RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
VI #0000303 AGAINST JOSE AGUIRRE FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Jose Aguirre, VI #0000303, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of May, 2001, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Richard Lipuma, representative for Jose Aguirre, was present at said
hearing, and.
WHEREAS, the Board of County Commissioners deems it advisable to continue said
violation to July 8, 2001, to allow adequate time for the property owner's attorney to be present
at said hearing, and
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0000303 be, and hereby is, continued to July 8, 2001,
at 10:00 a.m.

April 17, 2001 A group of individuals voiced their concern regarding this
property.
April 20, 2001 Letter received from Mr. Aguirre's attorney requesting
continuance. Continuance denied based on existing violation
and public concern.
April 23, 2001 Letter of response sent to Mr. Aguirre' s attorney.
Currently, there is a violation of Chapter 23, Article II1 (3) , Division 1, of
Sections 23-3-20, 23-3-30, 23-4-40 and 23-4-40 .0 of the Weld County Code. To
bring the property into compliance the property owner shall obtain approval of
a Use by Special Review permit and record the plat or remove the business and
business equipment from the property.
The Department of Planning also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert
with the identified parties .

(behind the fence). Mr. Aguirre said that he does
indeed have a construction business. He said that the
commercial vehicles are on the site during the day
and only return to the property overnight. He stated
that he wanted to build a structure to keep the
vehicles in. Julie explained his options to him. She
said that as long as he did not have several vehicles
and he built a structure to keep them in then he
could apply for a USR for a home business.

questions regarding my letter. I told him that the
construction on his property requires a "USR" permit.
He showed me the "USR" application that I had mailed
him. I informed him that it might be in his best
interest to go ahead and apply for the building
permits for the semi trailers being used as storage
units. I refered him to the Inspector on call (Frank)
to answer his questions in reference to the
application. He said that he would get the "USR"
packet in as soon as possible.

In reference to your letter received, April 20, 2001, we would recommend that Mr. Aguirre or another
representative attend the already scheduled violation hearing (May 8, 2001 at 10:00 a.m.) and request a
continuance from the Board of County Commissioners due to his representation not being able to attend.
Because of the on going violation and public concern, I can not grant an extension for this case. If the
continuance is granted, the next scheduled violation hearings will be on June 12, 2001 at 10:00 a.m.
Please contact me within five working days of the date of this letter to review these concerns with me or a

SUBJECT: Conversation with Jose Aguirre 2/22/01
* I spoke with Jose Aguirre regarding his pending USR application (USR-1318). I asked him
about what equipment will be stored in his designated "storage area" on his site plan. He
indicated that his vehicles and forms would be stored in the equipment storage area. The
forms would be stored in the vehicles.
* Mr. Aguirre also mentioned that his brother purchased a backhoe that would be stored on this
property along with a couple of skidloaders. I mentioned to Mr. Aguirre that these vehicles
were not listed in his application and that he needed to submit an updated list that reflects all
of the equipment that will be stored on this property.
* I mentioned to Mr. Aguirre that a complaint was received regarding the storage of a backhoe
and pallets on an adjacent property. Mr. Aguirre denied this. He did mention that a backhoe
was being stored on his property. I informed Mr. Aguirre that storage on outside properties is
unacceptable and could jeopardize his pending special use permit application.

not be permitted to use the special review permit process to develop."
31.4.15 "Home Business"
To bring the property into compliance the following option(s) are available:
As we have discussed a"Business"is not allowed in the Agriculture District unless a Use by Special Review"USR"
permit has been submitted and approved by the Board of County Commissioners. In order to bring the property into
compliance with the Weld County Zoning Ordinance,a"USR"application shall be completed and submitted to the
Department of Planning Services or the"Business"shall be removed from the property. Also,as I indicated to you
during our last telephone conversation,if we do indeed receive your application by February 12,2001,this case will
not appear before the Board of County Commissioners.
This meeting will take place in the County Commissioners'Hearing Room, First Floor,Weld County Centennial
Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance

The uses on the above described property are being considered as a zoning code violation of Sections of the
Weld County Zoning Ordinance. Currently your property is in violation of the following Section(s)of the Weld
County Zoning Ordinance:
31.2 "Uses allowed by Right in the A(Agricultural) District."
31.3 "Accessory Uses in the A District."
31.4 "Uses by Special Review in the A(Agricultural) District."
31.4.18 "Any use permitted as a Use by Right,an Accessory Use,or a Use by Special Review in the Commercial or Industrial
zone districts provided the property is not a lot in an approved or recorded subdivision plat or lots parts of a map or plan tiled prior
to adoption of any regulations controlling subdivisions. PUD development proposals shall not be permitted to use the special
review permit process to develop."
To bring your property into compliance with the Weld County Zoning Ordinance:
The commercial equipment consisting of skid loaders, cranes, steel forms, concrete, welding units and any other
commercial equipment shall either be removed from the site or a Use by Special Review"USR"permit shall be required.
Please be advised that Mr. Peyton (Attomey at Law)and I also discussed the requirement for obtaining building permits
for the use of a semi trailer for storage. Please note: the posting of a business address and/or phone number(which is a
residential address)in the telephone book,on business cards,in newspapers,etc.constitute a commercial business as well.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;however,we
have no discretion in this matter if you fail to correct this violation. You have 30(thirty)days from ,October 13,
2000, to correct this zoning violation. Failure to do so will result in this office scheduling the violation before
the Board of County Commissioners to consider whether to refer the violation to the County Attorney's Office
for legal action.

this matter has been set for a hearing before the Board of County Commissioners on May 8, 2001
at 10:00 a.m. This hearing was scheduled without any consultation with this office, although the
file of the Planning Department contains correspondence from me clearly indicating that I
represent Mr. Aguirre. I am not available on the morning of May 8 for this hearing because of
previously scheduled depositions of out of state witnesses in a pending District Court case. I
