RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
VI #0000066 AGAINST TIMOTHY PALERMO FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Timothy Palermo, VI #0000066, is allegedly in violation of the Weld County
Code, and
WHEREAS, on the 10th day of April, 2001, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Timothy Palermo was not present or represented at said hearing, and
WHEREAS, at said hearing of April 10, 2001, the Board of County Commissioners
determined the property owner has brought the subject property into compliance and deemed it
advisable to dismiss said matter.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0000066 against Timothy Palermo be, and hereby is,
dismissed.
The above and foregoing Resolution on motion duly made and seconded, adopted by
the following vote on the 10th day of April, A.D., 2001.

Currently, there is a violation of Chapter 23, Article III (3) , Division 1,
Sections 23-3-20, 23-3-30 and 23-3-30.I of the Weld County Code. To bring the
property into compliance the "Noncommercial Junkyard" shall be removed or
completely screened from all adjacent properties and public rights-of-way.
The Department of Planning also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert
with the identified parties.

Dear Mr. Palermo,
The property referenced above remains in violation of the Weld County Zoning Ordinance. I have scheduled
a meeting with the Board of County Commissioners on April 10,2001,at 10:00 a.m.,to consider the violations
occurring on the property. As we discussed the above mentioned property is in violation of the following
Section(s) of the Weld County Code:
Chapter 23,Article III,Div 1 "A(Agricultural)Zone District'
Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30.1 "Noncommercial junkyard."
To bring the property into compliance the following option(s)are available:
The"Noncommercial Junkyard"consisting of miscellaneous building materials including aluminum and metal shall
be removed or screened from adjacent properties and public-rights-of way.
This meeting will take place in the County Commissioners'Hearing Room, First Floor,Weld County Centennial
Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance
to answer any questions the Board of County Commissioners might have about the violations.
Please also be advised that I will be taking video from the road or adjacent properties the day before the Violation
Hearing (indicated above).
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation, the action necessary to correct the violation, and that you
were given sufficient time to remedy the violation. If you have any questions concerning this matter, please call

Dear Mr. Palermo:
The uses on the above described property are being considered as a zoning code violation of Sections of the
Weld County Zoning Ordinance. Currently your property is in violation of the following Section(s)of the Weld
County Zoning Ordinance:
31.3.9 "Noncommercial Junkyard"consisting of metal,wood,bricks and miscellaneous debris.
DEFINITION:
STRUCTURE: Anything that is built, constructed, or erected, an edifice or building of any kind, or any piece of work
artificially built up or composed of parts joined together in some definite manner,but not including fences or walls used
as fences less than six (6) feet in height, poles, lines, cables or distribution facilities of public utilities. Semi-trailers as
defined in§42-1-102(70),CRS,situated as TEMPORARY or permanent storage units,not safe or not operable or illegal to
be used on public road rights of way,which are not licensed,shall be considered'STRUCTURES'in accordance with this
definition,shall comply with requirements set forth in this Ordinance,including required zoning SETBACKS and OFFSETS,
and shall be installed in accordance with the requirements set forth in the Weld County Building Code Ordinance.
Please also be aware of Section 31.5.3 of the Weld County Zoning Ordinance:
31.5.3 "Minimum offset:Three(3)feet,or one foot for each three(3)feet for building height, whichever is greater/
To bring your property into compliance with the Weld County Zoning Ordinance:
•
The"Noncommercial Junkyard"shall be removed or screened from all adjacent property owners and public rights-of-way.
To bring the Semi-trailer up to code, you have a couple of options:
1.) Maintain current license plates on place at all limes on the trailer.
2.) Otherwise,a building permit will be required. To obtain that application, feel free to stop by our office, or let
me know and I will me more than happy to mail it to you.
After further discussion with staff regarding the semi-trailer, it was determined that there is also a violation of the
Weld County Building Code Ordinance. In order to bring your property into compliance with the Weld County
Building Code Ordinance, an application for a building permit must be received and issued.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,we
have no discretion in this matter if you fail to correct this violation. You have 30 (thirty)days from , September
28,2000,to correct this zoning violation. Failure to do so will result in this office scheduling the violation before
the Board of County Commissioners to consider whether to refer the violation to the County Attorney's Office
for legal action.

Re: Violations of Timothy Palermo
Per our telephone conversation today, this letter will confirm that Timothy
Palermo has fenced the subject property on three sides, obscuring the
violation from the road. We understand that this resolves the current
violation. It is also Mr. Palermo's desire to be in compliance and he agrees
that if there are further complaints, he will clean up the building materials
in question, or fence the fourth side so that nothing is visible from the
road.
It is our understanding that you will read the above agreement into the
record at the County Commissioner's meeting on April 10, 2001 at 10:00 a.m.
