Attempting to address the requirements of the fire district I would first like to mention part I sub paragraph 5 of the same resolution letter requiring the fire requirements be met by the builder before permits for building are issued. Secondly there is not enough fire flow for subdivision standards but plenty for an in home sprinkler system. A six-inch water line was installed along the 30-ft wide easement as required for the Bohrer PUD. The flow on that line was measured and was found to be over 525 gallons per minute of water. The District does not object to the recorded exemption, but does have the following comments and requirements for construction of homes, including the installation of a manufactured home, on either parcel: • All construction shall be in accordance with the provisions of the Uniform Fire Code, as ratified by the Weld County Commissioners, and ail other codes and ordinances, as enforced by Weld County. • Water supply for fire protection may be required for a new structure. In instances when a request is for a recorded exemption and not a subdivision, water supply for fire protection is not required for a single family residence that is not larger than 3,600 gross squaw feet and is placed on at least a 2.5 acre site. If a residence exceeds 3,600 gross square feet,or is placed on less than 2.5 acres,water supply for fire protection requirements apply. All other structures may require water supply for fire protection depending on the use of the new structure. • When water supply for fire protection is required, a minimum fire flow of 1,000 gallons of water per minute, measured at a residual pressure of 20 pounds per square inch (p.s.i.), is required for one- and two-family dwellings not exceeding 3,600 gross square. All other buildings (including larger one- and two-family dwellings) require a minimum fire flow of 1,500 gallons of water per minute, measured at a residual pressure of 20 pounds per square inch (p.s.i.)and may require more depending on the building size and type of construction as per Appendix III-A of the Uniform Fire Code. • Before construction may begin on any lot, fire department apparatus access must be provided for all structures in excess of 150 feet from a public access road. Fire apparatus roads shall be extended so fire apparatus may reach to within 150 feet of all portions of the building. Apparatus access roads shall be a minimum of 20 feet in width and be designed and maintained to support the imposed loads of fire apparatus(60,000 pounds). This road is maintained by Weld County. E. A 30-foot wide joint easement extending across Lots A and B from Weld County Road 1, for the benefit of all lots in Recorded Exemptions #2895 and #2896, shall be shown clearly on the plat. The joint access easement shall be dedicated for the use as shown using the language set forth in Section 24-8-70.L of the Weld County Code. The applicant shall address the requirements of Weld County School District RE-1J as stated in the referral response dated October 16, 2000. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. G. The applicant shall attempt to address the requirements or concerns of the Mountain View Fire Protection District, as stated in the referral response dated October 9, 2000. H. The applicant shall provide the Weld County Department of Planning Services with a certificate from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. The following notes shall be placed on the plat: 1) All proposed or existing structures will meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in Chapter 23 of the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure, as defined and limited to those occupancies listed as Groups A, B, E, H, I, M, and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed within a 200-foot radius of any tank battery, or within a 150-foot radius of any wellhead. The property is currently zoned Agricultural. Approval of this Recorded Exemption would not be consistent with the intent of the Zone District. The property is designated as "Prime"and"Irrigated, Not Prime Farm Ground". The Agricultural Zone District is established to maintain and promote agriculture as an essential feature of the County. The Agricultural Zone District is intended to provide areas for the conduct of agricultural activities and activities related to agriculture and agricultural production without the interference of other, incompatible land uses. This area is becoming increasingly incompatible with agricultural uses. c. Section 11.4.2.3- Consistency with the intent of the zone district the recorded exemption is located within as expressed in the Weld County Zoning Ordinance. A.Policy 1 states, "Agricultural zoning will be established and maintained to protect and promote the County's agricultural industry." The site has an existing pivot sprinkler that is irrigating both Lot A and Lot B of RE-1617. Sufficient area was left to build on the previously established lots without interfering with the pivot irrigation system. As proposed, the pivot sprinkler must be removed prior to building on two of the proposed lots. d. Section 11.4.2.4-Consistency with the purpose of efficient and orderly development as expressed in Section 1.3 of the Weld County Subdivision Ordinance. 1) Section 1.3.1 -Assisting orderly and integrated development. Staff believes that the further splitting of properties in this area is not orderly and integrated development. 2) Section 1.3.2 - Promoting the health, safety, and general welfare of the residents of the County. An increase in the number of lots in this area will detract from the health, safety and welfare of the residents of the county. The overall impact on services may effect the welfare of the residents in the area. As more and more people move into rural areas, an increase of urban type services is required. 3) Section 1.3.5-Encouraging well-planned subdivisions by establishing adequate standards for design and improvement. Adequate standards for design and improvement have not been established for this area, since this is Recorded Exemption application. The Recorded Exemption process has been utilized rather than the appropriate subdivision process. The Recorded Exemption process does not require the applicant to provide the same services that a subdivision process would require. The applicant is not required to provide an internal road system, public water, a Geotechnical Survey to evaluate any Geological Hazards and soil conditions of the proposed lots, or any of the other requirements of a subdivision. Normally a subdivision would require a Change of Zone as part of the process, these lots will remain zoned Agricultural. The subdivision process also requires public hearings, with public input. The public is not notified of Recorded Exemptions and does not have the opportunity to comment on the seven lots being created through this process. 4) Section 1.3.7-Safeguarding the interests of the public, the homeowner, and the subdivider. 5) Section 1.3.8-Securing equitable handling of all subdivision plans by providing uniform procedures and standards. Uniform procedures and standards have not been applied to this application, because it does not follow the same guidelines as a traditional subdivision. Mr. Bohrer has created a five lot Planned Unit Development adjacent to the four proposed parcels.The nine lot would be an urban scale subdivision outside of an area approved for urban scale development. 6) Section 1.3.10 - Preserving agricultural land and promoting its most productive agrarian use. Agricultural land has not been preserved in this area and allowing for further division through the Recorded Exemption process will further diminish the agrarian uses of the area. 7) Section 1.3.17-Providing adequate space for future development of schools and parks to serve the population. This provision has not been met through this application. e. Section 11.4.2.5- Compliance with the recorded exemption standards set forth in Section 11.8 of the Weld County Subdivision Ordinance. 1) Section 11.8.3-An adequate legal access exists for all proposed lots to a public road. All accesses shall be in accordance with Section 3 of the "Weld County Public Works Policies", Ordinance No. 180, as amended. Through a subdivision process, the four proposed lots would be required to access from an internal road system.Because no right-of way exists along the north section line,only one of the four lots has direct access to Weld County Road 1. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks,including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness,wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms,those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads;dust from animal pens,field work,harvest,and gravel roads;odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102,C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over4,000 square miles in size(twice the State of Delaware)with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement,ambulance,and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient that urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. The Recorded Exemptions are proposed on two adjacent lots which were previous Recorded Exemptions lots also created by the by Mr. Bohrer. The 30 and 38 acre parcels are located approximately three miles west of the Town of Mead, east of Weld County Road 1, south of the Weld County Road 32 section line. The parcels of land are directly north of B ohrer Planned Unit Development,created by the applicant in 1998. Based upon submitted infoiruation, referral agencies, and the governing mechanism of the County, the Department of Planning Services' staff has concerns regarding this request. The applicant is requesting to divide this section into one flag lot and three island lots. Staff has the following concerns: 1. The applicant has not demonstrated that this application is consistent with efficient and orderly development. These are the fourteenth and fifteenth requests for Recorded Exemptions in this section, since 1973. These recorded exemptions have created twenty-five lots, varying in size from approximately one acre to seventy acres in size. The existing lots are a flag lot and an island lot. The proposal would create two additional island lots in an area inundated with small lots, accessing from Weld County Road 1,which is classified as a collector status road. 2. The conflict between rural and urban activities is evident in this request. When an urban growth pattern is established without regard to long range comprehensive planning the outcome lacks the essential elements of long term desirability. Higher costs are incurred by providing many public services to urban sprawl areas. As urban areas develop and expand they inadvertently influence surrounding areas. These areas are either converted to urban uses themselves or are in direct conflict and competition with agricultural areas. 3. The applicant has failed to comply with the Agricultural Zone District intent. This parcel is located outside of an Urban Growth Boundary Area. Continued division of this parcel emphatically opposes the intent of the Agricultural Zone District. The potential to interfere and encroach upon the agricultural activities of this area is evident. Each is different than the other but are very similar because they are for adjoining lots. In my initial telephone contact with the Weld County Planning office on September 6th, 2000,there were a few comments made by an unknown individual who was in the room when I was talking to the planner on duty that day. Those comments are what prompted this cover letter as a matter of explanation. The first comment had to do with the required amount of time between subsequent recorded exemption. RE 1617 was done and approved Jun 15, 1994,which makes it fall within the time frame of a 5 year waiting period before another application can be filled. I amended RE 1617 and moved the center lot line some 30 feet to accommodate my center pivot in 1997. Prior to doing this I made several trips to the Weld County Planning Office to discuss the very matter of changing the waiting time if I amended the existing RE. At that time I spoke with Mr. Todd Hodges,current planner II,Mr. Scott Ballstadt, current planner, and a lady name Shanie. I was told by all three that because I was proposing moving the interior boundary line of the RE that would have no effect on the recording date because I was not change the exterior size of the original plat and no outer boundaries were moved. O course the recent comment was directed at the amended date of the RE and the 10 year waiting period. I realize that personnel and policies change over time,but something as important as the policy concerning that date of recording should be consistent and I do hope it is. I proceeded with the amendment in good faith and guidance from Weld County Planning Staff members and would never have done so knowing a change of recording dates would occur,I sure hope it didn't. The second comment concerned the avoidance of doing a PUD by applying for two recorded exemptions. That whole notion, (in my opinion),is absurd. It is obvious to me that whoever made the comment has never gone through the process personally. By doing a PUD I would have the possibility of 10-14 lots to divide among my heirs, sell,or do what ever I wanted. The recorded exemptions will net 4 lots. The PUD would net a considerable amount of additional revenue vs.,the Recorded Exemption. I simply do not wish to do a PUD,I want my heirs to live in the country, or at least have the opportunity to so. I hope this cover letter will circumvent some of the questions or concerns that might arise regarding RE 1617,or the application for Recorded Exemption here to attached. There is currently 1/4 share of irrigation water from the Highland Ditch assigned to the lot. When divided each lot will be assigned 1/8 share of Highland water, which is enough to allow access to the headgate, which is on the property, and will make available additional water if desired. 2. The proposed lots will have a septic system that complies with all Weld County Health Department regulations at such time a residence is established. There are no plans for construction in the very near future. 3. The property is zoned agricultural but is not being farmed. It has been idle for 2 years and I plan to retire from farming. It will be planted to grass in the spring of 2001, and the center pivot removed a short time later. The entire lot is designated irrigated non-prime farmland and is under 80 acres in size, (30 acres), and therefore is not a viable farming operation. (A. Goal 9) 4. I am retiring from farming and dividing the parcel will greatly aid in the fair and equitable distribution of my estate to my heirs. In addition the current parcel is zoned agricultural, and will remain agricultural, but is not large enough to provide enough farm income. The property has never been very productive, I would imagine the soil classification plays a part in this. Each lot will be willed to one of my heirs, and I would believe that a residence would be built on them in the future. With the remaining part of the lot left in grass for hay. 5. The location of the new lots will be approximently 1 1/2 miles north of Highway 66, just off county road 1, at the intersection of Vermilion Rd and county road 1. First and foremost the lots are zoned agricultural and will remain agricultural, unless Weld County re-zones them. Water will be available for irrigation if desired. The lots are accessible via a road presently located along the section line which is deeded property, and a perpetual agreement is in place dated September 3rd, 1994, recorded 10/18/94, Rec., 2411384, Book 1463, page 687. The mineral rights will remain on the lots. In addition a road maintenance agreement will be in place, along with covenants upon approval of application. The property is also included in the urban growth boundaries of both cities of Mead and Longmont. 11. There are 50-70 single family dwellings in the area, and there are lots and homes on 3 sides of the property. The zoning around the property consists of agricultural, and rural residential therefore the lots would be very compatible with the surrounding properties. In addition growth from the city of Longmont and Mead is moving closer each month. 12. The proposal is consistent because the lots will remain agricultural and there are also multiple zoning in the area. It is also in the urban growth boundaries of both Longmont and Mead which both have multiple zoning. There is only one tract of land being farmed in the immediate area, it consists of about 20 acres. The rest is in pasture or hay. There are small tracts of land from 2 1/2 acres to 17 acres, with residences, all around the property. 13. The size of the lots and the intent to zone agricultural would lend itself to an efficient and orderly development. Health and safety is provided by the Longmont Hospital which is approximently 7 miles away, the Weld County Sheriffs Dept., Mountain View Fire District with a station in Mead, and the Colorado State Patrol. In addition a road maintenance agreement will be in place for the well being and safety of the lot owners. All building permits will be obtained from Weld County as well as septic permits. All utilities are available on CR 1, with water available from Longs Peak Water District. Erosion will be kept in check with planting of grass which will promote the beauty of the county. In addition the lots will be large enough as not to look like a subdivision. Each lot has access to the Highland Ditch for irrigation water and there is no concern for flooding as the property is not in a flood plain, nor near a river.
