HomeMy WebLinkAbout20012606 HEARING CERTIFICATION DOCKET NO. 2001-60 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1340 FOR AN AGRICULTURAL SERVICE ESTABLISHMENT AND LIVESTOCK CONFINEMENT OPERATION (EXPANSION OF HORIZON-VUE DAIRY TO 2,000 HEAD) IN THE A(AGRICULTURAL)ZONE DISTRICT-RAYMOND AND DEBRA CARPIO/LUPE CARPIO A public hearing was conducted on September 12,2001, at 10:00 a.m.,with the following present: Commissioner M. J. Geile, Chair Commissioner Glenn Vaad, Pro-Tem Commissioner William Jerke Commissioner David Long Commissioner Robert Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Lauren Light Health Department representative, Trevor Jiricek Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated August 24, 2001, and duly published August 29, 2001, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request of Raymond and Debra Carpio/Lupe Carpio for a Site Specific Development Plan and Use by Special Review Permit#1340 for an Agricultural Service Establishment and Livestock Confinement Operation(expansion of Horizon-Vue Dairy to 2,000 head)in the A(Agricultural)Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Lauren Light, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Light gave a brief description of the location of the site, which is 70 acres. She reviewed the current improvements, and stated some of the outbuildings will be removed. Ms. Light stated the new construction will include a milk barn, additional cattle and calf pens, and holding ponds. She gave a brief description of the surrounding uses, and stated six referral agencies indicated no comments, five responded with comments or conditions which have been addressed by the Conditions of Approval or Development Standards, and three referral agencies did not respond. Ms. Light stated this dairy has existed for approximately 30 years, and due to the lay of the land, no prime farmground will be taken out of production under this proposal. She further stated the site is not located within any Overlay Districts or Urban Growth Boundaries of any municipalities. In response to Commissioner Vaad, Ms. Light stated the area to the north where improvements are proposed is currently vacant ground, and the dairy will be contained by the ditch and Weld County Road 57. JO °z //L ALt) 2001 PL1546 6 , HEARING CERTIFICATION - RAYMOND AND DEBRA CARPIO/LUPE CARPIO (USR#1340) PAGE 2 Responding to Chair Geile, Trevor Jiricek, Weld County Department of Public Health and Environment, stated there is an existing lagoon, and any stockpiling or composting will be addressed in the Waste Management Plan,which still needs to be reviewed. He further stated the applicant is required to comply with the State Engineer's Office regarding water supply. Ms. Light added the North Weld County Water District has indicated it can serve the dairy's needs. Don Carroll, Department of Public Works, stated Weld County Road 57 is designated as a local gravel road,which Weld County maintains. He stated the most recent traffic count was taken in 1998 and showed 152 vehicles per day. Mr. Carroll stated the dairy has existed for some time and the existing accesses are related to the dairy operations. Responding to Commissioner Vaad, Mr. Carroll stated the road is level with the property and there has been some runoff into the borrow ditches on certain occasions. He explained the site slopes from the ditch toward the County road; however, the applicant is proposing a berm to divert the runoff from pens into the new storage lagoons, which will address his concerns. Thomas Haren, AgPro Environmental Services, LLC, represented the applicant and stated Raymond and Lupe Carpio own the 70 acres where the dairy is located, as well as 250 acres of farmland across the road. He stated the 250 acres were not included in the application materials; however, the applicant does have a sufficient amount of land to handle and manage the manure and waste water. He explained under this application, the operation will be converting from an Animal Feeding Operation which has minimal regulations,to a fully regulated facility. Responding to Commissioner Vaad, Mr. Haren stated the feed alleys will have a gravel surface for the trucks, and the feed bunks will be concrete slabs. In response to Commissioner Jerke, Mr. Haren stated the North Weld County Water District currently provides water to the site. He further stated the referral from the State Engineer's Office just wants to ensure that if there are old wells being used, they need to be permitted for a commercial operation. He stated the North Weld County Water District has indicated there is water available at$1.48 per gallon, and the site does not have a well. Mr. Haren stated the applicant is willing to have an additional condition requiring proof of an adequate water supply prior to recording the plat. He stated the Greeley No. 2 Ditch flows from the southwest to the northeast and is elevated considerably above grade. He further stated the ditch provides a nice visual buffer for the houses located southwest of the dairy. Chair Geile suggested adding a new Condition of Approval #2.H requiring an adequate water supply prior to recording the plat and renumbering the following items. Mr. Haren agreed and stated the applicant will have to have water in order to operate a decent dairy. He further stated the manure and waste water will be land applied on the remaining farmland owned by the applicant, or stored and delivered to neighboring farms. Mr. Haren stated the storage area will have ditches to ensure any runoff will flow to the holding ponds. He explained the nuisance conditions are addressed in the permit to provide mitigation measure; however,this is a relatively small proposal and the applicant intends to grow into this facility. Responding to Commissioner Jerke, Mr. Haren stated they can use manure windrows, which make it easier to spray for dust and flies, and added the manure will be removed from the site annually. Raymond Carpio, applicant, stated they use corn silage for feed, which a nearby farmer brings as needed. Mr. Carpio clarified they do not store the silage at the dairy site, and they will not have a problem removing the excess manure based on the demand of the surrounding farms. 2001-2606 PL1546 HEARING CERTIFICATION - RAYMOND AND DEBRA CARPIO/LUPE CARPIO (USR#1340) PAGE 3 No public testimony was offered concerning this matter. Ms. Light informed the Board that the neighbors to the west did indicate some concern regarding the location of the stockpile area. Mr. Morrison stated the State Engineer's Office comments may be sufficient to address the concerns of the Board regarding water and are required to be addressed under the Conditions of Approval. In response to Chair Geile, Mr. Haren stated he and the applicant have reviewed and agree with the Conditions of Approval and Development Standards. Commissioner Vaad moved to approve the request of Raymond and Debra Carpio/Lupe Carpio for a Site Specific Development Plan and Use by Special Review Permit#1340 for an Agricultural Service Establishment and Livestock Confinement Operation (expansion of Horizon-Vue Dairy to 2,000 head)in the A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Long, and it carried unanimously. There being no further discussion, the hearing was completed at 10:30 a.m. This Certification was approved on the 17th day of September 2001.
