the expansion area.
8.5 Discharge Permits
The applicant maintains Colorado/NPDES stormwater and discharge permits for current
operations. The proposed mine will be dewatered and operated as a dry mine. Alluvial
groundwater from pit dewatering will be discharged into St. Vrain Creek. The existing
Colorado/NPDES discharge permits will be updated for the expansion area and all
discharge will be conducted in accordance with permit conditions.
Process wash water will be recycled and will not be discharged.
8.6 Water Requirements During Operations
The current mine production rate is 660,000 tons/year. For an anticipated increase in the
production rate to 800,000 tons/year, the total annual consumptive use during operations
will be approximately 32.7 acre-feet per year. This includes moisture loss in material
shipped from the site, on-site dust control, and process water consumption. These water

uses are discussed in the following subsections. The water supply plan for the period of
operation will be updated to reflect the increase in production.
8.6.1 Moisture Loss in Materials
The proposed expansion operation is anticipated to process approximately 800,000 tons
of sand and gravel per year. Based on data for similar materials, the average moisture
content of these materials at the time of shipment is expected to be four percent. The
moisture loss in the materials is calculated to be approximately 23.6 acre-feet per year.
8.6.2 Dust Control
Only minor new road development will be required to access proposed mining and
overburden stockpile areas. Therefore, water usage for dust control is expected to remain
the same as for current operations. Dust suppression will be performed by water truck
application to roadways. The amount of water used for dust control will vary based on
the time of year and weather conditions. Assuming 100,000 gallons per month for dust
suppression, annual consumptive use associated with the expansion will be approximately
3.7 acre-feet per year.
8.6.3 Processing Water Consumption
Water consumed in washing is accounted for in product water or evaporation from
process ponds. Wash water and sediment collection pond facilities in the existing process
area cover approximately 2.4 acres. This is expected to remain the same with the
expanded operations. Site precipitation averages 13 inches per year while local free
water surface evaporation is approximately 40 inches per year. Therefore, net
evaporation is approximately 2.25 feet per year per acre. Consumptive use in the wash
water pond used to process the materials from the expansion area will be approximately
5.4 acre-feet per year.
8.6.4 Water Supply Plan during Operations
The water supply plan is based on existing water credits from the Coffin-Davis ditch,
combined with a water lease from the City of Longmont. The water supply plan for the
period of operation will be updated to reflect an increase in production to 800,000
tons/year for the expansion areas.

8.6.5 Post-Mining Consumptive Use
The proposed reclamation plan will create a total of approximately 73.0 acres of open
water in the post-reclamation ponds and a total area of approximately 28.4 acres in the
wetlands. Assuming an evaporation rate of 2.25 feet per year per acre, annual post-
mining consumptive water use is expected to be approximately 228 acre-feet per year.
8.7 Post-Mining Water Augmentation Plan
A water augmentation plan will be developed to address post-mining consumptive water
use. This plan will be submitted to the State Engineer's Office, Colorado Division of
Water Resources, prior to completion of reclamation of the area.
8.8 Jurisdictional Wetlands and Waters of the United States
Delineations of jurisdictional wetland were completed for the expansion areas. Proposed
mining of the Longmont property includes the excavation of approximately 1.14 acres of
jurisdictional wetlands. If required, an appropriate COE permit will be obtained prior to
the excavation of the wetlands. Current mining activities may include the excavation of
approximately 2.81 acres of jurisdictional wetlands in the Bigelow area. No fill will be
placed in these areas. If required, an appropriate COE permit will be obtained for the
reclamation of this area. Approximately 0.46 acres of jurisdictional wetlands were
delineated in the Peschel Area. These areas will not be disturbed during mining.
Two existing flooded sand and gravel pits were identified as Waters of the United States
on the Longmont property. These areas will be excavated during mining of the Longmont
property. No fill will be placed in these areas during mining or reclamation. If required,
an appropriate COE permit will be obtained prior to disturbance of these areas.
A 100-foot setback from St. Vrain Creek and a 25-foot setback from Dry Creek are
proposed to serve as buffer zones for the riparian habitat and wetland areas adjacent to the
creeks. These areas will not be disturbed during mining or reclamation activities.

9.0 EXHIBIT H - WILDLIFE INFORMATION
A Mined Land Wildlife Questionnaire has been submitted to the Department of Wildlife
(DOW) and is included in this section. Based on previous wildlife assessments prepared
by the DOW for the currently permitted areas, species that are commonly found in the
area include dear, pheasant, rabbits, muskrat, beaver, opossum, waterfowl, raptors,
rodents, magpies and songbirds. While bald eagles have recently been observed in the
area, no local bald eagle nesting sites have been identified on or adjacent to the proposed
mining area.
Trapping surveys were conducted on the Peschel property in June 1998 and on the
Longmont property in September 1999 for the presence of endangered mammalian
subspecies Preble's meadow jumping mouse. Setbacks of 100 feet from St. Vrain Creek
should minimize potential disturbances to any existing mouse habitat areas.
Local wildlife species may be displaced from the area during operations; however, they
are expected to reestablish themselves when mining and reclamation have been
completed. The proposed mining and reclamation will not hinder local movement of
wildlife. The proposed post-mining ponds and wetlands are anticipated to provide
valuable habitat to waterfowl and migratory bird species.

Reclamation of the combined Longmont, Distel and Bigelow properties will
include the construction of two ponds, each approximately 15 acres in size, and
three wetland areas, with a total area of approximately 20 acres. Reclamation of
the Peschel property will include the construction of two ponds, approximately 35
and 10 acres in size, and three wetland areas, with a total area of approximately 14
acres. Pit slopes, stockpile areas and the pit floor will be reclaimed as upland
meadow and revegetated with a mixture of grasses. These reclamation measures
are anticipated to create an area that will be consistent with Weld County land use
goals.
The potential long-term use of the south end of the Peschel property is residential.
9. Substance to be mined: The operation will excavate and process alluvial sand
and gravel deposits.

11. Depth of excavation and distance to nearest surface water flow: The
maximum depth of excavation will be approximately 20 feet. The nearest flowing

is located a minimum distance of 250 feet to the east of the property boundary.

12. Total number of acres to be permitted: The areas to be permitted include
approximately 97.6 acres in the Longmont property and approximately 141.8
acres of the Peschel property. The total area to be permitted is approximately
239.4 acres.
13. Total number of acres disturbed: The total number of acres to be disturbed,
including mine pits, access roads, permanent and temporary stockpile areas will
be approximately 214.8 acres.
14. Miles of road to be constructed: The Longmont area proposed for mining is
bounded on the west by active permitted mining areas operated by the applicant.
The Peschel area proposed for mining is bounded on the east by active permitted
mining areas operated by the applicant. Roads required to gain access to the new

access to the currently permitted areas. The total disturbance area of
approximately 214.8 acres includes approximately two acres of new road for the
Longmont property and two acres for the Peschel property.

10.0 EXHIBIT I - SOILS INFORMATION
Excerpts from the Soil Survey of Weld County, Southern Part (SCS, 1980) are provided
in Exhibit C.2. Most of the soils in the proposed expansion area are aquolls and aquents
that commonly occur on bottomlands, floodplains and natural drainageways. These are
generally deep, poorly drained soils that formed in recent alluvium.
Aquolls and aquents soils are primarily suited for pasture, rangeland and wildlife habitat.
They are well suited to reestablishment of pasture grasses as proposed in the reclamation
plan. If recommended by SCS, soil samples will be subjected to agricultural testing to
evaluate fertilizer requirements.

11.0 EXHIBIT J - VEGETATION INFORMATION
Vegetation in the proposed expansion areas consists primarily of pasture grasses with
lowland riparian habitat areas occurring adjacent to St. Vrain Creek. These areas have
plant cover typical of riparian habitats, including cottonwood trees, cattails, bullrushes
and associated plants. A 100-foot setback will be maintained along St. Vrain Creek to
protect the riparian areas from disturbance.
Wetland delineations that were conducted by Savage and Savage, Inc. for the proposed
development areas. A wetland delineation of the Peschel property was conducted in
February 1998 and the Longmont property was surveyed in October 1998.
Five small wetland areas were located on the Longmont property. These include four
small cattail marches with a combined size of 0.88 acres and one 0.26-acre wet meadow.
The locations of these wetland areas are shown on Exhibit C.1. If required, all wetland
areas excavated during mining will be mitigated in accordance with the COE permit
requirements. Two small wetland areas, 0.4 and 0.06 acres, were identified on the
Peschel property. These areas are outside of the mine limits and will not be disturbed.
Species surveys were conducted for the threatened plant species, Ute ladies'- tresses
orchid, on the Bigelow and Peschel properties in June 1998 and the Longmont property in
September 1999. These surveys indicated that no orchids exist within the mining areas.
A setback of 100 feet from St. Vrain Creek should minimize disturbances to any potential
orchid habitat areas.

13.0 EXHIBIT L - RECLAMATION COSTS
The estimated cost for the reclamation of the Longmont/Distel/Bigelow area is
$1,276,200 and the estimated cost for the reclamation of the Peschel property, using the
primary reclamation option, is $356,200. The total estimated reclamation cost is
$1,632,400. A breakdown of this cost is given in Table 13.1. Costs are estimated by
mining task and are based on full development of the property. Access and haul roads
that will be required to develop the property have for the most part been previously
constructed and bonded in the original 112 Permit M89-029. Reclamation costs for the
access roads are discussed in previous permit applications for the Longmont Distel
Operations.

20.0 EXHIBIT S - PERMANENT MAN-MADE STRUCTURES
Longmont Property
No residences are located on the Longmont property or within 200 feet of the property
boundary. The nearest residences are located approximately 1500 ft south of the
proposed mining area. Residences within one half mile of the proposed expansion
properties are shown on Exhibit C.1.
An abandoned and plugged crude oil well, and associated tank and meter house, are
located in the northeast section of the Longmont property. The sales line from the well
runs southwest from this well to the property boundary, then west along the property
boundary where it crosses the St. Vrain Creek and terminates at the tank battery located
north of the creek. This site is currently used as a drilling practice site. The site is
accessed by a dirt road that runs north from CAMAS Colorado' plant site on Weld
County Road 20'/2. The locations of these structures and ownership information are
shown on Exhibit C.1.
A buried electric utility line runs to a utility pole located south of the oil well and meter
house. A temporary overhead electric utility line runs from this pole and travels west,
along the northern Longmont property boundary, to the current mining operations in the
Bigelow property. An agreement will be finalized between the owner and the operator
for the relocation of this line prior to disturbance. No other electrical, communication
lines or easements exist on this property.
Peschel Property
Two residences exist on the Peschel property, both owned by the surface landowner of
record of the Peschel property. A house is located on the western boundary of the
Peschel property, adjacent to Weld County Road 1. The owner will demolish this house.
A second house is located along the east edge of the Peschel property, adjacent to Dry
Creek. Electric and communication lines, a gas line and a water line to this residence run
along the access road from Weld County Road 1. An agreement will be finalized
between the owners of the utilities and the operator for the relocation of all utilities. An
agreement will be finalized between the operator and the surface landowner that limits the
distance of mining from the residence. No other structures or utilities exist within the
property boundaries.

A residence is located south of the Peschel property boundary, on Weld County Road 1,
within 200 feet of the proposed mine limit. Mining will be limited to within 200 feet of
the residence unless a different agreement of the buffer zone is reached between the
operator and the surface landowner. No stability problems or impact to the property or
residence are expected as a result of mining activities. Water is supplied to this house
from a water main running adjacent to County Line Road 1.
Weld County Road 1 is located along the western boundary of the Peschel property. This
road will not be disturbed during mining or reclamation activities. An agreement will be
finalized between the appropriate agencies and the operator that limits the distance of
mining from the road. No other structures are located within 200 feet of the Peschel
property boundary. Residences within one half mile of the proposed expansion properties
are shown on Exhibit C.1.
Distel Property Expansion
Information related to the Distel property was submitted with the original Distel property
permit application. There are no structures located within 200 feet of the property
boundary.

THIS SUPPLEMENTAL ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT is
entered Into on June 2L . 1999 by and between the COUNTY OF WELD, STATE OF
COLORADO ("County") and CAMAS COLORADO, INC., an Indiana corporation ("CAMAS"):
Recital
1. On June 3, 1992, the County, C & M Ready Mix Concrete Company Of Boulder, Inc.
("C &M") and Western Mobile, Inc. have previously entered into a Road Maintenance And
improvements Agreement and a Long Term Road Maintenance and Improvements Agreement
("Original Agreements").
2. As the result of various business asset acquisitions and corporate mergers, CAMAS has
acquired the business and assets of C & M, including land use and mining permits known as
USR 877 (Distal Farm) and USR 1046 (Tull Farm) and is the successor in interest to C & M
under the Original Agreements.
3. The parties intend by this Supplemental Agreement to provide for additional road
maintenance and improvements in areas not provided for in the Original Agreements.
4. The parties do not intend by this Supplemental Agreement to alter, amend or otherwise
affect the rights and obligations of the parties under the Original Agreements.
Provisions
5. The parties acknowledge that CAMAS, at its expense, has satisfactorily repaired County
Road 20-1/2 from the Distel Plant haul road west to County Road (the "Distal/201/2 Section") by
excavating potholes and distorted areas of pavement, along with unsuitable subgrade materials,
and repaired such sections with four (4) inches of hot bituminous pavement and aggregate base
as required to replace unsuitable subgrade to the standards approved by the Weld County
Department Of Public Works, with ail construction and materials in accordance with the
Colorado Department Of Transportation (formerly State Department Of Highways) Standard
Specifications For Road And Bridge Construction 1991 (as supplemented or revised by COOT).
During construction, signage shall be posted In accordance with the Uniform Manual of Traffic
Control Devices.
9. The Intersection of the Distel Plant haul road and County Road 20.1/2 shall be modified,
as depicted on Exhibit"A" hereto, as follows:
a. The presently existing forty-five (45) degree off-ramp lane shall be removed and
the presently existing configuration of the intersection shall be replaced
with a ninety (90) degree, two-way intersection having forty (40) foot
turning radii, per Ordinance 180, Appendix"8" (Commercial Access.)
b. An acceleration lane shall be installed.

7. The work referred to in Section 6, above, shall be completed by the end of the 1999
construction season.
8. CAMAS shall pay one hundred percent (100%) of the expenses related to the road
repairs referred to in Section 6, above.
9. Upon the completion of the road improvements provided for in this Supplemental
Agreement, CAMAS shall be deemed to have complied with the road maintenance and
improvement obligations set forth in the permits referred to in Section 2, above.
10. CAMAS is required to share in reasonable future maintenance and improvements along
the Distel/20-1/2 Section when such maintenance is related to its hauling impacts.
11. The County shall, to the best of Its ability within the restrictions of the law, require future
aggregate, asphalt and ready-mix concrete operators ("Operators")that use the Distei/201/2
Section to participate in the costs of repairing and maintaining the same.
12. Upon notification by the County, CAMAS and such other Operators as may use the
Diste1/20-1/2 Section shall examine the Distei/20.1/2 Section and determine a plan for the
maintenance and improvements that are required.
13. Upon determining what maintenance and improvements are required, a separate
agreement shall be drawn detailing the work to be done and how the costs are to be
— shared.
14. It is anticipated that CAMAS and other Operators using the Distel/20-1/2 Section will
perform the work and share in the equipment, labor and materials required. Any sharing done
between the Operators shall be in separate agreements.
15. If Weld County does not require Operators other than CAMAS who are using the
Distel/20-1/2 Section to share a reasonable portion of maintenance and improvements, the
County shall be responsible for that portion.
16. If CAMAS does not participate as outlined in this Agreement, (i) CAMAS shall be
deemed to have violated its permit, (ii) the County may hold a probable cause hearing pursuant
to the Administrative Manual to consider revocation of the CAMAS special review permit, and
(ill)the County, at its option, may take remedial measures within a reasonable amount of time.
IN WITNESS WHEREOF the parties have duly executed this Supplemental Agreement on the
date set forth above.

TRAFFIC HAUL ROUTES
'TRAFFIC PATTERNS FOR THE DISTEL FARM OPERATION, CAMAS AMERICA
The existing R. I. A. is adequate in terms of improvements and maintenance. The proposed
amendment will not impact the adjacent roads in number and types of vehicles anticipated beyond
that anticipated for the two separate gravel operations permits, USR-877 and USR-1046, now
held by the applicant. However, the applicant is hereby requesting a change in the agreement to
•
allow traffic to move both east and west from the access point at WCR 20 1/2. At that point,
50%of the traffic would proceed each direction from the access. At WCR 7, one-half of the
traffic will proceed each way, north and south. At WCR 1, one-half of the traffic will proceed
each way, north and south.
Some material is imported to the site for processing and mixing to make specification products.
This material is generally backhauled to the site with the same trucks that haul from the site. This
is not a major part of the production operation and does not affect traffic patterns.

ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT

Western Mobile Inc., hereinafter called "WMI" and C & M Ready Mix Concrete Company
of Boulder, Inc., hereinafter called "C & M,"
WHEREAS, WMI and C & M have acquired land use permits from Weld County
for gravel pits in the area of Rinn, Colorado, and
WHEREAS, WMI and C & M have entered into Road Maintenance and
Improvements Agreements with Weld County to WMI repair
and
m�ning and plant operation and,verlay County roads impacted
by heavy truck traffic generated from and C & M's
WHEREAS, the County has inventoried the County roads in the Rinn area and
found repairs are necessary.
NOW, THEREFORE, in consideration of the mutual covenants and conditions
hereinafter set forth, the County, WMI, and C & M mutually agree as follows:
1. The County roads to be repaired are to C & M County gr Roadel 20.5it, between Weld
Weld County
County Road 7 and the entrance
Road 7 from Weld County Road 20.5 south to state Highway 52.
2. Repair will consist of excavating potholes and distorted areas of pavement,
along with unsuitable subgrade materials, and repairing with four inches of
hot bituminous pavement and aggregate base as required to replace
unsuitable subgrade.
3. All construction and materials shall be in accordance with the State
Department of Highways, Division of Highways, State of Colorado, Standard
Specifications for Road and Bridge Construction, 1991. The addition of lime
to the hot bituminous pavement will not be required.
4. WMI will furnish the necessary hot bituminous pavement, equipment, and
labor to repair damaged areas.
5. The County will reimburse WMI for the cost of the AC-10 liquid asphalt
required to manufacture the hot bituminous pavement.
6. C & M will share the expense for repairs with WMI as determined by a
separate agreement.
7. Because of the instability of the existing roadbed, overlaying will not be done
at this time. WMI and C& M will be responsible for patching until such time
as the roadbed is stabilized and other improvements such as paving fabrics
and overlays can be considered.

LONG TERM ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT
THIS AGREEMENT, made and entered into this 3 day of iU Al . , 19,
by and between the County of Weld, State of Colorado, hereinafter called "County" and

Western Mobile Inc., hereinafter called "WMI" and C & M Ready Mix Concrete Company
of Boulder, Inc., hereinafter called "C & M,"
WHEREAS, WMI, C & M, and other gravel operators have acquired land use
permits from the County for gravel mining and plant operations in the area of Rinn,
Colorado, and
WHEREAS, it is anticipated there will be additional land use permits granted by the
County in the future, and
WHEREAS, gravel mining and plant operations are anticipated to continue in the
area of Rinn, Colorado, well into the future, and
WHEREAS, the County roads in the area of Rinn, Colorado, will be impacted by
heavy truck traffic generated from gravel mining and plant operations, and
WHEREAS, present and future gravel operators are required to enter into Road
Maintenance and Improvements Agreements with the County to mitigate the impact created
by heavy truck traffic, and
• WHEREAS, haul routes overlap between different gravel operators and the existing
haul routes are difficult and impractical to manage, and
WHEREAS, the maintenance and improvements required will vary over time and
provisions should be made to address future requirements, and
WHEREAS, the County, WMI, and C & M agree it would be advantageous to set
forth an agreement that would provide a basis for future Road Maintenance and
Improvements Agreements.
NOW, THEREFORE, in consideration of the mutual covenants and conditions
hereinafter set forth, the County, WMI, and C & M mutually agree as follows:
1. The County roads considered in this agreement are haul routes that were
established by land use permits previously granted by the County and are as
follows: Weld County Road 7 between Colorado State Highway 119 and
Colorado State Highway 52; Weld County Road 20.5 between Weld County
Road 7 and the entrance to C & M's gravel mine, which is a distance of
approximately 7,700 feet; Weld County Road 18 between Weld County Roads
7 and 5; and Weld County Road 5 between Weld County Road 18 to County
Road 7.
2. WMI and C&M are restricted to hauling on the road identified in Paragraph
1 above. Previous haul route restrictions shall not apply and the
establishment of the new haul routes does not constitute a substantial change
from the restrictions contained in land use permits previously granted by the
County, provided WMI and C & M are not in breach of this Agreement.
3. The County will, to the best of its ability within the restrictions of the law,
require future gravel operators that use the haul routes described in
Paragraph 1 above, to participate in Road Maintenance and Improvements
Agreements as outlined herein.
4. WMI, C & M, or future gravel operators are required to share in reasonable
future maintenance and improvements when such maintenance is related to
their hauling impacts.
5. Upon notification by the County, all gravel operators and the County will
examine the roads and determine a plan for the maintenance and
improvements that are required.
6. Upon determining what maintenance and improvements are required, a
separate agreement shall be drawn detailing the work to be done and how the
costs are to be shared.
7. It is anticipated WMI, C & M, or future gravel operators will perform the
work and share in the equipment, labor, and materials required. Any sharing
• done between the gravel operators shall be in separate agreements.
8. If Weld County does not require a future gravel operator to share a
reasonable portion of maintenance and improvements, the County will be
responsible for that portion.
9. If a gravel operator does not participate as outlined in this Agreement, it will
constitute a violation of the operator's land use permits granted by the
County. the County will take remedial measures,within a reasonable amount
of time, against an operator that does not participate.
