Kirby, Chairman Board of Weld County Commissioners Office of Board of County Commissioners P.0. Box 758 Greeley, CO 80631 Re: Location of Right-of-Way along approved Laramie River-Ault 345 kV Transmission Line Dear Mr. Kirby: In response to your letter of January 28, 1980, we have very care- fully examined our routing of the Laramie River-Ault Transmission Line near the town of Carr. As you may recall in your letter, mem- bers of the Wheatland-Ault Landowners Association presented a proposal to the Board of County Commissioners regarding the poten- tial location of lines adjacent to Carr. At this time it was indicated by the Landowner group that Tri-State was considering routing the Ault line on the East side of County Road 19 near Carr. In your letter you indicated that the Board supports the request of the area landowners to locate the easements along the West side of County Road 19, specifically, through Sections 21 , 28 and 33, in Township 11 North, Range 67 West. We appreciate this type of input, and in fact, have decided to re- route the line on the West side of County Road 19 in this area for the following reasons: 1 . The proposed Rawhide Power Plant may create substantial de- mand for an existing subdivision located in Section 27, Township 11 North, Range 67 West. 2. The landowners of the aforementioned subdivision may -have purchased the property specifically for residential develop- ment. 3. It is possible that no other subdivision plats in this area could be obtained from Weld County until the aforementioned subdivision has been developed. 4. The landowners effected by the re-route apparently did not object to the line being on their lands. 'AN EQUAL OPPORTUNITY EMPLOYER' 80H 8q 2.71:7 _ _ _ C.W. In a letter dated April 30 , 1979, Mr. John E. Pope stated that your company has a "respon- sibility to conduct good faith negotiations with individual landowners for rights-of-way." From information received to date, it would appear that your company may be violating the trust placed in it by this Board. It has recently come to the attention of the Board of County Commissioners that certain landowners along the above-referenced route are concerned with your company' s approach to acquisition and location of right-of-way. The Board is concerned, based upon reports received from area landowners , that your company has chosen its right-of-way location without consulting with all potentially affected landowners . Members of the Wheatland-Ault Landowners Association pre- sented a proposal to this Board recently regarding the potential location of lines adjacent to Carr. It has been reported to the Board of County Commissioners that you are considering the east side of County Road 19 in this area. The Board supports the request of area landowners to locate the easement along the west side of County Road 19 in ' dnl ti Laramie River t Transmission Line January 28 , 19 - - Page Two Sections 21, 28, and 33 in T11N, R67W and asks that you give serious consideration to landowners ' concerns in this situation. As this Board is advised by landowners of similar situations to that stated above or other matters pertaining to your easement locations in the County, we will be forwarding those concerns to you. If you have any questions relating to this matter, or if the Board of Weld County Commissioners can be of service to you, please feel free to contact me . Yours truly, C. W.
