Dear Mr. Hickman,
This letter is in response to your plans to install a portable scale and scale house on the D&S
Mining property that you lease (USR_695J,adjacent to Fort Lupton. Department of Planning
Services staff determined at our February 23, 2001 meeting that this is not a substantial change
to your existing special use permit. However, a flood hazard development permit will be
required if the improvements are to be installed within the 100-year flood plain.

Thank you for your telephone call this morning informing me that our request, dated
February 13 , 2001 , has been accepted as a use by right. Our request was for a temporary
asphalt plant at the above referenced location. Enclosed is the CDOT contract, which
you needed us to submit to include in your files .

(To be executed in duplicate, one copy for the Department of Transportation, of the State of
Colorado, and one for the Contractor,)
This Agreement, Made and entered into this a0day of ap, pyt.„)A D 2000, by and
between the State of Colorado, Department of Transportation, acting by and through its
authorized representatives, party of first part, and Lafarge dba Western Mobile Northern
of P.O. Box 2187, Ft. Collins, in the County of Lorimer and State of Colorado, party of the
second pait, hereinafter referred to as the Contractor
WI:TNESSETII, That the parties to these presents, each in consideration of the
undertakings, promises and agreements on the part of the other herein contained, have
undertaken, promised, and agreed, and do hereby undertake, promise and agree, as follows
The said Contractor agrees with the said first party that he will in a good and
workmanlike manner at his own cost and expense, and strictly in accordance with this
contract, furnish all materials and do all work not herein specifically excepted, necessary or
incidental to the complete construction of Colorado Project No STA C030-020, located at
two sites on State Highway 52 and one site on State Highway 85 in Weld County in the
State of Colorado. The work consists of HBP overlay, shouldering, asphalt planing,
hieatei scarifying, bridge rail, guardrail, inlaid concrete pavement, removal of asphalt
and pavement markings.

I o comply with veteran affirmative action policies, the contractor agrees that
all suitable employment openings which exist at the time of the execution of this
contract, including those not generated by this contract, shall be listed at an
appropriate office of the Colorado Job Service
Information on the location of Colorado Job Service Offices and Organizations
likely to yield minority and female applicants for employment may be obtained
from the Staff Construction Office.
This contract shall not take effect or be in force until said Contractor shall
have furnished and delivered to the party of the first part a surety bond, acceptable
to said first party, in a penal sum equal to the nearest integral $100.00 in excess of
the Project Commitment Amount duly executed by a corporate surety, qualified and
licensed to do business in Colorado and maintaining a general agent therein The
Project Commitment Amount is the total bid per "Schedule" hereto attached plus the
estimated amount of force account items shown in the Special Provisions
It is especially understood and agreed that the Invitation for Bids, the
Contractor's Proposal, the Plans, Standard Specifications for Road and Bridge
Construction, and Special Provisions, all being applicable to the project and on file
in the office of the Department of Transportation at Denver, Colorado, together
with such alterations and modifications as may be made in accordance with the
provisions of said Plans and Specifications, are each and all included in and made a
part of this contract (Also refer to FilWA 1273 of this Contract)
In consideration of the foregoing the party of the first part hereby agrees to
pay to the Contractor, according to the requirements of the specifications and
subject to the following paragraph, the amounts required for the completed-work at
the unit prices set forth in the Contractor's Proposal, and such further amounts as
may be required for extra work or tnatcrials, all according to the provisions and
subject to the conditions as set forth in the specifications above referred to
Payment pursuant to this Contract will be made, as described in the
specifications, from available funds that are currently cncumbeied for this Contract
in a maximum amount not to exceed $6,498,784.00 The liability of the State for
payment shall be limited to such funds, provided that the Contractor understands
and agiecs that the Department may, in its sole discretion, unilaterally take
appropriate administrative action to encumber and make available additional funds
to increase that maximum amount as may be required to pay for increased quantities

shall begin under this contract no later than indicated in the specificalions,(or
such later date as may be authorized in writing by the Chief Engineer, in the
"Notice to Proceed") and that all work must he completed within SO working days,

The Contractor (and any Subcontractor) shall maintain a complete file of all
books, records, accounts, and other written or computerized materials which pertain
to the accounting and performance of work, the delivery of services, and the
compliance with applicable requirements under this Contract, and shall maintain
such records for a period of three (3) years after the date of termination of the
Contract, or for such further period as may be necessary to resolve any matters
which may be pending
a APPLICABLE LAW
This Contract is funded with Federal and/or State funds and therefore, is
subject to applicable Federal and State laws and regulations The
Contractor (and any Subcontractor) shall comply with all Federal and State
laws and regulations applicable to the solicitation, execution, and
performance of this Contract including, without limitation, the following
Title VI of the Civil Rights Act of 1964, 42 U S C. §2000d-4 and 49
C l',R 21,
the Colorado Anti-Discrimination Act of 1957, §24-34-301, C R S ,
and the Colorado Antitrust Act of 1992, §6-4-101, C R. S
b ACCESS TO RECORDS
The Contractor (and any Subcontractor) shall permit the state, the FI1WA,
and their designated and representatives, during normal business hours, to
access all books, records, accounts, and other relevant material concerning
the work performed or services provided under this Contract for the
purpose of investigation, audit, and copying to ascertain compliance with,
or to detect violation of', any applicable Federal and/or State law or
regulation or with the terms of the Contract, or to evaluate performance
tinder the Contract All records or information obtained in this manner
shall be used only for the purpose described herein, except as otherwise
authorized by law,
For the benLfit of the State, the Contractor shall include the language of this
paragraph in all subcontracts, in order to require the subcontractor(s) to comply
with the record maintenance and access conditions described above
Pursuant to CRS 24-30-202 4 (as amended), the state controller may withhold
debts owcd to state agencies under the vendor offset intercept system for. (a)
unpaid child support debt or child support arrearages, (b) unpaid balance of tax,
accrued interest, or other charges specified in Article 22, Title, 39, CRS, (c) unpaid
loans due to the student loan division of the department of higher education, (d)
owed amounts required to be paid to the unemployment compensation fund, and (e)
other unpaid debts owing to the state or any agency thereof, the amount of which is
found to be owing as a result of final agency determination or reduced to Judgement
as certified by the controller

Dear Ms . Light :
We were recently awarded several CDOT paving projects for work on Highway 52 and
85 that will be done this summer_ We have got a sand and ravel pit located west of Fort
Lupton, off of State Highway 52 _ I spoke with someone in your office on Monday, and I
apologize for not getting a name . I called to determine what we need to do to set up a
portable asphalt plant temporarily at our gravel pit. I was told to send a letter including
as many specific details as possible and it would be discussed at your Thursday or Friday
meeting .
1 ) The asphalt plant will be on site from April 1st to September 1st. We expect 110 one
way truck . The direction of travel will depend on which paving project we are working
on. The three phases are listed below :
Hwy 52 from 1 -25 to Hwy 85
Hwy 85 from the north end of Brighton to the north end of Fort Lupton
Hwy 52 from Hudson east for 10 miles
2) We will be using aggregate from the above referenced site, but we will also need to
haul in material from another gravel pit in Longmont in order to meet the paving specs
that CDOT requests _ This would be about 30 one way trips per day, starting March 1st
and ending sometime in June_
3 ) Tracks will mn Monday through Friday, during daylight hours .
