The Weld County Public Works Department has reviewed this proposal. This project falls under the purview of
the Weld County Use by Special Review (open mining) Standards. Our comments and requirements are as
follows:
COMMENTS:
WCRs 22.5 and 25 are both designated on the Transportation Map as local gravel roads, which require a 60-foot
right-of-way at full build out. There are presently 60 feet of right-of way. These roads are maintained by Weld
County. Pursuant to the set back in the Weld County Ordinance (Ordinance 89, as amended) the required set
back is measured from the future right-of-way line.
The Weld County Public has no traffic count information data on either of these two roads.
On the west end of the property, there is a residential/agricultural access to the historical barn and out buildings.
Half way through the property, there is an existing access to the other residential structure. (Eastern Access)
REQUIREMENTS:
Eastern Access: The residential/agricultural eastern access needs additional gravel and shall be graded and
drained to provide an all-weather access.
Utilize the existing agricultural, oil and gas, and ditch roads as needed for the agricultural operation. No additional
accesses shall be granted.
Pursuant to Ordinance 169A, if noxious weeds existing on the property or become establishe4d as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds.
The Weld County Public Works Department recommends approval of this USR.

COLORADO CASE: USR-1297 NAME: Windell, Bradley & Heidi
Environmental Health Services has reviewed this proposal for multi-family dwellings for persons
customarily employed at or engaged in farming. Our Department recommends approval. The
following conditions are recommended to be part of any approval:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100, C.R.S., as amended) shall be stored and removed for final disposal in a
manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site.
3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
4. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
5. The existing homes shall use the existing septic systems.
6. All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and
handled in a safe manner. Reference 25-8-205.5 Colorado Water Quality Control Act and
Rules and Regulations thereof.
7. The existing homes shall utilize the existing private wells.
