The applicant has submitted documentation supporting their application for a substantial
change hearing. The Weld County Health Department has reviewed this additional
documentation.
The applicant has proposed a Service Plan Addendum —Sewage Disposal for Beebe Draw
Farms Metropolitan District 1 & 2. This addendum provides for the management, inspection
and routine maintenance of the individual sewage disposal systems. It also incorporates an
ongoing education program in the proper care and use of septic systems.
The proposed design for all new septic systems is a single pass sand filter system. The service
plan states that other, alternative designs may be considered with approval from the
Metropolitan District and Weld County Department of Public Health and Environment. The
Department will require that each septic system be designed for site specific conditions as each
lot is developed.
Although there is conflicting data regarding the number of lots the development will be reduced
to (707 in the Petition for Rehearing document, substantial changes explanation, paragraph 1;
724 in the Service Plan Addendum, economic evaluation, page 9) the Department is under the
impression that the Service Plan Addendum will cover all homes in Filing1 and Filing 2 of the
development.
The information submitted in letter dated September 21,2001 from David A. Clinger&
Associates the applicant states the minimum lot size has been increased to 2.5 acres in Filing
2.

The Weld County Public Works Department has reviewed this PUD substantial change request.
COMMENTS:
Internal Roadways: The road layout does not appear to have changed from the previous submittal. We
have assumed that if this substantial change is approved,the previous roadway plans will be resubmitted.
The previous drainage study was based on the higher density; 100 fewer homes on lots of this size will
not significantly change the drainage requirements.
External Roadways: While a reduction in the number of homes reduces the number of trips on the
external roadways, this site will still generate 4600 to 6800 vehicles per day. The external roadways do
not have the capacity to assimilate this additional traffic. The external roadway improvements required
for the original project will still be required.

1. Approved numbers and addresses shall be provided at the commencement of any new construction.
Addresses shall be visible and legible from the street or road fronting the property. Streets or
roads shall be identified.
2. Proper building permits shall be obtained prior to any construction or excavation.
3. Building permits and plan reviews are required for signage for the development.
4. Prior to any demolition work, a building permit must be obtained.
5. Sprinkler systems require permitting and inspections. Installation shall follow the standards as set
forth in the 1997 International Plumbing Code (IPC).
6. All principal dwellings require engineered foundations. Such foundations shall be based on a site-
specific geotechnical report or an "open hole" inspection made by a Colorado licensed engineer.
7. All buildings or structures associated with the equestrian center, including but not limited to, the
riding arena, stables, and equestrian manager building, shall require building permits and plan
reviews. Many, if not all, of the buildings will require engineering. Foundations shall be
engineered and meet the same criteria as mentioned above in item no. 6.
8. Marina buildings and structures, including but limited to boat docks, the clubhouse, and the dock
manager building, shall require building permits and plan reviews. Many, if not all, of the

9. All buildings or portions of buildings open to the public shall be accessible to persons with
disabilities. Additionally, accessible exterior routes shall be provided from public transportation
stops, accessible parking and accessible passenger loading zones and public sidewalks to the
accessible building entrance they serve. Where more than one building or facility is located on

site, accessible routes between elements, facilities, and buildings shall be provided. As a reference,
please note Chapter 11 and Appendix Chapter 11 of the 1997 Uniform Building Code (UBC).
10. The allowable size of structures shall be as per Sections 504, 505, and Table 5-B of the UBC.
11. All buildings or structures shall maintain distances from property lines and adjacent buildings as
outlined in Table 5-A of the UBC.
. 12. An electrical permit shall be obtained for any electrical work. This includes electrical services, site
lighting, electricity for pumps, etc.
13. Drawings and plans will need to be submitted to the appropriate fire district for their review and
approval.
14. After each set of drawings or plans is reviewed by the Weld County Building Inspection
Department and the Fire District, there may be additional comments and/or requirements.

important tank batteries,heater/treaters, well heads,pumps, etc. be fenced to mitigate tampering
or vandalism.
The scheme of street names uses numbered cul-de-sac's with identical street names. I
believe that will make locating specific addresses,particularly in emergencies during darkness,
very difficult and confusing. It is important whatever street names are employed with address
ranges be clearly displayed at all intersections.
This development has limited ingress and egress despite a significant system of internal
roads. I strongly recommended these roadways employ some type of traffic calming feature or
features to reduce speeding including,but not limited to, neck downs, medians, identification
islands, traffic circles,pavement treatments, deviations, speed humps, raised
intersections/crosswalks, etc.
I am unable to determine what plans exist to address school bus collection locations. It is
important bus shelters or some other specific design for such a use be initially incorporated into
the design to improve safety and reduce the potential for neighborhood complaints from
subsequent ad hoc practices.

Dear Monica,
The Division of Wildlife received the request from your agency for comments concerning
the changes proposed to the previously denied 2ea filing of Beebe Draw Farms(SCH-20).
I have reviewed the proposal and the maps included indicate environmental buffer zones
and setbacks that conform to the original recommendations for Beebe Draw Farms-Filing
#1 that were submitted in 1996. The attached planning aid memorandum from the U.S.
Fish and Wildlife Service and Statement of Concurrence by the Colo. Div. Of Wildlife
were submitted at that time to minimize impact on wildlife. Those recommendations
remain valid and should be compulsory for this most recent proposal.
I have also included correspondence from U.S. Fish and Wildlife representative Leroy
Carlson concerning the active Bald eagle nest at Milton Reservoir. This nest produced
three eaglets in 2000 and two eaglets in 2001. The continued success of this nest depends
on the protection of the peninsula nesting site from human activity. As this development
evolves and human activity increases,protection of this nesting site will become a
significant challenge for all agencies involved.
The Division of Wildlife appreciates the opportunity to review and comment on this
project proposal. Consideration for wildlife and critical wildlife habitat are essential in
minimizing negative impacts on the resource.

Payments for each residential unit. In 1985 an agreement was made between the District and Beebe Draw Farms
to deed 36+- acres to the District. The deed has been transferred. If in the future, any additional residences are

In consultation with the Natural Resources Conservation Service(NRCS),we have reviewed the above
referenced case and have the following comments.
SOILS/LIMITATIONS: The soils found on this parcel of land are very limited for septic tank absorption
fields and have severe limitations for sewage lagoon areas. The primary soils are not limited for dwellings
with or without basements but are severely limited for shallow excavations. Soils are generally well suited
for windbreak and landscape plantings. In some areas,soil blowing may make tree establishment difficult.
PRIME FARMLANDS: No Prime Farmlands will be taken out of production.
SOIL EROSION POTENTIAL: The potential for water erosion is slow,however,the potential erosion
hazard due to wind is high to severe.
OTHER: If the future land use will include grass establishment and grazing,we would recommend that
the new landowner contact the local NRCS office for recommendations on establishing and maintaining the
grass and grazing management. Additionally,the future landscape plan should address the reduction of
water use with the use of Xeriscape. We also recommend that Ron Broda,Weld County Vegetation
Management Specialist be contacted to assist the landowner in developing a weed management plan. Ron
can be contacted at 970-356-4000 x3770.

Dear Ms Daniels-Mika:
In response to your request I reviewed the revised plan and the development plan for
Beebe Draw Farms. My comments are listed below:
1) Size of the lots. Lot sizes have been increased to a minimum of 2 acres by combining
some lots and removing access easements for oil and gas facilities. The increased lot size
is an improvement, but building space will still be limited on a few lots, specifically 397,
52 and 53, because of setbacks from petroleum facilities and cul de sacs. These lots
should be examined closely to confirm there is adequate space for a home between the
setback lines.
2) Metropolitan District. CGS is in favor of formation of the metropolitan district to
oversee wastewater disposal. As stated in the development plan and the Service Plan
Addendum prepared by David Shupe (May 2001), poor maintenance causes many of the
problems associated with ISDS. The metropolitan district proposes a combination of
leach field inspection, mandatory pumping of tanks, annual testing of monitoring wells,
and education of homeowners to address potential problems. This effort should be
coordinated with the Weld County Health Department.
3) ISDS Design. CGS agrees that the geology of the site is consistent and does not
oppose using a uniform design for the septic systems on Beebe Draw Farms as long as
parameters for locating the field relative to site drainage are supplied on an individual
basis (from the Service Plan Addendum, p.8). This statement acknowledges that there
may be local variations in topography(such as deflation basins) or soil that may not be
conducive to leach field siting, in that conditions do not meet Weld County requirements.
Each ISDS location must be evaluated to confirm that the chosen septic system design
can be applied. The Health Department should review all permits.

4) Oil and gas operations. As stated in one of my earlier letters, plat notes should include
a statement that heavy equipment and oil well service trucks will have access to
subdivision roads.
5) Erosion control. An erosion control plan should be prepared for the entire site, in
addition to the marina area. This issue was discussed in my letter of June 9, 2000.
