The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards. Our comments and requirements are as follows:
COMMENTS:
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the State Highways.
Please contact Gloria Hice-Idler or Tess Jones at the Greeley office to verify the access permit or for any additional
requirements that may be needed to obtain or upgrade the permit. (SH 60)
The average daily traffic count reflects 3,900 vehicles taken in a 24-hour period on State Highway (SH) 60 at this
location. This count has been provided to the Weld County Public Works Department by the CDOT Traffic
Department.
REQUIREMENTS:
--The Weld County Public Works Department recommends approval of this application.
Drainage Plan: The 1.68 acre lot slopes to the north with little or no vegetation. The applicant shall provide a
plan to contain storm water run-off from their site that prevents damage to the adjacent properties north of the
proposed facility. This shall be designated on the plat as a detention facility and covered in a paragraph in the
application or on the plat.
Parking: Off-street parking and loading areas shall be surfaced with either gravel, asphalt, or concrete and shall
be graded so as to prevent drainage problems.

Environmental Health Services has reviewed this proposal for a Truck and Landscape Materials Storage. We have no
objections to the proposal, however, we do recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. Apply for an Underground Injection Control (UIC)Class V Injection Well permit through the Environmental
Protection Agency(EPA), for the floor drain system that serves the maintenance shop, or provide evidence
that the applicant is not subject to the EPA Class V requirements.
2. Submit a dust abatement plan to the Environmental Health Services, Weld County Department of Public
Health&Environment, for approval prior to operation.
3. The septic system serving the house shall be reviewed by a Colorado Registered Professional Engineer. The
review shall consist of observation of the system and a technical review describing the systems ability to
handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services
Division of the Weld County Department of Public Health and Environment. In the event the system is found
to be inadequately sized or constructed the system shall be brought into compliance with current Regulations.
4. The applicant shall submit a waste handling plan, for approval,to the Environmental Health Services
Division of the Weld County Department of Public Health& Environment. The plan shall include at a
minimum, the following:
I) A list of wastes which are expected to be generated on site(this should include expected volumes
and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including the facility name, address,
and phone number).
We recommend that the following requirements be incorporated into the permit as"development standards":
1. An individual sewage disposal system is required for the proposed work shop and shall be installed according
to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed
by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface
and groundwater contamination.

3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes
specifically excluded from the definition of a"solid waste" in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended.
4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing
debris, and other potential nuisance conditions.
5. Fugitive dust shall be controlled on this site.
6. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as
delineated in 25-12-103 C.R.S., as amended.
7. Adequate toilet and handwashing facilities shall be provided for employees and the public.
8. The applicant shall remove,handle, and stockpile overburden, soil, sand and gravel from the facility area in a
manner that will prevent nuisance conditions.
9. All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and handled in a safe
manner. Reference 25-8-205.5 Colorado Water Quality Control Act and Rules and Regulations thereof.
10. The facility shall utilize the existing public water supply. (Little Thomson Water District)

Mr. Robert Anderson:
Thank you for referring case number USR-1333 to the School district. As stated in
previous letters the projected student impact upon the Johnstown-Milliken School district
appears to be minimal as presented at this time. Currently our schools are above or
nearing capacity, especially at the elementary levels. Our facilities plan indicates that we
will have the need to build an additional elementary school with the next two years.
As of this date the Towns of Johnstown, Milliken and Berthoud have formally passed a
resolution and ordinance describing the land dedication or cash in lieu of land dedication
for education. At present,the cash in lieu of land dedication fee is $750. This fee is paid
at the time of the issuance of a building permit and is paid directly to the school district.
As this referral does not include any new residential facilities, the school district does not
object to this request. If in the future, residential dwellings are planned, we would
request that the owner pay the cash-in-lieu fee that is in effect at that time.

Dear Mr. Anderson;
In reference to the Site Specific Development Plan and a Special Review Permit for a
Use permitted as a use by Right or Accessory Use in the Commercial Zone District in the
Agriculture Zone District the Town of Milliken found "no conflict" with this request,
but did ask the Bernhardts' to annex to the Town of Milliken once the surrounding 80
acres is developed. They are also going to try to comply with the Town of Milliken
Commercial Standards.
