Raised islands shall be placed at the appropriate locations to mitigate this concern. G. A typical cross section delineating the depth of base or asphalt or full depth asphalt to accommodate the proposed use. Refer to Weld County Code Section 24-7-20.C and Section 24-7-20.D,Geometric Design Standards and Road Structure to properly design the cross section for the access drives and parking area. Further, this cross section shall be designed to support the imposed loads of fire apparatus as stated in the Mountain View Fire Protection District referral dated April 19, 2001. .Al': The additional fire hydrants required as requested by the Mountain View Fire Protection District as stated in their referral dated April 19, 2001. 2. The following requirements shall be addressed prior to recording the Site Plan Review Plat: A. If applicable, the applicant shall submit an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application to the Air Pollution Control Division, Colorado Department of Public Health and Environment. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional EPOCS Manufacturing,page 2 Engineer according to the Weld County Individual Sewage Disposal Regulations. Evidence of approval shall be submitted to the Department of Planning Services. C. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. Evidence of approval by the Weld County Department of Public Health and Environment shall be submitted to the Department of Planning Services. The Plan shall include at a minimum the following: 1. A list of wastes which are expected to be generated on site, including the expected volumes and types of wastes generated. 2. A list of the type and volume of chemicals expected to be stored on site. 3. The Waste Handler and facility where the waste will be disposed, including the facility name, address and telephone number. (Department of Public Health and Environment) D. The applicant shall enter into an Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for parking and landscaping requirements. The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the plat. (Department of Planning) 3. The following notes shall be placed on the plat: -A. In accordance with the Weld County Code, no land, building or structure shall be changed in use or type of occupancy, developed, erected, constructed, reconstructed, moved or structurally altered or operated in the commercial or industrial zone districts until a Site Plan Review has been approved by the Department of Planning Services. Landscape Plan, Sheet L-1 ❑ Staff is concerned with plant material selection for the above grade storage tank. Juniperus sabina var. 'Buffalo', Buffalo Juniper, is a low growing prostrate plant that under ideal conditions at maturity will have a height of 12-18 inches and a spread of 6-8 feet, thus providing no screening potential. Given this concern, staff directs the applicant to propose an alternative plant and or opaque screen with plant materials to mitigate this concern and meet the landscape and screening requirements. ❑ Landscape Legend, Sheet L-1 All trees shall be staked and awed, please note this in all instances. It is our experience that the Syringa meyeri dies back in the winter providing no screening potential. Given this concern, staff directs applicant to propose alternative plant and or opaque screen with plant materials to mitigate this concern and meet the landscape and screening requirements. The Department of Planning Services has reviewed the preliminary cost estimates for landscape treatment. Staff has determined the submitted estimates are adequate with the following caveats. Staff has the following comments: The drip line for trees and shrubs will be placed at the perimeter of the property to provide positive irrigation for all plants. Should this be correct, the cost estimate may be low. Please provide written comment on this issue. The fencing requirements addressed in Exhibit A are not addressed in Exhibit B. Please provide an estimated time frame for completion. A general question. Will landscape fabric be placed in all of the planting beds to control noxious weeds. If yes, please add to Exhibit A and B as required. Twenty-five wheel stops are delineated on Sheet A-1. COLORADO FROM: Kim Ogle, Planner II S S SUBJECT: Meeting Notes of May 16, 2001 - 1:00 pm Department of Planning Services ACTION A meeting was requested by Jerry Boos, Contractor for Bruce Miller of EPOCS, and applicant of the above referenced project. In attendance were: Bruce Miller, EPOCS Jerry Boos, Contractor Char Davis, DPH&E Phillip Brewer, DPH&E, part-time Dennis Renley, DBI Jeff Harley, DBI Kim Ogle, DPS Discussion commenced regarding referral requirements from DPH&E. Davis asked for clarification and background on what this facility is manufacturing including the manufacturing processes, specific to environmental wastes Miller provided a memorandum, sent via facsimile on May 15, 2001 at 4:52 p.m. that addressed many of the concerns of DPH&E. Davis stated she was not in receipt of said memorandum. Miller submitted copies for review. Discussion addressed issues specific to referral dated April 19, 2001. Item 1 -APEN permit requirements Davis to follow-up Item 2 - Septic System Permit on File Item 3 -Waste Handler Davis to follow-up Davis to address all internal issues with Director of DPH&E and contact Miller with concerns or additional requirements if any. Davis to follow-up with memorandum stating findings and additional requirements if any. Davis to follow-up Davis to contact Miller for a site visit and review of existing facility in Longmont. Ogle stated that screening and perhaps landscaping will be required. Ogle further stated that a double walled tank would not require berming to contain effluent, Landscaping still required. Miller to follow-up Ogle addressed Administrative Review comments by line item It was agreed that parking could be reduced by 3 stalls. Total parking requirement will be 67 spaces of which 1 will be van accessible and one will meet ADA standards and requirements. Ogle discussed curb returns at new road to parking lot interface. Boos stated curb returns not practical due to snow removal. Ogle stated at a minimum wheel stops could be utilized, however a curb return would be preferred. Miller/Boos to follow- up Ogle discussed additional landscape treatment consisting of evergreen and deciduous tree planting, south side of building to break up the blank building elevation and wall treatment. Additional plant material to be added to area by trash receptacle and above ground tank as previously discussed. Ogle asked for a check print, a paper copy of a blueline, to address all on-site requirements. When approved by staff, i.e., Davis, Ogle, staff will accept mylar for recording with modifications as required by review Boos to provide The applicant was provided an Improvements Agreement to cover on site improvements. Collateral was tendered in the form of two separate Deed of Trust documents on July 30, 1997. On-site improvements was covered via a Deed of Trust for Lot 8, Block 1 in the amount of$768,000.00 dollars. Collateral for off-site improvements was covered via a Deed of Trust for Lots 4 and 5, Block 1 in the amount of$176,000.00 dollars. (BCC#971689) On February 28, 2000, the Board of County Commissioners executed the release of Deed of Trust for Lots 4 and 5, Block 1 in the amount of $176,000.00 dollars for collateral for off-site improvements. (BCC#20000264) Referring to staff Exhibit 1, a partial photocopy of the Drainage and Erosion Control Map prepared by Landmark Engineering, Ltd.,engineers of record for this development dated 1997 clearly delineates on site slopes running southwest to northeast. Referring to staff Exhibit2,a partial photocopy of the Amended Final Replat of the Rademacher 1-25 Business Park delineates a twenty (20) foot drainage and utility easement adjacent to the south property line of Lot 9, Block 1 (north property line for Lot 10, Block 1). Further, there is a second twenty (20)foot drainage, landscape and utility easement adjacent to the east property line of Lot 9, Block 1, adjacent to Weld County Road 9.5. Per the overland flow documentation held by this office, all on-site drainage is directed to the existing drainage swales, specific to Lot 10, Block 1 (Home Lumber and Supply Company) of this development. The 4.29 acre lot is on the west side of Weld County Road (W.C.R.) 9.5 (with W.C.R. 9.5 lying along the N.-S. centerline of Section 23) approximately 3,200 north of Colorado State Highway 66 and one-half mile east of Interstate Highway 25 (I-25). See Exhibit #1. the base for Exhibit #1 is the U.S. Geological Survey (U.S.G.S.), Gowanda, Colorado Quadrangle map of 1949, photorevised 1979. Exhibit #2 is a final grade and drainage plan of Lot 9. The vertical control for Exhibit #2 is from a U.S.G.S. benchmark along I-25 brought to the site by others for the original business park development INITIAL CONTROL DOCUMENT Initially this overall development was known as Rademacher Business Park P.U.D. (Landmark referenced the LCSWMM into their initial work.) This study for Lot 9 follows the criteria, guidelines, assumptions, values, and procedures of the original Landmark work in order to be compatible with the overall business park drainage facilities. EXISTING CONDITIONS The general slope of the ground throughout the entire business park and that of the abutting Sekich Business Park to the south is down toward the north-northeast. Lot 9 is bounded by W.C.R. 9.5 on the east, Knights Way on the north, and Camelot Circle on the west. Lot 10 which abuts Lot 9 to the south is currently developed and was draining its surface runoff directly onto Lot 9 at the time of this study. Lot 9 lies fallow with some natural occurring vegetation on the surface. The existing on-site contours taken from Landmark Sheet 6 of 21 shows an elevation of 4968 in the S.W. corner and 4955 in the N.E. corner, giving a drop of 13 feet over a distance of 640 feet, resulting in an average N.E.-S.W. slope of 0.02 feet per foot (2%). These contours are copied onto Exhibit #2 as the existing elevations for this study. A few additional spot elevations such as on top of curbs were taken to assist in design. The Landmark Sheet 6 of 21 shows Camelot Circle paved with side ditches and Knights Way unimproved with a gravel surface on W.C.R. 9.5 with no initial side ditches. That sheet also shows an originally proposed drainage swale flowing to the north in the additional 20-foot widening of W.C.R. 9.5 right-of-way (R.0.W.) granted with this business park plat. At the time of this study Camelot circle and Knights Way were found paved with curb and gutter, the drainage swale along the west side of W.C.R. 9.5 not defined, and a 24" reinforced concrete pipe (R.C.P.) culvert with flared end sections under Knights Way on the west side of W.C.R. 9.5 with no ditch or swale leading up to or away from the culvert. From a visual observation along Camelot Circle it appears a high percentage of the existing development to the south and west of Lot 9 does not follow the original master drainage plan. PROPOSED SITE DEVELOPMENT A 155' x 200' building is to be situated 100' east of the lot westline and the northeast corner of the building 65' south of the northline. At the south end of the building E.-W. driveways will intersect Camelot Circle on the west and W.C.R. 9.5 on the east. These two entrances will not be connected. Mr. Jerry Boos Page 3 of 5 EPOCS Manufacturing Drainage January 22, 2001 Two N.-S. driveways are proposed on the north, one on each side of the building. These two driveways each connect to an E.-W. drive (above) through parking areas. The building might be extended to the south at some future date. Landscape berms are proposed on the three sides of the lot with street frontage. Drainage swales are to be behind the berms flowing around the building from the southwest corner of the lot to the east and to the north to a detention basin at the lot's northeast corner. A culvert will carry runoff flows under the east drive. A storm sewer will carry runoff flows under the north drives and around the septic area. In the event of plugged pipes or excessive runoff the waters can flow over the southeast drive to the detention basin and waters can flow over the northwest drive but some of such waters may be diverted off-site at the northeast drive. See Exhibit 2. The elevations of the driveways at the center of the berms are set one foot above the adjacent gutter flowlines, or, at W.C.R. 9.5, one foot above the adjacent edge of the existing gravel. This is done to protect the site from major runoff along the street. PROPOSED CONDITIONS: VALUES AND QUANTITIES For this work it is assumed all overland drainage from Lot 10 will be diverted from Lot 9. For the Rational Method calculations a runoff coefficient "C" of 0.90 was used for pavement and roof and 0.20 for lawns. For this site the resultant composite "C" is 0.48. For comparison Landmark used 0.20 for historic calculations and a composite "C" of 0.75 for developed lots. Landmark developed a two-year historic release rate from each lot of 0.238 cubic feet per second (c.f.s.) per acre for the area to the south of the park draining north to the Baugh Lateral. For this 4.29 acre lot that results in a maximum release rate of 1.0 c.f.s.. The minimum storage volume of the detention basin as determined by the Modified Rational Method of the Landmark report, using the "C" of 0.48, is 0.385 acre feet. This peak occurred at 50 minutes after the start of the rainfall event. The 100-year runoff event was used for all on-site calculations. • The detention basin outlet is through an orifice plate set in a 12" pipe in a headwall draining east to W.C.R. 9.5 as well as an emergency spillway draining north to Knight Way. Mr. Jerry Boos Page 4 of 5 EPOCS Manufacturing Drainage January 22, 2001 A value for the Probable Maximum Precipitation (P.M.P.) for the emergency spillway was chosen as 12.6 c.f.s. which equates to two times the 100-year developed flow at that location. With a crest elevation of 4958, using a discharge coefficient of 3, and a bottom width of 15' the broad crested weir proposed is calculated to pass 17.4 c.f.s. at 0.5 foot of depth. The elevation of 4958 is used so that the weir can discharge directly on to Knights way. To drain the site internally from the southwest to the northeast the outlet for the detention basin fell below the surrounding finished (existing) grade. The outlet structure is a 12" pipe with an invert elevation equal 4954. The control device is a circular orifice in a plate with the centerline of the orifice set at elevation 4954.5. This requires discharging into the existing culvert flowing north across Knights Way on the west side of W.C.R. 9.5. As there is no ditch or swale leading away from the outlet of that culvert and as it is on Weld County (County) Right-of-Way (R.O.W.) it is expected that the County will construct the necessary ditch (swale) north to the Baugh Lateral. The culvert under the southeast drive is proposed to be 15" diameter pipe with flared end sections. The storm sewer flowing east on the north side of the site is proposed to be 18" diameter with two manholes and a flared end section at the inlet and outlet of the sewer. An area inlet on the northeast corner of the area on the north side of the building is to be connected to the storm sewer. At the time of this study the County was preparing plans for the improvement of W.C.R. 9.5 which would include additional R.O.W. on the east side with four lanes, two of which to be part of the original construction. It is not known whether the improvements will use side ditches or curb and gutter for drainage nor when that construction will get underway. The grading plan (Exhibit 2) contains a note for this project's contractor to work with the County to determine if a culvert will be required under the southeast driveway in the R.O.W. The County has preliminary information concerning this project's plan. The proposed building on Lot 9 is situated so that an extension to the building could be made if and when desired in the future. For the purposes of this study a 100 foot extension is considered along with 100 foot extensions to the parking area (east and west) at their present proposed widths. Such a change would result in a composite runoff coefficient ("C") for Lot 9 of 0.61. With the Modified Rational Method this would require a total of 0.4856 acre feet storage. The volume of the detention basin as drawn (Exhibit 2) at elevation 4957 is 0.4423 acre feet which exceeds the 0.3852 acre feet for the presently proposed project with C = 0.48. At elevation 4958 the available storage volume is 0.7613 acre feet which exceeds the 0.4856 required for a possible future expansion (C = 0.61). Mr. Jerry Boos Page 5 of 5 EPOCS Manufacturing Drainage January 22, 2001 A 5 inch diameter orifice is planned in the outlet works as the control device. To meet the required storage volume, as shown above, the water surface elevation for the presently proposed condition (C = 0.48) would be below 4957, and, for a possible future expansion (C = 0.61) below 4958. With a discharge coefficient of 0.6 the orifice would carry 0.79 c.f.s. at water surface elevation of 4957 and 1.23 c.f.s. at 4958. As shown earlier, the desired maximum discharge from the basin (2-year historic) would be 1.0 c.f.s. COMMENTS It is my recommendation that consideration be given to shifting the building location to the east by, say, five feet. While this would add an additional length to the storm sewer it would ease the steepness of the slopes on the sides of the north flowing swale on the west of the building as well as the grade on the southwest driveway. While this would slightly reduce the capacity of the detention basin, as shown here, the basin is more than adequate for now and the future as now planned. Please note that as drawn (Exhibit 2) should there be an excsssive rainfall or the storm sewer become plugged there is the potential of there being one foot of water depth at the northwest corner of the parking lot by the storm sewer inlet. With careful) attention to detail, this can be reduced to, say, a half foot by reducing the surface slope of the asphalt paving in the parking area down to the west from the building without creating pockets (so called "bird baths"). Asphalt Parking and Driveway Section: We wish our plan to remain as originally proposed as a section of Class 6 aggregate beneath 6 inches of asphalt is typical highway paving, not private parking lot paving. We would like to show you two close by neighbors with 6 year old buildings where 6 inches of asphalt on grade is how their parking lot is constructed. The paving looks as good today as the day it was put down. 2. Wheel Stops: We wish our plan to remain as originally proposed with no wheel stops. 3. General Question-Bollards: We do not plan to place bollards at any overhead door location. In 25 years of owning and operating manufacturing businesses, I've never had a need for bollards. Our General Contractor assures us that the costs to install drip lines are both accurate and competitive based on current pricing and his experience installing such systems. Landscape fabric will not be placed in planting beds. While it would be nice to go "top shelf' with this project, we are on a strict construction budget and have to pay close attention to the dollars spent. That budget and the funding to support it have received final approval from our bank working in cooperation with the SBA. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. If applicable,the applicant shall submit an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application to the Air Pollution Control Division, Colorado Department of Public Health and Environment. 2. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. The installation of the septic system shall comply with the Weld County I.S.D.S. flood plain policy. 3. The applicant shall submit a waste handling plan, for approval,to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum,the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as"development standards": 1. All liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a"solid waste" in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. The Fire District does not object to the request to build the facility provided the requirements of the Fire District can be met. Based on my review, I have the following comments: • Buildings shall be designed and constructed in accordance with the provisions of the of the Uniform Fire Code, as ratified by the Weld County Commissioners, and all other applicable codes and ordinances, as enforced by Weld County. • The building is approximately 31,000 square feet of type II-N construction and will not be protected with an automatic fire sprinkler system. In accordance with Appendix III-A of the Uniform Fire Code, the required fire flow for the building is 3,750 gallons per minute, measured at a residual pressure of 20 pounds per square inch. This water supply must be provided by four fire hydrants. The existing fire hydrant located on the southwest corner of the property on Camelot Circle and the fire hydrant located 250 feet north of the northwest corner of the property on Camelot Circle qualifies as two of the required four fire hydrants, but two additional fire hydrants will need to be provided. A revised site plan showing proposed hydrant locations and waterlines must be submitted to the Fire District. Waterlines serving hydrants must be a minimum of 8-inches in diameter. Dead-end waterlines shall not serve more than one hydrant. • Fire apparatus access to the building appears to be adequate as indicated on the plans. Fire apparatus access roads must be designed and maintained to support the imposed loads of fire apparatus (60,000 pounds), must have a surface that provides all-weather driving capabilities and be free from obstructions which includes gates. • A final inspection of the occupancy will be required by a member of the Fire District before a Certificate of Occupancy is issued from Weld County. The surface estate may be owned separately from the underlying mineral estate, and transfer of the surface estate does not necessarily include transfer of the mineral rights. Third parties may hold interests In oil, gas, other minerals, geothermal energy or water on or under the Property, which interests may give them rights to enter and use the Property. Such matters may be excluded from the title insurance policy. Buyer is advised to timely consult legal counsel with respect to all such matters as there are strict time limits provided in this contract (e.g., Title Objection Deadline [§2c] and Off-Record Matters Objection Deadline [§2c]). 9. LEAD BASED PAINT. Unless exempt, if the improvements on the Property include one or more residential dwelling(s) for which a building permit was issued prior to January 1, 1978, this contract shall be void unless a completed Lead-Based Paint Disclosure(Sales)form is signed by Seller and the required real estate licensee(s), which must occur prior to the parties signing this contract. 10. PROPERTY DISCLOSURE AND INSPECTION. On or before Seller's Property Disclosure Deadline (§2c), Seller agrees to provide Buyer with a written disclosure of adverse matters regarding the Property completed by Seller to the best of Seller's current actual knowledge. a. •Inspection Objection Deadline. Buyer shall have the right to have inspection(s)of the physical condition of the Property and Inclusions, at Buyer's expense. Damage; Liens; Indemnity. Buyer is responsible for payment for all inspections, surveys, engineering reports or for any other work performed at Buyer's request and shall pay for any damage which occurs to the Property and Inclusions as a result of such activities. Buyer shall not permit claims or liens of any kind against the Property for inspections, surveys, engineering reports and for any other work performed on the Property at Buyer's request. Buyer agrees to indemnify, protect and hold Seller harmless from and against any liability, damage, cost or expense incurred by Seller in connection with any such inspection, claim, or lien. This indemnity includes Seller's right to recover all costs and expenses Incurred by Seller to enforce this subsection, including Seller's reasonable attorney fees. The provisions of this subsection shall survive the termination of this contract. 11. CLOSING. Delivery of deed(s)from Seller to Buyer shall be at Closing (Closing). RECOMMENDATION OF LEGAL AND TAX COUNSEL. By signing this document, Buyer and Seller acknowledge that the Selling Company or the Listing Company has advised that this document has important legal consequences and has recommended the examination of title and consultation with legal and tax or other counsel before signing this contract. 20. TIME OF ESSENCE AND REMEDIES. Time is of the essence hereof. If any note or check received as Earnest Money hereunder or any other payment due hereunder is not paid, honored or tendered when due, or if any other obligation hereunder is not performed or waived as herein provided, there shall be the following remedies: a.
