March 16, 2001 Mn , 20w i Mr. Kim Ogle, Planner II Weld County Planning n rA 1555 N. 17th Avenue Greeley, Colorado 80631 Re: Weld County Ordinance No. 211 Dear Kim, I am writing concerning the road impact fees under ordinance No . 211 as it relates to Elms at Meadow Vale 1st, 2nd, and 3rd. Filing and Meadow Vale Farm 3rd. Filing. I attended a meeting of the Southwest Weld Economic Development Group on February 23. The subject of the meeting was to hear a report by Weld County of ordinance No. 211 and WCR 9.5 alignment. Representing Weld County at this meeting was Mike Geile, Don Warden, Frank Hempen and Monica Mika. Don Warden presented the report on ordinance No. 211. Meadow Vale Farm and Elms at Meadow Vale Farm have spent $434,640.00 to improve WCR 5.5 to new standards. This is only the beginning, we have additional work to do which is estimated to cost$430,000.00. These figures do not include engineering and surveying. Weld County Ordinance No. 211 charges a fee of $2,031 per residential unit when building permits are obtained. In response to my question Don Warden said that if a developer improved existing Weld County Roads the development should have a credit toward the impact fees. I am asking for that credit. It is unfair to charge an impact fee and also require the developer to improve existing county roads, to do so makes the development pay twice. I request that road impact fees on Meadow Vale 3rd. filing of 14 lots be waived and all impact fees on the Elms at Meadow Vale 1st, 2nd. and 3rd. filing also be waived. There will be 262 houses in Elms at full build out. Please discuss this with appropriate stall and advise me if we can expect this credit against road impact fees.
