MOTION FOR ONE DAY EXTENSION TO FILE STATUS REPORT
Comes now Defendant, United States, by and through United States Attorney
Thomas L. Strickland and Assistant U.S. Attorney Paul J. Johns, and respectfully
requests that the Court extend the deadline for filing a status report one business day to
January 2, 2001. Good cause exists for the motion. On or about December 5, 2000,
this office received the Court's Order for all parties to file a status report by December
29, 2000. The Office of the U.S. Attorney moved it's offices effective December 18,
2000. Shortly after that date, the undersigned was on an extended absence from the
office until January 2, 2001. The filing of the status report was delayed when the
document was inadvertently misplaced and not executed until January 2, 2001, which is
the next business day after the original deadline. Since this is only a status report, no
harm will come to any party as a result of this one business day extension.

Pursuant to D.C. COLO. LR. 7.1(A), on January 2, 2001, a telephone call was
placed to Plaintiffs Counsel, Mr. George Imatani, who advised that Plaintiff has no
objection to this one day extension
WHEREFORE, the Defendant United States respectfully requests that the Court
extend its deadline for filing a Status Report filed to January 2, 2001.

UNITED STATES' STATUS REPORT
The United States of America, for its agency, the Western Area Power
Administration ("WAPA"), by and through the United States Attorney for the District of
Colorado, Thomas L. Strickland and Assistant United States Attorney Paul J. Johns, for
its Status Report in response to the December 4, 2000 Order, responds as follows:
1. On October 31, 1997, the United States received notice of this action in
Weld County to quiet title to property on which the United States had an easement.
2. On November 21, 1997, the United States removed this action from Weld
County to United States District Court.
3. On December 30, 1997, the United States filed its Answer on behalf of its
agency, WAPA.
4. The United States has made serious efforts to reach a Settlement with
Plaintiff to allow this action to continue with the agreement that the United States'
easement on the property remain intact. It is anticipated that the Federal interest will be
stipulated if trial of the case occurs.
5. Plaintiffs counsel has advised the undersigned on January 2, 2001 that all
of the parties to the action are soon to be served or otherwise notified of the action and
further, that the matter should proceed to an uncontested hearing in the next 90 days.
