Further, I've made an on-site inspection of the present facility. The size of the present dairy requires it to adhere to the Confined Animal Feeding Operation (CAFO) Regulations, and continued compliance with these regulations must be observed during all phases of expansion. Animal density at the present time is approximately 600 square feet/lactating cow, and is within the recommended range for dry lot facilities in semi-arid climates. Proposed lactating cow corrals show the same density, with somewhat higher densities for dry cow and heifer corrals. These are all within accepted standards. Construction of new holding ponds, for storm water and for process wastewater, are underway. There are several small ponds, constructed by previous owners, located immediately south of the existing cow corrals that appear inadequate in construction. It is my understanding after talking with the applicant's representative, that those ponds will be closed and filled in upon completion of the new ponds. That is an appropriate action whether or not approval is given for the expansion. With these comments in mind,Weld County Extension has no objection to the proposed expansion of Kerb's Dairy. Sincerely, elk Keith R. Maxey Extension Agent(Dairy/Youth) Colorado State University,U.S.Department of Agriculture and Weld County cooperating. This project falls primarily under the purview of the Weld County Use by Special Review Standards. Our comments and requirements are as follows: COMMENTS: WCR 55 is designated on the Transportation Plan Map as a chemically stabilized base gravel road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-of-way line. There is one main access point to the facility between a modular and a mobile home. The access appears to be adequate for turning radiuses and two-way traffic to accommodate the dairy traffic. REQUIREMENTS: Directly north of the existing mobile home, the contractor has created a new access point to construct a new septic field. This access point shall be closed. Utilize the main access. No additional accesses will be granted. Pursuant to Ordinance 169A, If noxious weeds exist on the property, the applicant/landowner shall be responsible for controlling the noxious weeds on the property. On our site investigation, there were numerous noxious weeds evident. Please contact Ron Broda, Weld County Public Works Department, for a follow-up inspection. The traffic circulation pattern appears to be adequate for the proposed and existing facility. Storm Water Drainage: The storm water drainage will be referred to the Department of Health and Environment as it deal with animal units. pc: Ron Broda, Vegetation Management Specialist AmUSR-820 file plan8usr.wpd EXHIBIT a /C WeldtCounty Planning Dept. The ability of the District to provide adequate educational opportunities for its student population is depenant upon, among other matters, the availability of adequate land, or in the alternative the availability of funds to purchase adequate land. Since the approval of residential land development applications by local governments with territory within the boundaries of the District substantially impacts the District's ability to meet its obligations to the public, the District shall encourage and request that such local government entities refer to the District all residential land development applications for review and comments concerning the adequacy of public school sites and facilities. Further, the District shall encourage and request that such local government entities consider the District's' comments in conjunction with the review and processing of each individual residential development application, and cooperate with the District in regard to the mitigation measures established in this Resolution. The District shall promptly review the referred development application and promptly submit its comments, recommendations and requests consistent with the policy set forth in this Resolution, to the appropriate local government. 2. Land Dedication Requirements. In connection with any pending Or new application for residential land development to any local government with territory within the boundaries of the District, the District shall recommend and request that the following land dedication standards be imposed by such local government as a condition of development approval, except to the extent that the District, through its Superintendent or designee, has determined that the best interests of the District would be served•by the payment of the fees set forth in paragraph 3 hereof,in lieu of such land dedication. Land shall be dedicated to the District in an amount equal to the greater of: (a) 10 percent of the total size of the approved development,or(b)calculated at the rate of two acres for every 1,000 new residents reasonably projected by the District for the development. 3. Pecs in Lieu of Dedication. In the event the District, through its Superintendent or designee, determines that dedication of land is not in the best interests of the District, the District shall recommend and request that the following fees be paid in lieu of such land dedication,as a condition of approval of the development application by the local government. The fees shall be calculated as follows: (a)$750 for each new single-family residence;(b)$585 for each unit in a duplex or triplex; and(c)$420 for each unit in a multi-family structure other duplexes or triplexes. 4. It shall be an acceptable method of payment, for purposes of such agreements, for the fees to be paid as building permits are issued. 6. Exemptions. This policy is an effort to assist the district in mitigating the increasing capital cost of growth.
