NOTICE OF APPLICATION FILED TO THE PARTIES IN THIS MATTER AND ALL INTERESTED PERSONS, FIRMS OR CORPORATIONS : You are notified that this application has been filed with the Colorado Public Utilities Commission, and any person desiring to intervene in or participate as a party in this proceeding shall file his petition for leave to intervene, or under the Commission' s Rules of Practice and Procedure, file other appropriate pleadings to become a party, within 30 days after the date of this notice . At the time of this notice, the Commission has not deemed this application to be complete within the meaning of § 40-6- 109 . 5 , C.R. S . The Commission may consider and decide this application upon the record without a formal public hearing if the application is deemed complete and no notice of intervention or petition to intervene contesting or opposing the application has been timely filed. If a hearing is required in this matter, the Commission will notify the parties of the hearing date, time and location. Applicants must appear at the hearing, if one is set, and present evidence in support of their application. Other parties may appear and present evidence in support of their position. Unless previously filed, the applicant shall file its list of witnesses and copies of its exhibits at least 20 days before the first day of hearing . APPLICATION The Town of Milliken, Colorado, (Town)hereby applies to the Public Utilities Commission of the State of Colorado (PUC) for authority to upgrade the crossings of the Union Pacific Railroad Company(Company)in the Town of Milliken,Colorado at the crossings of Weld County Roads 23 and 46, and in support of said application respectfully states as follows: 1. That the Town is a political subdivision of the State of Colorado, with address at P. O. Box 290, Milliken, Colorado, 80543. The Town's representative will be Andrew Schmidt, Director of Public Works. Please direct all inquiries regarding this application to him at the Town's address. 2. There presently exists the crossings of Weld County Roads 23 and 46 and the tracks of the Company. Each track crosses the Town's right-of-way at approximately at a 45 degree angle. The crossings are totally within the Town limits. Two maps showing that immediate surrounding areas are attached to this application as "Exhibits A-1 and A-2" and are incorporated herein by this reference. 3. Presently, Weld County Roads 23 and 46 are two lane gravel roads. The crossings are protected by railroad signage on all approaches. An aerial map showing the existing conditions is attached to this application as "Exhibit A-3" and is incorporated herein by this reference. 4. The Town proposes to widen the track crossings on Weld County Roads 23 and 46 in order to construct those streets as arterial streets to conform to the Town's Master Transportation Study. In order to do so,the existing crossing will need to be widened and railroad gates and signals will need to be installed at each crossing. 5. The Town will contract with the Company to have it install and maintain railroad gates with flashing signals and a warning bell at both crossings. 6. Exhibits A-1 and A-2 identify the location of the tracks,buildings, structures, ground lines, and streets in the vicinity of the crossings. They also indicate adjacent property owners to the proposed construction. The Town will coordinate with the affected utility companies to avoid or resolve any conflicts or concerns they may have. 7. The installation of said railroad crossing gates, flashing lights, and bells will be in accordance with the Railway/Highway Grade Crossing Protection Specifications of the Association of American Railroads, the specifications of the Public Utilities Commission, and the standard of the Manual on Uniform Traffic Control Devices. See Exhibits A-4 through A-7 for the proposed improvements and lane stripping for these crossings. 8. Presently, an average weekday daily total of 100 motor vehicles cross the Company tracks on Weld County Road 46 with an average speed of 30 mph. Presently, an average weekday daily total of 500 motor vehicles cross the Company tracks on Weld County Road 23 with an average speed of 25 mph. Presently, a total of 2 freight trains per day,with a time table speed of 40 miles per hour uses these crossings. It is estimated that the project average weekday daily total of motor vehicles to cross the Company tracks on Weld County Road 46 will be increased to 16,000 vehicles. It is estimated that the projected average weekday daily total of motor vehicles to cross the Company tracks on Weld County Road 23 will be increased to 12,500 vehicles. 9. A request for a cost estimate for the crossings for the installation of the standard flashing signals, railroad gates, and a warning bell has been sent to the Company. 10. PUC Highway Crossing Protection Funds are being requested to fund the railroad signal portions of the crossings. Accordingly,the Town proposes that the cost of the crossings be allocated to the Town in the amount of 10 percent; to the-Company in the amount of 20 percent; and to the PUC Highway Crossing Protection Fund in the amount of 70 percent. 11. The construction of these improvements to the crossings are expected to be started and completed during the fall of 2001. WHEREFORE, The Town requests that the Public Utilities Commission of the State of Colorado enter an Order authorizing the upgrading of the above-described crossings, authorizing the installation,operation,and maintenance of flashing light signals,railroad gates, and bells at the said crossings; AND, WHEREFORE, the Town requests that the Public Utilities Commission of the State of Colorado enters an Order allocating the costs of the improvements in accordance with CRS40-4-106.
