HomeMy WebLinkAbout20010316 RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JANUARY 31, 2001 TAPE #2001-05 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, January 31, 2001, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner M. J. Geile, Chair Commissioner Glenn Vaad, Pro-Tem Commissioner William H. Jerke Commissioner David E. Long Commissioner Robert D. Masden Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther E. Gesick Director of Finance and Administration, Donald D. Warden MINUTES: Commissioner Vaad moved to approve the minutes of the Board of County Commissioners meeting of January 29, 2001, as printed. Commissioner Long seconded the motion, and it carried unanimously. ADDITIONS TO AGENDA: There were no additions to the agenda. CONSENT AGENDA: Commissioner Vaad moved to approve the consent agenda as printed. Commissioner Long seconded the motion, and it carried unanimously. PRESENTATIONS: RECOGNITION OF SERVICES, WELD LIBRARY DISTRICT - ALBERTA JACOBSEN, MARJORIE STAUFFER, CONSTANCE HANSEN: Chair Geile read the certificate recognizing Alberta Jacobsen,who was present, for 19 years of service to the Weld Library District. Chair Geile also read the certificates recognizing Marjorie Stauffer and Constance Hansen,who were not present,for their years of service with the Weld Library District. RECOGNITION OF SERVICES, HUMAN SERVICES DEPARTMENT-MARIA NINO:Chair Geile read the certificate recognizing Maria Nino for 26 years of service to the Department of Human Services. Walt Speckman, Director of Human Services, presented Ms. Nino with flowers and a Weld County pin, and thanked her for the many years of dedication to the Department of Human Services. COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports. 2001-0316 BC0016 PUBLIC INPUT: Bill Crowley, Power Equipment Company, read a letter into the record, marked Exhibit A, regarding the Motor Grader Bid. WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants for approval by the Board: All Funds $408,755.30 Electronic Transfers -All Funds $907,392.51 Commissioner Vaad moved to approve the warrants as presented by Mr. Warden. Commissioner Long seconded the motion, which carried unanimously. BIDS: PRESENT CONCRETE BOX CULVERTS BIDS - DEPARTMENT OF PUBLIC WORKS: Pat Persichino, Director of General Services, presented the two bids received. Said bids will be considered for approval on February 14, 2001. PRESENT 2001 SLURRY SEAL PROJECT BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino presented the three bids received. Said bids will be considered for approval on February 14, 2001. PRESENT RUBBERIZED CRACK FILLING BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino presented the five bids received. Said bids will be considered for approval on February 14, 2001. PRESENT BITUMINOUS PAVEMENT HOT/COLD MIX AND ASPHALT BID-DEPARTMENT OF PUBLIC WORKS: Mr. Persichino presented the four bids received. Said bids will be considered for approval on February 14, 2001. PRESENT FOUR-DOOR, FOUR-WHEEL DRIVE VEHICLE BID - SHERIFF'S OFFICE: Mr. Persichino presented the five bids received. Said bids will be considered for approval on February 14, 2001. PRESENT HEAT VACUUM APPLICATOR BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino presented the sole bid received. Said bid will be considered for approval on February 14, 2001. PRESENT CONCRETE AND WASHED ROCK ON CALL BID-DEPARTMENT OF PUBLIC WORKS: Mr. Persichino presented the two bids received. Said bids will be considered for approval on February 14, 2001. PRESENT 2000 MILK BID -SHERIFF'S OFFICE: Mr. Persichino presented the two bids received. Said bids will be considered for approval on February 14, 2001. PRESENT SOUTH COUNTY ADMINISTRATION BUILDING BID - DEPARTMENT OF FINANCE: Mr. Persichino presented the twelve bids received. Said bids will be considered for approval on February 14, 2001. In response to Commissioner Vaad, Mr. Jerome stated a heat vacuum applicator is used to make road signs. Responding to Chair Geile, Mr. Persichino stated the amounts shown in Bid #B000251 are more than the amount budgeted. He explained once the value engineering is complete, staff will meet with the Board in a work session to discuss the final amounts. He stated they will meet with the apparent low bidder next week to begin the negotiation process. Minutes, January 31, 2001 2001-0316 Page 2 BC0016 APPROVE MOTOR GRADER BID-DEPARTMENT OF PUBLIC WORKS: Considering the remarks read into the record by Mr. Crowley during Public Input, Mr. Persichino recommended this matter be continued to allow staff more time to review the cost comparisons. Commissioner Vaad stated that request may not be appropriate bid procedure since the bids have already been closed. Commissioner Jerke and Mr. Warden concurred. Mr.Warden suggested the Board consider rejection of all bids and rebidding the item. Responding to Chair Geile, Mr. Barker stated it is appropriate to accept further testimony from Bill Crowley. Mr. Crowley stated he attended the work session yesterday; however, he was not allowed to comment. He stated the total cost only came up on the motorgarders, not other equipment. He stated Power Equipment Company has been denied demonstrating its equipment for the past four years. He stated they are willing to give Weld County three machines for a one-year period without charge,and the County would only be responsible for maintenance costs. Chair Geile commented the Board must also consider the sell back amount, not just the purchase price. Responding to Chair Geile, Mr. Crowley explained the purchasers are given a check at the time of buyback, not credit towards more equipment. Chair Geile stated the Board must consider cost, maintenance,and resale value,and Power Equipment Company was not the low bidder on all of those specifications. Responding to Commissioner Jerke,Mr. Persichino stated all records on bids are public information and the bidders that are rejected have access to that information. Commissioner Vaad commented the net-five year cost from Wagner was a significant savings, regardless of the $75,000 difference in face value. Rick Moley, Wagner Equipment, expressed concern with altering the bid process. He stated the figures are available in the bid specifications, and the Board should not allow proposals which are different from the original bid process. There being no further comments, Chair Geile closed public testimony. Mr. Persichino stated the Department of Public Works recommends approval of the bid from Wagner, in the amount of $154,124.00 per machine. Commissioner Jerke moved to delay said bid to allow the Departments of Public Works and Purchasing additional time to review the bid proposals. Commissioner Vaad seconded the motion. He stated he is willing to make an exception in this case because Power Equipment Company was the apparent low bidder. Commissioner Masden stated he is in favor of the motion; however, he wants to ensure this is not allowed on a continuous basis. In response to Chair Geile, Mr. Persichino stated if the new proposal from Power Equipment Company is not acceptable, the Board can choose to rebid the matter. The motion carried unanimously. APPROVE WALK-IN-BEHIND COMPACTOR VIBRATOR TRENCH ROLLER BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the Department of Public Works recommends approval of the low bid from United Rentals, in the amount of$23,090.00. Commissioner Vaad moved to approve said bid as recommended by staff. Commissioner Masden seconded the motion, which carried unanimously. APPROVE TANDEM WITH SNOW PLOW AND MATERIAL SPREADER BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the Department of Public Works recommends approval of the low bid from Transwest Trucks, in the amount of$187,279.00. Commissioner Vaad moved to approve said bid as recommended by staff. Commissioner Long seconded the motion. Responding to Commissioner Jerke, Mr. Persichino stated the specification information is listed in order and when the options are eliminated,Transwest Trucks is the low bidder. Commissioner Long requested a five minute recess. Upon reconvening, the motion carried unanimously. APPROVE TRACTORS BID-DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the Department of Public Works recommends approval of the low bid from Ellis and Capp Equipment, in the amount of $83,398.00. Commissioner Vaad moved to approve said bid as recommended by staff. Commissioner Masden seconded the motion, which carried unanimously. Minutes, January 31, 2001 2001-0316 Page 3 BC0016 APPROVE TANDEM TRUCK TRACTOR BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the Department of Public Works recommends approval of the low bid from Rocky Mountain I-H Trucks, in the amount of$65,985.04. Commissioner Masden moved to approve said bid as recommended by staff. Commissioner Vaad seconded the motion, which carried unanimously. APPROVE TANDEM TRUCK TRACTOR BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the Department of Public Works recommends approval of the low bid from MHC Kenworth-Greeley, in the amount of$83,886.00, without the winch option. Mr. Persichino stated staff recommends the two lower bids be rejected because they did not meet the specifications for suspension. Commissioner Long moved to approve said bid as recommended by staff. Commissioner Vaad seconded the motion, which carried unanimously. APPROVE TRACTORS BID-DEPARTMENT OF PUBLIC WORKS: Mr.Persichino stated the Department of Public Works recommends approval of the low bid from Transwest Trucks, in the amount of$76,077.00. Commissioner Vaad moved to approve said bid as recommended by staff. Commissioner Masden seconded the motion, which carried unanimously. APPROVE 3/4-TON 4-WHEEL DRIVE PICKUP BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the Department of Public Works recommends approval of the low bid from Heritage Ford, in the amount of$.23,283.00 with the manuals. Commissioner Masden moved to approve said bid as recommended by staff. Commissioner Vaad seconded the motion, which carried unanimously. APPROVE 1/2-TON 4X4 REGULAR CAB PICKUP BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the Department of Public Works recommends approval of the low bid from King Oldsmobile-GMC-Subaru, in the amount of$18,219.00. Chair Geile commented that because there is less than a one-percent difference between the two lowest bids, the Board may choose to favor the local County vendor. Commissioner Vaad moved to approve the second bid from Weld County Garage. Commissioner Jerke seconded the motion, which carried unanimously. APPROVE ONE-TON DUAL WHEELS WITH SERVICE BODY BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the Department of Public Works recommends approval of the low bid from Formby Interstate Ford, in the amount of$26,935.00. Commissioner Vaad moved to approve said bid as recommended by staff. Commissioner Masden seconded the motion, which carried unanimously. APPROVE ONE-TON CAB AND CHASSIS WITH EXTENDED CAB BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated Ghent Chevrolet has a 2001 truck for$23,620.00; however, Weld county Garage has a new 2000 truck in stock for$23,000.00. Responding to Chair Geile, Mr. Persichino stated the 2000 truck is new and has not been sold off the lot. Commissioner Vaad moved to approve the bid for the 2000 vehicle from Weld County Garage. Commissioner Jerke seconded the motion,which carried unanimously. APPROVE ONE-TON CREW CAB WITH SERVICE BODY BID - DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the Department of Public Works recommends approval of the low bid from Garnsey and Wheeler, in the amount of $32,029.00. Commissioner Masden moved to approve said bid as recommended by staff. Commissioner Jerke seconded the motion, which carried unanimously. APPROVE ONE-TON 4X4 CAB AND CHASSIS WITH DUAL WHEELS BID-DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the Department of Public Works recommends approval of the bid from Ghent Chevrolet, in the amount of$25,219.00. He stated the first two bids did not meet specifications. Commissioner Vaad moved to approve said bid as recommended by staff. Commissioner Masden seconded the motion, which carried unanimously. Commissioner Masden moved to approve said bid as recommended by staff. Commissioner Vaad seconded the motion, which carried unanimously. APPROVE 1/2-TON COMPACT PICKUP WITH CAMPER SHELL BID - PRINT SHOP: Mr. Persichino stated the Print Shop staff recommends approval of the low bid from Garnsey and Wheeler, in the amount of$12,953.10. Commissioner Vaad moved to approve said bid as recommended by staff. Commissioner Masden seconded the motion, which carried unanimously. APPROVE MID-SIZED 4-WHEEL DRIVE PICKUP BID - DEPARTMENT OF BUILDING INSPECTION: Mr. Persichino stated staff recommends this bid be rejected to allow all vendors to bid on mid-sized, four- wheel drive pickups. Commissioner Vaad moved to reject said bid as recommended by staff. Commissioner Long seconded the motion, which carried unanimously. APPROVE CIVILIAN VEHICLES BID - SHERIFF'S OFFICE: Mr. Persichino stated the Sheriff's Office recommends approval of the low bid from Heritage Ford, in the amount of $30,241.00. Commissioner Vaad moved to approve said bid as recommended by staff. Commissioner Masden seconded the motion, which carried unanimously. APPROVE PATROL VEHICLES BID - SHERIFF'S OFFICE: Mr. Persichino stated the Sheriffs Office recommends approval of the second low bid from Heritage Ford, in the amount of$20,970.00 per vehicle. Following discussion regarding the one percent difference between the bids from Heritage Ford and Formby Interstate Ford, Inc., Commissioner Vaad moved to approve the bid from Heritage Ford as recommended by staff. Commissioner Long seconded the motion, which carried unanimously. APPROVE TRANSPORT MINIVAN BID-SHERIFF'S OFFICE: Mr. Persichino stated the Sheriffs Office recommends approval of the sole bid from Burt Chevrolet, in the amount of$104,850.00. Commissioner Masden moved to approve said bid as recommended by staff. Commissioner Vaad seconded the motion, which carried unanimously. APPROVE MAXI VANS BID - DEPARTMENT OF HUMAN SERVICES: Mr. Persichino stated the Department of Human Services recommends approval of the sole bid from Adaptive Automotive, Inc., in the amount of $34,590.00 per unit for a total of$138,610.00. Commissioner Masden moved to approve said bid as recommended by staff. Commissioner Long seconded the motion,which carried unanimously. APPROVE MAXI VANS WITH LIFTS BID-DEPARTMENT OF HUMAN SERVICES: Mr. Persichino stated the Department of Human Services recommends approval of the sole bid from Adaptive Automotive, Inc., in the amount of$38,4910.00 per unit for a total of$76,980.00. Commissioner Masden moved to approve said bid as recommended by staff. Commissioner Long seconded the motion,which carried unanimously. APPROVE ROADSIDE SPRAYING SYSTEM BID- DEPARTMENT OF PUBLIC WORKS: Mr. Persichino stated the Department of Public Works recommends approval of the low bid from Westheffer Company, in the amount of $10,527.72.00. Commissioner Vaad moved to approve said bid as recommended by staff. Commissioner Masden seconded the motion, which carried unanimously. NEW BUSINESS: CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES AND AUTHORIZE CHAIR TO SIGN- ATOMIC I, LLC: Michael Sampson, Assessor's Office, stated staff recommends approval of this petition. He explained based on income information that was not available at the time in 1999, the property owner Minutes, January 31, 2001 2001-0316 Page 5 BC0016 filed a protest in 2000, at which time staff recommended they file an abatement for the 1999 value. Commissioner Vaad moved to approve said petition and authorize the Chair to sign. Seconded by Commissioner Masden, the motion carried unanimously. CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES AND AUTHORIZE CHAIR TO SIGN- LEASE CAPITAL CORPORATION: Christopher Woodruff, Assessor's Office, stated because the equipment was used for agricultural operations, it should have been exempt from taxation, and staff recommends approval of the petition. Commissioner Vaad moved to approve said petition and authorize the Chair to sign. Seconded by Commissioner Long, the motion carried unanimously. CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES AND AUTHORIZE CHAIR TO SIGN- BLOSKAS WH AND ASSOCIATES: Mr. Sampson stated staff recommends approval of this petition because due to a chemical spill in the basement, the property value was lowered. Responding to Chair Geile, Mr. Sampson stated the property was originally assessed at $23,200.00. Commissioner Vaad moved to approve said petition and authorize the Chair to sign. Seconded by Commissioner Jerke, the motion carried unanimously. CONSIDER QUIT CLAIM DEED TO PLATTEVILLE HISTORICAL SOCIETY FOR FORT SAINT VRAIN MONUMENT AND AUTHORIZE CHAIR TO SIGN: Bruce Barker, County Attorney, stated approval of this Quit Claim Deed will finalize the process for deeding the St. Vrain Monument to the Platteville Historical Society,which is good standing in Colorado and as such can own property. He stated the Society has also requested a fence be located around the perimeter, a survey be conducted to locate the official markers, and a road sign be posted to assist the public in accessing the site. Commissioner Vaad moved to approve said Quit Claim Deed and authorize the Chair to sign. The motion,which was seconded by Commissioner Jerke, carried unanimously. CONSIDER WELD COUNTY GOVERNMENT EMPLOYEES'CAFETERIA PLAN: Mr. Warden stated the IRS passed Section 125.A of the IRS Code, which allows employees to redirect their salary for health, dental, vision, and other benefits on a pre-tax basis. He stated this results in a savings to the employees and the County which does not have to pay Social Security on the wages directed to pretax benefits. Mr. Warden stated the IRS has changed the regulations to clarify when employees can change marriage status, clarified independent care, and the County has until July 1, 2001,to be in compliance with new IRS regulations, and he recommended approval. Commissioner Masden moved to approve said plan. Commissioner Vaad seconded the motion, which carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board. We request this because we are not confident the data used to evaluate our Volvo Motor Graders is the most current, and accurate. Power Equipment Company offers the following proposal to you: Weld County purchases the VOLVO Motor Graders as specified in Bid#14 for $398,576.00. After one year of operation and less than 1500 hours of use, Power Equipment Company WILL repurchase the three units for the original purchase price of $398,576.00.
