RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1315
FOR A BUSINESS (LANDSCAPING MATERIALS YARD) IN THE A (AGRICULTURAL)
ZONE DISTRICT - HENRY RICKERS
A public hearing was conducted on April 18, 2001, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated March 30, 2001, and duly published April 4, 2001,
in the Tri-Town Farmer and Miner,a public hearing was conducted to consider the request of Henry
Rickers for a Site Specific Development Plan and Use by Special Review Permit #1315 for a
Business(landscaping materials yard)in the A(Agricultural)Zone District. Lee Morrison,Assistant
County Attorney, made this a matter of record. Sheri Lockman, Department of Planning Services,
presented a brief summary of the proposal and entered the favorable recommendation of the
Planning Commission into the record as written. Ms. Lockman gave a brief description of the
location of the site and the surrounding uses. She stated six referral agencies responded
favorably, five did not respond, and she did not receive any correspondence from surrounding
property owners. Ms. Lockman stated the site is visible from 1-25; therefore, staff is requesting
the applicant do landscaping. She further stated the applicant has completed Conditions#2.A.4,
#2.E,#2.1, and#2.J, therefore, they should be deleted. Don Carroll, Department of Public Works,
reviewed the site access, and stated the applicant is required to verify the access permit and any
upgrades required by the Colorado Department of Transportation (CDOT). He further stated the
applicant is required to have adequate approach radiuses to accommodate two-way traffic,and the
off-site parking area will be gravel, asphalt, concrete, or equivalent to accommodate loading and
shall be graded and drained. Responding to Commissioners Jerke and Vaad, Ms. Lockman stated
the impact fees are assessed in conjunction with building permits, and she indicated the boundary
of the City of Dacono.
Henry Rickers, applicant, stated CDOT is going to begin construction to construct another lane of
the frontage road which will be separate from his access. Responding to Commissioner Jerke, Mr.
Rickers stated the site is approximately 15 acres in size, and he has farmed it for 50 years with hay
and grass. In response to Commissioner Vaad, Mr. Rickers stated this site used to be a driving
range; however, that business was not successful. He further stated the pond is a shallow well,

which he uses to irrigate the site. He explained it has been purchased by CDOT because it is
located within the right-of-way for the Highway, so he will construct a new well. In response to
Commissioner Masden, Mr. Rickers stated he is allowed one sign for advertisement. Responding
to Chair Geile, Mr. Rickers stated he has reviewed and agrees with the Conditions of Approval and
Development Standards, as well as the proposed changes. In response to Commissioner Jerke,
Ms. Lockman stated the fees are assessed based on new buildings, not the overall property size.
No public testimony was offered concerning this matter.
Commissioner Vaad moved to approve the request of Henry Rickers for a Site Specific
Development Plan and Use by Special Review Permit#1315 for a Business(landscaping materials
yard) in the A(Agricultural)Zone District, based on the recommendations of the Planning staff and
the Planning Commission,with the Conditions of Approval and Development Standards as entered
into the record. His motion also included the deletion of Conditions #2.A.4, #2.E, #2.1, and #2.J,
and to renumber or reletter as appropriate. The motion was seconded by Commissioner Masden,
and it carried unanimously.
This Certification was approved on the 23rd day of April 2001.
