RESOLUTION
RE: APPROVAL OF REPLAT OF LOTS 5, 6 AND 7, SEELEY LAKE SUBDI-
VISION, 1ST FILING.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 10th day of December, 1980, a public meeting
was held by the Board of County Commissioners of Weld County,
Colorado to consider the application of Ogilvy Irrigation and
Land Company, et al. , for a replat of Lots 5, 6 and 7 , Seeley
Lake Subdivision, 1st Filing, more particularly described as
follows:
A tract of land located in the West Half
of the Northwest Quarter of Section 25,
Township 6 North, Range 65 West of the
Sixth Principal Meridian, Weld County,
Colorado, said tract of land being Lots
5, 6 and 7 of Seeley Lake Subdivision,
First Filing together with the following
parcel of land, previously described in
Book 573, Reception No. 1495147 and Book
783, Reception No. 1704912 , Weld County
Records:
Commencing at the West Quarter Corner of
said Section 25 and considering the West
Line of the Northwest Quarter of said
Section 25 to bear North 00°00 ' 00" East
with all other bearings contained herein
being relative thereto;
Thence North 00°00 ' 00" East along said
West Line, 1120.32 feet to a point on
the North right-of-way line of Weld

Said tract of land contains 6.387 acres,
more or less.
WHEREAS, the Board of County Commissioners has studied the
recommendations of the Weld County Planning Commission, and having
been fully informed, is satisfied that the proposed replat of
Lots 5, 6 and 7, Seeley Lake Subdivision, 1st Filing, conforms
to the requirements of the Weld County Subdivision Regulations
and finds that said replat should be approved subject to the
following:
1. The Utilities Coordinating Advisory Committee
approving a revised utility easement along the
120.29 foot property line between the proposed
Lots 1 and 2 . The revised utility easement is
proposed to be 5 feet on the South side of 10
feet on the North side.
2. The following statements shall be placed on the
plat prior to recording the plat in the Clerk
and Recorder' s office:
1. Foundation excavations shall be examined
by a qualified foundation engineer to
determine proper foundation design prior
to new construction.
2 . Engineered septic systems may be necessary.
New septic systems shall be designed by
qualified personnel.
3. Ingress and egress to Lot 3 shall be from
Seeley Court. Direct access to County
Road 35 is prohibited.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the replat of Lots 5,
6 and 7, Seeley Lake Subdivision, 1st Filing, be, and hereby
is, approved subject to the conditions stated above.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 10th day of
December, A.D. , 1980.

The City of Greeley Planning Commission, at its November 25, 1980,
meeting, reviewed the proposed replat of Lots 5 , 6, and 7, Seeley
Lake Subdivision, First Filing. The Commission recommended no
objection to the replat with the condition that access to Lot 3
only be permitted from the Seeley Court cul-de-sac.

The representatives of this proposal explained that they would
like to divide the area previously platted as Lot 6 and give
portions to three adjacent lots. The owners of Lots 1 and 2
wish to have these areas legally platted onto their lots . The
remainder of old Lot 6 will be combined with old Lot 5 and
replatted as Lot 3. This lot needs to be replatted since, as
it exists, it does not meet the minimum lot size required for
septic tanks in the County . The owners explained that Lot 5
did originally meet that requirement but that when Weld County
went through and improved County Road 35, they took a large
portion of old Lot 5 for street right-of-way. This made the
lot too small to allow for septic tanks under the County ' s
regulations.
The representatives of the proposal explained that essentially
all they wished to do is eliminate one lot in the subdivision
and change some existing lot boundaries.
Ken McWilliams asked the developers how they propose to access
to this Lot 3. The developers felt .that it would access from
the Seeley Court cul-de-sac. Mr . McWilliams explained that
this would be the recommendation of the City since access onto
to the curve portion of the highway would not be acceptable.
Mr . McWilliams also asked Mr. Barsch if he had any problems
with dedicating the additional 20 ' strip of right-of-way as shown
on the drawings. Mr . Barsch indicated that he had no objections
to that proposal .
Since there were no other comments from the ART Board members ,
Mr. McWilliams explained that this item would go to the City
Planning Commission for recommendation to the County on the
25th of November.

Re : Rerlat Seeley Lake Subdivision
We are having to rer_lat Seeley Lake Subdivision for the
following reasons:
1. Since the First Filing of Seeley Lake Subdivision
the county road department has straightened the curve
on the South East corner of the subdivision, which
took part of the corner lot, narrowing it down to the
point that we no longer had the required 40,000 sq. ft.
lot for se tic system rurposes, ccnseque.tly we had to
merge 2 lots into one and because of it being such a
large lot, made it hard to sell. In the meantime
Mr. F. W. Barsch and Mr. Tom Cowan had desires to
increase the size of their lot, so a-reements were
made to- sell each- of them portions of the enlarged lot,
which left the corner lot a more feasible size for sale.
Mr. Cowan has since sold his lot to Mr. Fabricius who
presently owns it. Since boundary lines are being changed
on First Filing a replat is necessary.
2. The lot that Mr. Barsch owns was never included in
First Filing, because that lot was purchased before the
subdivision was started and that lot will now be replatted
into the subdivision.
3. Replatting at the request of the County Planning
Department.

We have reviewed the Replat of Lots 5, 6, and 7 of the Seeley Lake subdivision,
First Filing. We have no objection to this replat.
A review of available information indicates that this area may be susceptible
to seasonally high ground water levels due to the proximity of Seeley Lake and
soil compaction. High ground water can flood basements, damage foundations,
and cause standard on-lot septic systems to malfunction. Soil compaction may
cause serious foundation damage.
We recommend that prior to new construction taking place in this area that
foundation excavation be examined by a qualified foundation engineer to determine
proper foundation design. Additionally, we recommend that septic systems be
designed by qualified personnel . Engineered septic systems may be necessary in
this area.
If these recommendations are closely observed, we have no objection to development
of this subdivision.
