HomeMy WebLinkAbout800640.tiff • RESOLUTION RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 54 :80: 2 FOR KENNI- COTT DUCK CLUB FOR A CLUBHOUSE ON A TRACT OF LAND LOCATED IN PART OF SECTION 34, TOWNSHIP 4 NORTH, RANGE 61 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public meeting on the 31st day of March, 1980 at the hour of 9 : 00 o'clock a.m. for the purpose of hearing the application of Kennicott Duck Club for the granting of a Condi- tional Use Permit for a Clubhouse on the following described real estated, to-wit: The Northeast Quarter of Section 34, Town- ship 4 North, Range 61 West of the 6th P .M. more particularly described as follows: Commencing at the Northeast corner of said Section 34; thence South 89°29 ' West, 2667 .42 feet to the North Quarter corner of said. Section 34 ; thence South 0°49 ' West, 2679 . 04 feet to the center of said Section 34; thence North 89°26 ' East, 2657. 64 feet to the East Quarter corner of said Section 34; thence North 0°04 ' East 2679. 60 feet to the point of beginning. WHEREAS, a representative of the petitioner was present, and WHEREAS, evidence was presented in support of the granting of the Conditional Use Permit for a Clubhouse, and WHEREAS, Section 3 . 3.D. of the Weld County Zoning Resolution authorizes such a use in an Agricultural District upon approval of a Conditional Use Permit by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those pre- sent, has studied the request of the petitioner and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been P800640 ./Z/s2 c9O/ / fully informed, is satisfied that the request for a Conditional Use Permit for a Clubhouse on the hereinabove described real estate complies with all of the conditions as set out in Section 3. 3.D. (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Ken- nicott Duck Club for a Conditional Use Permit for a Clubhouse on the hereinabove described tract of land be, and hereby is, granted subject to the following: 1. The development standards contained in the Conditional Use Permit. 2. No building or electrical permits shall be issued on the Conditional Use Permit area until the Development Standards for the Conditional Use Permit and the property owner' s signature have been placed on the , Conditional Use Permit plat and said plat has been delivered to the office of the Department of Planning Services. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the/ reasons for approval contained in the Planning Commission recommendations dated March 18 , 1980 be, and hereby are, adopted as the findings of fact of the Board of County Commissioners in this matter. Roll Call was as follows : Chuck Carlson Present Bob Ehrlich Present Fred Otis Present Bette Kountz Present Irma White Present Don Billings Present Jerry Kiefer Absent Frank Suckle Absent Also present were: Tom Honn, Zoning Administrator Bob Lowenbach, Assistant County Attorney As a quorum was present Chairman Carlson called the meeting to order and call for a motion to approve the minutes of March 4, 1980. Fred Otis made a motion to approved the minutes as submitted. His motion was seconded by Bette Kountz. A unanimous vote was cast to approve the minutes. Tape 14- Side 2 Consider and formulate a recommendation to the Board of County Commissioners on a proposal to' repeal Section 6 :5 , Special Areas Subject to Flooding, Supplementary Regulations of the Official Weld County Zoning Resolution DISCUSSION: Tom Honn stated that the current regulations were recently adopted by the Board of County Commissioners and these new regulations are promulagated as a result of the Federal Insurance Administration. Because of their adoption this section needs to be repealed. He also stated that this was an oversite that was not included in the initial action regard- ing the Floodplain regulations, but since they were not yet formally adopted, it was reasonable to keep them in until the new regulations were adopted. MOTION: Be it therefore resolved to recommend approval based on the Planning Staff' s recommendation to the Board of County Commissioners. Motion by Fred Otis,• seconded by Irma White. A vote of "aye" was cast by Don Billings; Bob Ehrlich, Fred Otis, Irma White, Bette Kountz, and Chuck Carlson. Tape 14 - Side 2 Consider and formulate a recommendation to the Board of County Commissioners on a proposal to adopt the Official Weld County Flood Hazard Overlay District Zoning Maps. These maps will be used in conjunction with the Flood Hazard Overlay District Regulations to regulate any new buildings, structures, and land uses within the floodprone areas as delineated on these maps DISCUSSION: This proposal was presented to the Planning Commission several weeks ago at their regularly scheduled meeting. This hearing is being held to primarily give the citizens of Weld County the opportunity to request any changes in the maps they felt were in error. Discussion followed regarding the boundaries of the floodplains. MOTION: Be it therefore resolved to recommend approval based on the Planning Staff ' s recommendation to the Board of County Commissioners. Motion by Fred Otis, seconded by Bob Ehrlich. A vote of "aye" was cast by Don Billings, Bob Ehrlich, Fred Otis, Irma White, Bette Kountz, and Chuck Carlson. • Planning Commission '"'.nutes Page 2 z March 18, 1980 Consider certifying for recordation the updated version of the Official Zoning Map of Weld County DISCUSSION: Tom Honn stated that this is an annual request of the Planning Commission in which the Chairman is authorized to sign the certificate which will be placed on the original copy plus the office copy and to further recommend that they adopt and certify the map so that it may be placed in the records of the Clerk and Recorder' s Office. Discussion followed. MOTION: Be it therefore resolved to recommend approval based on the Planning Staff' s recommendation to the Board of County Commissioners. The house is presently existing on the property. He stated tha they may not hunt anywhere else except where the club has permission to hunt, but have had a lot of problems with trespassers. Tom Honn then the Planning Staff ' s recommendation for approval into the record along with the Development Standards. Chairman Carlson then asked if there were any objections from anyone, in the audience regarding the request. At this time Ray Peterson and Esther Howard, both surrounding property owners, expressed their concern about trespassers on their property whil hunting who have said they were members of the club, but in fact were not. Discussion followed regarding possible ways of dealing this. It. was suggested that perhaps club members could be issued a means of identification which indicates they are members of this club and if the / could not present identification, they would be trespassers. It was also suggested by Bob Lowenbach that a provision could be made in the Development Standards which would state that the permit shall apply onl to the duck club and will expire if the property is transferred by dee etc. or if the duck club no longer operates or leases the Conditional I Use Permit area. Discussion followed. J MOTION: Be it therefore resolved to recommend approval with amendment ' to the Development Standards regarding identification of club members when hunting and that the permit shall apply only to the duck club. to the Board of County Commissioners based on the Planning Staff' s recommendation. SW4, Section 3 and Pt. NW4, Section 10, T4N, R63W LOCATION: 8 miles southeast of Kersey on the north side of U.S.' Highway 34 APPEARANCE: Mr. Harper stated their proposal is to excavate borrow materia on this site for a••construction project on U.S. 34 between Kersey and Dearfield. This site is located on 191 acres . This site will be totally reclaimed when they are finished with the project. No county roads will be involved. The area is presently dryland pasture. The Planning Staff ' s recommendation for approval was incorporated into the record and not read into the record. MOTION: Be it therefore resolved to recommend approval to the Board of County Commissioners based on the Planning Staff ' s recommendation. Motion by Bob Ehrlich, seconded by Bette Kountz. Tape 15 - Side 1 State Health Department Site Application - Town of Windsor DISCUSSION: Tom Honn stated that the State Health Department under its rules and regulations requires a site application approval for any construction to sewage: .treatment facilities. In this case the Town of Windsor is planning to modify their existing facility. The Planning Staff has reviewed the modification and determined it would not be enlarging or expanding which would require a Special Use Permit. However, because of the State process this matter does come before the Planning Commission and the Board of County Commissioners for review. The action by the Planning Commission would be to authorize the Board of County Commissioners to sign on the application either approval or disapproval of the recommendation or no comments. The Planning Staff' s recommendation is that the -Planning Commission would authorize the Chairman to make a recommendation of approval. Mr. Takata of M & I Engineering stated that they serve as the town' s engineers. They propose to enlarge the treatment capacity of the existing wastewater plant which was constructed in 1972 and is an aerated lagoon. A study was conducted which indicate that within 11 years at the present rate of growth, it would be exceeding the capacity of the plant. Aeration will be added to the existing lagoons. Estimated cost of the project will be approximately $230, 000 which will be financed by the Town of Windsor. Discussion followed. Kennicott Duck Club CUP-54 :80 :2 PLANNING STAFF RECOMMENDATION March 18, 1980 The Planning Commission recommendation for approval is conditional upon the following: 1. The attached Development Standards being recommended and approved for the Conditional Use Permit. 2. No building or electrical permits shall be issued on the Conditional Use Permit area until the Development Standards for the Conditional Use Permit and the property owners signature have been placed on the Conditional Use Permit plat and said plat has been delivered to the office 'of the Department of Planning Services. • Kennicott Duck Club DEVELOPMENT STANDARDS 1. The permitted use on the hereon described parcel shall be a clubhouse for a hunting club and all uses permitted by right under Section 3. 3B of the Weld County Zoning Resolution. Facilities shall be limited to those as shown on the Conditional Use Permit plans. • 2. Kennicott Duck Club shall exercise due care in conducting the hunting activities on the Conditional Use Permit area so as to prevent injuries and/or deaths to livestock and/or individuals who are occupying adjacent properties and assumes all liability for such injuries and/or deaths. 3. Kennicott Duck Club members shall carry some form of identification while hunting on the Conditional Use Permit area. The purpose of the identification is to distinguish non-members from members of Kennicott Duck Club. 4. The Conditional Use Permit shall not run with the land and shall apply to the Kennicott Duck Club and no other person, organization and/or association. It shall expire if Kennicott Duck Club' s interest in the property is transferred by deed, lease, or other method or if Kennicott Duck Club no longer operates or leases the Conditional Use Permit area. 5. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 6. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 7. The Conditional Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 8. The Conditional Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approvalof an amendment to the Conditional Use Permit by thePlanning Commission and Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 9. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. ' Non-compliance with any of the above stated Development Standards may be reason for revocation of the Conditional Use Permit by the Board of County Commissioners. A • COMMENTS: Our office has received 3 letters from adjacent property owners who are concerned with the possibility of club members trespassing on their property and that neither livestock nor persons on adjacent properties be placed in any physical danger by the activities conducted by the applicant on the Conditional Use Permit area. This concern has been addressed in Development Standard #2 to the extent that the staff feels it can be dealt with. • • CERTIFICATION OF COPY I Shirley A. At that time a small ranch building near the lake was built which had its own septic and water supply. Essentially this club had about 18 members and was- used- on Saturdays, Sundays and Wednesdays, during the hunting season. The rest of the time the lake was used in the latter years for recreationsl purposes; i.e. , boating and fishing, again with a limited membership. A strict log was kept all this time on the number of ducks and geese taken during the season., and it was notedthat in the last 15years the - quality of the hunting was in a gradual decline. This fact coupled with the expense of renewing the lease on Union Reservoir, made it mandatory that another reservoir be sought, and in 1978 a move was made to the present location on the Empire Reservoir. At that time the club bought -a modular home and put up a garage for storage, drilled a water well, and - - - put in-a complete septic system, all. of -which met the codes and regulations of that immediate area. A general contractor supervised the building of the new clubhouse. The maximum use of the club since locating on Empire Reservoir has been no more that 4 people per weekend, again with hunting only on Saturdays and - Sundays-, and an occasional Wednesday:- The quality of the hunting has again been deteriorating and in the hunting season 1979-80 the useage of the club was. down to 15 people,over the three and a half month hunting season. At present there are no future plans to expand the use of the clubhouse or • any of the facilities due to the poor quality of the hunting that we have experienced. The maximum number of people that could spend the night and use the club at any one time would be 9 individuals, but to date there has never been full occupancy. Four automobiles was the maximum at the clubhouse at any one time during the hunting season 1979-80. All trash and garbage is carried away after each hunting weekend. At present there are 30 members of the club, but unless the quality of the hunting increases this number may decrease in the immediate future. Pictures were taken. No contact was made with Mr. Kohler. Inspection was made from pontoon boat on the lake. John Holdren advised that he had been the ditch rider for less than a year for Empire Resevoir and was not sure when the lean-tos were built but felt that recent expansion had been taking place. My conversation with Mr. Holdren reveals that Bijou Irrigation Company is filing the compliant for a boat club in the agricultural zone without the proper permits because Mr. Kohler refuses to pay fees to Bijou Irrigation Company for the usage of the lake for the boats. Violation notices were not issued as I had not obtained proof as to when the expansion of a nonconforming use occurred and further it appeared that there was a private feud involved between two property owners. John Holdren advised me that his attorney would be getting in touch with me (Ed Zorn, attorney for Bijou) and that Lee Thompson of Wiggins who is a property owner adjacent to the boat club area, would also submit his complaints about the boat club dumping raw sewage under his cattle guards as they cross his land. Explanation of the CUP process was briefly explained to Mr. Holdren and I advised him I would follow up on it and issue a violation notice if my research proved a violation existed. Letter will be written to Kohler regarding the same. Included in this unit are some soils with lime above 40 inches. Also included in mapping were some soils with sandstone between 40 and 60 inches.' Typically the surface layer is brown sand about 6 inches thick. The underlying material, to a depth of 60 inches is brown sand. Permeability is rapid:- Available water capacity is moderate. Effect- ive rooting depth is 60 inches or more. Surface runoff is slow and erosion hazard is low. ( The potential vegetation on this soil is dominated by sand bluestem, sand reedgrass, switchgrass, sideoats grama, needle and thread, little bluestem and blue grama. Potential production ranges from 2500 pounds per acre in favorable years to 1800 pounds per acre in unfavorable years. When range, condition-deteriorates, sand bluestem, switchgrass, sand reed- grass, sideoats grama and little bluestem decrease and production drops. 'Sand sage increases, undesirable weeds and annual plants invade and "blow- out" conditions can occur as range condition becomes poorer. Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Seeding is advisable if range is in poor condition. Sand bluestem, sand reedgrass, Indian- grass, switchgrass, sideoats grama, little bluestem and blue grama are Csuitable for seeding. Due to the wind erosion susceptibility of this soil seeding should be done with an interseeder or in a firm, clean 0 sorghum stubble-prepared the growing season prior to seeding with a grass drill. Early spring seeding has proven most successful. Brush management can also help improve deteriorated range. Windbreak and environmental plantings are generally not suited to this soil. On-site investigation is needed to determine if plantings are feasible. Wildlife is an important secondary use for this soil. Rangeland wild- life, exemplified by the pronghorn antelope, can be assisted and en- couraged by development of livestock watering facilities, proper live- stock grazing management and range reseeding where needed. This Valent soil has a fair potential for urban development. The primary limiting soil features are the rapid permeability and susceptibility to wind erosion.' Septic tank absorption fields will function properly, however, the proper filtering effect may not be achieved by the sandy substratum. Sewage lagoons would require sealing. Lawns, shrubs and trees, for beautification, when once established will do well.
