RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST MOLLY ELLIOTT FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Molly Elliott, VI #0000188, is allegedly in violation of the Weld County Code,
and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of April, 2001, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Michael Quinn, representative for Molly Elliott, was present at said hearing,
and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until August 10, 2001, to allow adequate time for the property owner
to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0000188 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Molly Elliott to remedy the violation of the Weld County
Code, and any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until August 10, 2001, to allow adequate time
for the property owner to bring the subject property into compliance by obtaining a Use By
Special Review Permit.

Currently, there is a violation of Chapter 23, Article II1 (3) , Division 1,
Sections 23-3-20, 23-3-30, 23-3-40 and 23-3-40.D of the Weld County Code. To
bring the property into compliance a "Use by Special Review" permit shall be
obtained, approved and a plat recorded; otherwise the commercial business shall
cease to operate.
The Department of Planning also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert
with the identified parties.

going to go ahead and schedule this case before the
Board of County Commissioners for a Violation Hearing
on April 10, 2001 @ 10:00 a.m. in the Centennial
Center downtown. I told him that if he had the
application to us by the 6th of April, the case would
not have to go before the board.

a visual inspection of the property, the following
items were noted: semi truck and numerous commercial
business equipment (fork lifts, snow plows, ect...)I
spoke to a Mr. Quinn(Business owner),he stated they
would be in next week to pickup a USR application. I
gave him my card and the hours for our office. The
property is kept very clean and picked up; however,
the equipment does pose a problem without a USR
permit. Please see pictures dated 06/08/00.

met Mr. Quinn and Ms. Elliott on site. They have
moved much of the equipment behind a row of trees.
You have to look pretty closely to see the items in
violation. The requested 30-60 days to bring in their
"USR" application. (They wanted to get through the
holidays) They have been in constant contact, this
extension is granted. No pictures taken at this time.

It is the intention of this office to assist and cooperate with you without imposing undue hardships;however,we
have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from , August 15,
2000, to correct this zoning violation. Failure to do so will result in this office scheduling the violation before
the Board of County Commissioners to consider whether to refer the violation to the County Attorney's Office
for legal action.

Dear Ms. Elliott:
It has come to the attention of the Department of Planning Services' staff that the uses on your property may not
be in compliance with the Weld County Zoning Ordinance. The potential noncompliance with the Zoning
Ordinance is Noncompliance with an existing Use by Special Review otherwise known as a "USR". As we
discussed on the telephone, the USR that you are operating under is for a "Child Care Facility". Your current use
of a Commercial/Business site (because semi's, forklifts, dump trucks, trailers, ect...are located on the property)
does not fall under the USR-836, the child care facility mentioned above. Therefore, as we discussed to bring
your property into compliance, you will need to come in to our office and speak to a Planner On-Call (Mon-Thurs
07:30-4:00 and Friday 12:00-4:00). Please make arrangements as soon as possible so that future proceedings
can be avoided.
Please call me within five working days of the date of this letter to review these concerns with me or a thirty-day
violation notice will be issued.
