RE: APPROVE RESUBDIVISION (LOT LINE ADJUSTMENT ONLY) OF ARROWHEAD
SUBDIVISION, S#608 -TYLER RICHARDSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 10th day
of September, 2001, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of
hearing the application of Tyler Richardson, P.O. Box 328, Greeley, Colorado 80632, for a
Resubdivision (Lot Line Adjustment Only) of Arrowhead Subdivision on the following described
real estate, to-wit:
Lots 22 and 23, Block 1, 2nd Filing, Arrowhead
Subdivision; located in the NW1/4 of Section 27,
Township 5 North, Range 66 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, said applicant was present, and
WHEREAS, Section 24-5-30 of the Weld County Code provides standards for review of
said Resubdivision (Lot Line Adjustment Only), and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Weld County Department of Planning Services staff and all of the exhibits and evidence
presented in this matter and, having been fully informed, finds that this request shall be
approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 24-5-30.6 of the Weld County Code.
2. It is the opinion of the Board of County Commissioners that the applicant has
shown compliance with Section 24-50-30.C.3 of the Weld County Subdivision
Ordinance including specifically:
a. Section 24-5-30.C.3.a -- No utility easements are affected by the
proposed lot line change.
b. Section 24-5-30.C.3.b -- No utility easements have been designated
along the property line to be relocated due to the fact that utility
easements were not identified at this location at the time of the original
plat. All new construction will meet bulk requirements of the
A (Agricultural) Zone District, as outlined in Section 23-5-50 of the Weld
County Code.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of Tyler Richardson for a Resubdivision (Lot Line
Adjustment Only) S #608, on the hereinabove described parcel of land be, and hereby is,
granted subject to the following conditions:
1. The Resubdivision Plat shall be recorded in the Office of the Weld County Clerk
and Recorder. The map plat shall be prepared in accordance with
Sections 24-4-40.D.6 through 24-4-40.D.11 of the most recent version of the
Weld County Code.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 10th day of September, A.D., 2001.

THE DEPARTMENT OF PLANNING SERVICES' STAFF HAS APPROVED THIS REQUEST FOR THE
FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 24-5-30 of the
Weld County Code.
2. The request is in conformance with Section 24-5-30.C of the Weld County Code, as
follows:
24-5-30.C 3.a - The lot line revision complies with the approved recorded final plat. No utility
easements are affected by the proposed lot line change.
24-5-30.C 3.b - The application complies with the adopted rules,regulations, and ordinances currently
in force affecting the subdivision. No utility easements have been designated along the property line
to be relocated due to the fact that utility easements were not identified at this location at the time of
the original plat. All new construction will meet bulk requirements of the Agricultural Zone District, as
outlined in Section 23-5-50 of the Weld County Code.
3. Should the Board of County Commissioners approve this request, the Department of Planning
Services' staff recommends the following conditions be attached:
A. The Resubdivision Plat shall be recorded in the Office of the Weld County Clerk and Recorder. The
map plat shall be prepared in accordance with Section 24-4-40 D.6 through 24-4-40 D.11 of the
most recent version of the Weld County Code.

Dear Mr. Richardson:
Your telephone number provided in materials for the aforementioned land use application is
incorrect (371-3001). Therefore, I need to rely on mailing information to you regarding the Utility
Board hearing scheduled for Thursday,August 23 at 10:00 a.m. The hearing will take place in the
Planning Commission hearing room, second floor, 1555 North 17th Avenue, Greeley.
Please come prepared to discuss the service providers for the following utilities: Water, sewer,
electric power, natural gas and fire protection, telephone, cable, etc. A list of the names of
providers along with phone numbers and addresses will be helpful. There are seven Utility Board
members. Please bring an adequate number of copies of supporting documents. Utility Board
members will be curious to know how the lot line change will affect any existing utilities.
A hearing in front of the Board of County Commissioners will be scheduled after the Utility Board.
We can discuss times next Thursday. Please feel free to contact me with any questions.

Upon an actual and accurate field survey of these lots completed on May 17, 2001
by McRae 8 Short, Inc. , it was discovered that portions of the driveway and a
brick shed encroached over the line common to said lots. In order to remove
said encroachment, the owners are hereby making this application for a "Lot
Line Adjustment" to correct said fault. The plat of record on these lots does
not show any easements along the common line and to the best of our knowledge,
no utilities or restrictions exist thereon.
Research of the covenants on said lots shows no restrictions on the proposed
lot line adjustment.

WARRANTY DEED
THIS DEED, made this 14 day of_February, 2001, between SCOTT FISH FAMILY
TRUST ("GRANTOR"), and TYLER A_ RICHARDSON and KELLY S. RICHARDON, as
joint tenants, whose address is 5740 Arrowhead Drive, Greeley, CO 80634, ("GRANTEES ").
WITNESSETH, that the Grantor for Ten Dollars ($10.00) and for other valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, have granted,
bargained, sold and conveyed, and do grant, bargain, sell, convey and confirm, unto the Grantees,
their successors and assigns forever, all the real property, together with improvements, if any,
situate, lying and being in the County of Weld, State of Colorado, described as follows:

bargain, sell and convey the same in manner and form as aforesaid, and that the same is free and
clear from all former and other grants, bargains, sales, liens, assessments, encumbrances and
restrictions of whatever kind or nature, except any liens concerning outstanding real property taxes.
This Deed is an absolute conveyance, the Grantor having sold said land to the Grantees for
fair and adequate consideration,
Grantor declares that this conveyance is freely and fairly made, and that there are no
agreements, oral or written, other than this Deed between the Grantor and Grantees with respect to
said land.
The Grantor shall and will WARRANT AND FOREVER DEFEND the above-bargained
premises in the quiet and peaceable possession of the Grantees, their successors and assigns, against
all and every person or persons lawfully claiming the whole or any part thereof.

MODIFICATION OF PROMISSORY NOTE AND
DEED OF TRUST AGREEMENT
THIS MODIFICATION OF PROMISSORY NOTE AND DEED OF TRUST
AGREEMENT is entered into this 13 day of February, 2001 by and between FIRSTIER
BANK, ("FirsTier") and Tyler Richardson, Kelly Richardson ("Borrower") and Arlo
Richardson ("Guarantor").
WHEREAS, Tyler and Kelly Richardson, by virtue of an Assumption Agreement
executed of even date herewith, are obligated as borrowers to FirsTier on a debt evidenced by a
Promissory Note dated February 15, 2000, in the principal amount of$425,000.00, Loan No. 07-
183914, ("Promissory Note"). Borrowers are currently complying with the terms and conditions of
the Promissory Note and accordingly, the Promissory Note is not in default as of the date of this
Agreement; and
WHEREAS, Arlo Richardson is individually obligated as guarantor on the debt
evidenced by the Promissory Note; and
WHEREAS, said Promissory Note is secured by first lien interest in real property
described in Exhibit "A" attached hereto,as evidenced by a Deed of Trust dated February 15, 2000,
("Deed of Trust") which Deed of Trust has been recorded in the records of the Clerk and Recorder
for the County of Weld at Reception Number 2750250,on the 17" day of February, 2000; and
WHEREAS, the parties hereto are in agreement that the Promissory Note and Deed
of Trust referenced above shall be amended to amend the maturity date of the Note and Deed of
Trust.
NOW THEREFORE, for the mutual promises and covenants set forth herein and
for other good and valuable consideration, the receipt and sufficiency of which are hereby
acknowledged, the parties hereto agree as follows:
AGREEMENT
1. The Deed of Trust and Promissory Note referenced above, executed in favor
of FirsTier, shall be modified to reflect that the maturity date shall be February 15, 2005
2. In consideration of this Agreement, Arlo Richardson agrees that the
guaranty agreement which he has executed contemporaneously herewith for the benefit of FirsTier
guaranteeing the debt evidenced by the Promissory Note, shall continue and shall remain in full
force and effect.
3. All parties to this Agreement, agree and acknowledge by their execution
herein, that they consent to the terms and conditions of this Agreement and specifically
acknowledge and agree that this Agreement will not effect, in any way, nor be a basis for any

defense, set-off or claim on their continuing obligations on the debt to FirsTier pursuant to the
terms of the Promissory Note and Guaranty Agreement.
4. Except as modified herein, all other terms and conditions of the Promissory
Note, Deed of Trust, and Guaranty Agreement remain in full force and effect. In addition, all of the
real property described in the Deed of Trust shall remain subject to the lien, charge or encumbrance
of such document and nothing herein contained or done pursuant hereto shall affect or be construed
to affect the lien, charge or encumbrance of the Deed of Trust, or the respective priorities thereof
over other liens,charges, or encumbrances.
5. This Agreement applies to or inures to the benefit of and binds all parties
hereto and their respective heirs,successors and assigns.
6. This Agreement may be executed in counterparts, each of which shall be
deemed original, but all of which,together, shall constitute one and the same instrument.
