Approved with Conditions
The Weld County Department of Planning Services has determined through administrative review that the
standards of Section 24-8-40.6.1 through 24-8-40.B.6 of the Weld County Code have been met. This
Recorded Exemption is approved with the following conditions in accordance with information submitted in
the application and the policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. The applicant has proposed a well as the source of adequate water for Lot A. Property owners are
advised that the quality of water available for usage may be limited to specific uses, i.e.,"Domestic Use
Only," etc. Because each situation is unique, the Department of Planning Services encourages
property owners to contact the Office of the State Engineer, Division of Water Resources (1313
Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581), to discuss each

3. Prior to recording the plat:
A.1 Due to the flood plain and oil and gas structures on Lot A, the applicant shall submit a
proposed building envelope to the Department of Planning Services for review. Upon
approval by the Department of Planning Services, the building envelope shall be delineated
on the plat. All building envelopes shall take into consideration setbacks from oil/gas
structures as required by Section 23-6-10 of the Weld County Code.
B. The plat shall be titled: Recorded Exemption No. 1469-23-3 RE-3186.
In accordance with Chapter 8, Article II of the Weld County Code, Lot A shall be granted one
residential/agricultural access. Direct access from a public road shall be limited to one access
per legal parcel for residential use, no circle drives or additional accesses shall be granted.The
road shall be graded and drained to provide all weather access. Accesses shall be placed in
such a location as to have adequate sight distance in both directions,shall not be placed below
the crest of a hill or where physical obstructions are present.
,D. Lot B shall use the existing residential/agricultural/ oil and gas/ ditch road access points
necessary for agricultural operations as no additional accesses shall be granted.
-- .\E. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe(CMP)is Weld
County's minimum size. If the applicant chooses to place a larger culvert please contact the
Weld County Department of Public Works to adequately size the culvert.
\)F. Weld County Road 21 is designated on the Weld County Transportation Plan Map as a local
paved road,which requires 60 feet of right-of-way at full build out.There is presently 60 feet of
right-of-way. A total of 30 feet from the centerline of Weld County Road 21 shall be delineated
right-of-way on the plat. This road is maintained by Weld County.
w G. All vehicles located on the property must be operational with current license plates, or be
)i screened from all adjacent properties and public rights of way,or be removed from the property.
All other items considered to be part of a noncommercial junkyard, semi trailers, must also be
y\ removed from the property or screened from adjacent properties and public rights-of-way. The
applicant shall schedule an on-site inspection with Weld County Code Compliance to verify the
property is in compliance with the Weld County Code. Written evidence shall be submitted to
the Department of Planning Services, by the applicant, documenting the property is in

a,) H. The applicant shall provide the Weld County Department of Planning Services with a certificate
from the Weld County Treasurer showing no delinquent taxes exist for the original parcel.
The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed
within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead.
Any construction within a 200-foot radius of any tank battery or 150-foot radius of any
wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld
County Code.
_2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
V3) All construction or improvements occurring in the flood plain as delineated on Federal
Emergency Management Agency FIRM Community Panel Map 080266 0980 C dated
September 28, 1982, shall comply with the Flood Hazard Overlay District requirements
of Chapter 23, Article V, Division 3 of the Weld County Code.
4) The installation of any septic system within the 100-year flood plain shall comply with the
Weld County I.S.D.S.flood plain policy.In accordance with the State of Colorado I.S.D.S.
Regulations, no septic system shall be installed with in the floodway.
�5) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Recorded Exemption number.
-46) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that Lot A has an adequate water supply of sufficient
quality, quantity and dependability.
�7) Potential purchasers should be aware that Lot A may not be eligible for a domestic well
permit which allows for outside irrigation and/or the watering of stock animals. The
State Division of Water Resources issues all well permits.
8) Potential purchasers should be aware that groundwater may not meet all drinking water
standards as defined by the Colorado Department of Public Health and Environment.
The Weld County Department of Public Health and Environment strongly encourages
well users to test their drinking water prior to consumption and periodically there after.
v9) Prior to the release of building permits for any structure exceeding 3,600 square feet,the
applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code.
X10) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
�311) Prior to the release of building permits on Lot A, the Lot owner shall verify with the
nearest Town/City or Sanitation District to determine the location of the nearest sanitary
sewer line. In accordance with the Weld County Code, if a sewer line exists within four
hundred (400) feet of the property line and the sewer provider is willing to serve the
proposed structure, a septic permit cannot be granted by the Weld County Department
of Public Health and Environment. Evidence of such shall be submitted in writing to the
Weld County Department of Planning Services.

��12) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with longstanding
agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area:
open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Without neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens,field work, harvest, and gravel roads;odor from animal confinement,silage,and
manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and
fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs
cannot simply be moved out of the way of residential development without threatening
the efficient delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102,C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and county roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not
provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after
a major snowstorm. Snow removal for roads within subdivisions are of the lowest
priority for public works or may be the private responsibility of the homeowners.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of
the farmer's livelihood. Parents are responsible for their children.
4. The applicant shall submit a Mylar plat and a paper copy of the Mylar plat to the Weld County
Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder.
The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County
Code. The plat shall be submitted within sixty(60)days from the date of approval by the Weld County
Department of Planning Services. The applicant shall be responsible for paying the recording fee.
5. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to
meet any one of these conditions within 60 days of approval, then this case will be forwarded to the
Weld County Board of County Commissioners with a staff recommendation for denial.

Dear planners,
I currently own 39+/-acres at my present address and wish to divide it into two lots. One will be my present home
and barns and storage buildings (lot A) which will be 29 acres or more. The new lot (lot B)will be 10 acres or less,
and will be the location for a'new home' . My father is up in age and rather ill,and he may occupy the new lot and
the new home, if he does not get any better physically.
Questionairre:
1. a)Domestic Water use I currently have a well on my property for my current home. The Water District does not
come out to our area and is not available. For the new lot and new home, we shall have a well installed also, once
the decision is made to build the new house.
b)Irrigation Water involves the New Brantner Extension Ditch company(see attached)where I own 1/2 share of this
Ditch company water. This provides enough acre/feet of water to give us alfalfa/hay crops for our cattle/horses,
when needed. There is also a Stream that cuts across the Northeastern edge of the property, called Dry Stream
Ditch....which has runoff/gray water in it occasionally.
2. The current house uses a 'septic system' from the old days when the house was first built. It involves pipes from
the house carrying sewer to leach/sand field away from the house(current home)...to where trees are planted. The
new house will apply for a normal Septic system to be built when the house is built.
3. Currently, there is about 25 acres of Alfalfa/Hay crop and 7 acres or more in pastures for horses. . I have my house
on the property( 3 BR home),Hay barn(50x 50), Shed(45 x 27) , Workshop (40'x 27'), lean to shed( 19 x 40) and
3 sided shed(30'x 20'), several irrigation ditches on southern edge and western edges of the property, plus the
"Dry Creek"stream/ditch on Northeastern sector of the land. There is a'grasshopper'/oil rig, plus two storagetanks
and a burnoff apparatus(oil/gas)on the northeastern section of the property. Off and on, I have had 4 horses and
as many as 10 cattle on the property.
4. The proposed smaller lot(lot B)may be used for another residential building lot....possibly for my elderly father. I
do foresee that a new home will be built on this lot in the future. My larger lot(lot A)will be used for my house that is
currently on the property and my outbuildings(Barn, Workshop, Storage buildings)where I do some farming and
ranching along with several varied hobbies/collections .
5. I have no specific use for the lot B (smaller lot)where the new home will be built....except to let my horses graze and
to grow some alfalfa/hay occasionally. This lot will be no more than 10 acres and possibly small as 7 acres., so my
father may decide to grow some hay,etc., once a home is built on that lot. The location of the smaller lot will be(B)
will be facing WCR 21 at the western side of the lot,and facing Farmland(neighbors 110 acres)at the eastern side of
the lot....facing more farmland on the northern edge(mostly divided by the Dry Creek Ditch)and facing Lot A...the
larger lot where my home is located._.on the southern side. The larger lot(A)will be facing WCR 21 on the Western
side and then farmland on the Southern and Eastern sides....with the smaller lot(B)on the northern side.. See map for
drawing of this location of the two lots.
6.The unique characteristics, aside from my Ranch home and outbuildings, located on southern side of the property,
are pastures and oil/gas Pump(Grasshopper)and facility(Bumoff tank)and storage tanks(oil/gas) with O&G road
going to/from the facility----located in North/Central sector of the total acreage.
7.To the best of my knowledge, the present structures do meet minimum setbacks and offset needs for Ag Zone District.
Any new structures will also meet those standards.
8.I am not desiring to place a conservation casement on my property.
9. Later,a building envelope may be designated on the smaller parcel B,when we decide to build a home for my father or
someone else in the future. There is no immediate building envelope.
10.This proposal is consistent with the Weld County Comprehensive Plan, as far as I can understand it, as I have a total
of 39+/-(40 ac)acres that I own and wish to separate them into 2 lots----10+/-ac and 29+/-acres. I have checked with
Brighton and Ft. Lupton and was told that my land is not in their long range plans.
11.The proposed usage will be compatible with existing surrounding land uses as it is primarily AG'land with ranching,
farming usage to be done on both parcels A and B. Both will eventually have a home and outbuildings for farm use.
12.As I understand it,this proposal is consistent with the intent of the district it is located within, as expressed in the
Weld county Zoning Ordinance...as amended and the Weld county comprehensive Plan. It is agricultural and will be
remaining same, as both parcels will have irrigaion water,pastures and large Dry Creek Ditch meandering between both
properties. My neighbors know of my intent and have expressed no negative opinions towards this request.
13.Yes. I do believe that this proposal is consistent with efficient and orderly development of my land...as it is defined in
the Weld county Subdivision Ordinance,section 1:3 as I am only asking for a smaller part of my land where my Dad
may build a home. I am not requesting subdivision for this 39+/-acreage that I own. I have lived and worked in this
area(Weld County)for nearly 4 decades and love this land. Thanks for all of your assistance

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
Weld County Recorded Exemption Standards. Our comments and requirements are as follows:
COMMENTS:
WCR 21 is designated on the Transportation Plan Map as a local paved road, which requires a 60-foot right-
of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the
required setback is measured from the future right-of-way line.
WCR 8 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-of-
way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the
required setback is measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present. (Lot A)
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately
size your culvert. (Lot A)
Direct access from a public road shall be limited; only one access is allowed per legal residential parcel. No
circle drives will be allowed. In accordance with Chapter 8, Article II of the Weld County Code, this policy shall
apply to all new and existing accesses within the unincorporated areas of Weld County. Properties within
municipalities or other counties that access Weld County roads are also subject to this policy. (Lot A)
The applicant shall utilize the existing residential access to this parcel, and no additional accesses shall be
granted. (Lot B)
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.
(Lot B)
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic system
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
2. Prior to the release of building permits on lot A, the lot owners shall verify with
the nearest Town/City or Sanitation District to determine the location of the
nearest sewer line. In accordance with the Weld County Code, if a sewer line
exists within 400 feet of the property and the sewer provider is willing to serve the
proposed structure, a septic permit cannot be granted by the Weld County
Department of Public Health and Environment.
Additionally, please note the following:
1) This application is proposing a well(s) as its source of water. The applicant
should be made aware that while they may be able to obtain a well permit from
the Office of the State Engineer, Division of Water Resources, the quantity of
water available for usage may be limited to specific uses, i.e. domestic use only,
etc. Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.

In consultation with the Natural Resources Conservation Service (NRCS), we have reviewed the above
referenced case and have the following comments:
SOILS/LIMITATIONS:
Septic Systems: The Olney fine sandy loam has moderate limitations because of restricted permeability.
Shallow Excavations: The Kim loam has moderate limitations because of its potential for cutbanks to
cave in. The Olney fine sandy loam has severe limitations because of its high potential for cutbanks to
cave in.
PRIME FARMLANDS: All if the irrigated land covered by this application is considered prime
farmland. We recommend that a building envelope be designated to restrict construction to non-irrigated
land, if possible,to preserve the function of the remaining prime farmland.
SOIL EROSION POTENTIAL: All of these soils are considered highly erodible and should be
protected from erosion. Construction should be planned so as to disturb as little soil as possible and
measures should be taken to prevent soil movement offsite. Any areas that are disturbed should be
stabilized with perennial vegetation, gravel or pavement once construction is complete.
OTHER: The applicant should contact Ron Broda, Vegetation Weed Management Specialist with the
Weld County Public Works Department at(970) 356-4000 X 3770 to develop a weed management plan.
