HomeMy WebLinkAbout20010686 • • RESOLUTION RE: ACTION OF BOARD CONCERNING SUBSTANTIAL CHANGE OF A RECORDED EXEMPTION - HOMEWARD CONCRETE STEPS OF ROCHESTER, INC., C/O LOUIS BLANDA WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 12th day of March, 2001, at the hour of 9:00 a.m. in the Chambers of the Board, on behalf of Homeward Concrete Steps of Rochester, Inc., c/o Louis Blanda, 4600 Weld County Road 31, Fort Lupton, Colorado 80621, for the purpose of considering whether or not there has been a substantial change in the facts and circumstances regarding the application for Recorded Exemption #2823, which was denied by the Board of County Commissioners by Resolution dated November 6, 2000, and WHEREAS, said action was taken concerning property described as: Lot B of Recorded Exemption #455, being a part of the S1/2 of the NW1/4 of Section 10, Township 1 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant was present, and WHEREAS, said hearing was conducted pursuant to the Board's policy concerning applications for land use for property previously denied, as set forth in Section 2-3-10 of the Weld County Code, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and, having been fully informed, finds that said request to apply for a Recorded Exemption shall be approved for the following reasons: 1. It is the opinion of the Board of County Commissioners that the applicant has demonstrated that a substantial change in facts and circumstances has occurred. A. The relocation of Lot A from the Northeast corner to the Northwest corner of the lot alleviates concerns regarding a flaglot configuration with associated complications regarding access. The newly proposed Lot A has direct access from Weld County Road 31. B. Lot A, as currently proposed, has been reduced in size from 4.5 acres to 2.5 acres. "The Board feels this proposal will create a flag lot,which is not consistent with Section 10.5 of the Weld County Subdivision Ordinance. " 3. Pursuant to Chapter 2, Article II § 2-3-10 of the Weld County Code, the Board of County Commissioners shall consider the applicant's request for a Hearing of Substantial Change and whether within the concept of a new application, the facts and circumstances of which are substantially changed from the initial application: A. Has the land-use application substantially changed? (e.g., substantial changes in lot size or density, in internal or external roads, or, in the case of a rezoning, in the uses proposed) The proposed relocation of Lot A from the interior of the applicant's parcel to the exterior of the proposed Recorded Exemption Application does not, in the opinion of the Department of Planning Services staff, constitute a substantial change. The Department of Planning Service advised the • applicant, both prior to and at the hearing, that Planning Services would support a Lot A located adjacent to Weld County Road 31. This previously offered recommendation is identical to the applicant's current proposed substantial change. B. Have the surrounding land-uses substantially changed ? (e.g., has the adjacent land use changed during the period of time since the last application such that what would be compatible with the adjacent use has changed) A thorough check of both pending and recently approved cases does not indicate that surrounding land uses have changed to the extent that it would affect the applicants plea.The applicant has not submitted any evidence to support a claim that surrounding land uses have changed substantially. C. Have applicable provisions of the law substantially changed? (e.g., the applicant is proposing using a different procedure so a different set of criteria apply or the applicable ordinance has been amended by the Board so the criteria have substantially changed) While the applicants request was received on or about December 15, 2000 and Weld County has since adopted the Weld County Code no substantial changes in the applicable provisions of the law have substantially changed which would affect the applicant's request. The applicant has not submitted any evidence to support a claim that applicable provisions of the law have changed. D. Within the concept of rehearing the previously denied application, is there newly discovered evidence that the applicant could not have discovered with diligent effort at the time of the original application ? The Department of Planning Services knows of no newly discovered evidence that the applicant could not have discovered with diligent effort at the time of the original application nor has the applicant submitted any evidence to support a claim that there exists newly discovered evidence. 4. The applicant has submitted a single component(the relocation of Lot A)to represent a substantial change. This proposal does not appear to constitute a substantial change, rather it demonstrates the applicant's attempt at addressing the previously stated concerns raised by Planning Services and the Board of County Commissioners regarding adequate ingress and egress to the proposed parcel as well as the creation of an island lot. Section 10.5.10 - A flag lot configuration shall be avoided when possible. The proposed Recorded Exemption would result in the creation of an island lot with access dependent on Lot A. Should the Board of County Commissioners approve this request, the Department of Planning Services' staff recommends the following conditions be attached: 1. In accordance with the Weld County Ordinance 219, for all applications, including amended applications, for recorded exemptions, subdivision exemptions associated with a recorded exemption,and site plans approved administratively on or after September 13, 2000, notice that such approval includes a determination of compliance with Article XXVIII,shall be published once,at the cost of the applicant,not more than fourteen(14) days after the approval of the application, in the newspaper designated by the Board of County Commissioners for publication of notices.The notice shall describe generally the type of application approved and the specific parcel or parcels affected and the basis for determining compliance with Article XXVIII,and shall state that any interested person who wishes to appeal such determination of compliance to the Board of County Commissioners must do so in writing within fifteen (15)days of the date of publication of the notice.No building permits shall be issued for the development until the end of such fifteen(15)day appeal period.The cost of such publication shall be paid for by the applicant. 2. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 3. Prior to recording the plat: A. In accordance with Weld County Department of Public Works Ordinance #180, Lot A shall be granted one residential access.Direct access from a public road shall be limited to one access per legal parcel for residential use, no circle drives or additional accesses shall be granted.The road shall be graded and drained to provide all weather access.Access shall be placed in such a location as to have adequate sight distance in both directions. B. Lot B shall use the existing residential/agricultural/oil and gas/ditch road access points necessary for agricultural operations as no additional accesses shall be granted. C. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved road access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe (CMP) is Weld County's minimum size. If the applicant chooses to place a larger culvert please contact the Weld County Department of Public Works to adequately size the culvert. D. Weld County Road 31 is designated on the Weld County Transportation Plan Map as a local gravel road,which requires 60 feet of right-of-way at full build out.There is presently 60 feet of right-of-way.A total of 30 feet from the centerline of Weld County Road 31 shall be delineated right-of-way on the plat. This road is maintained by Weld County. E. A 30 foot wide joint easement extending across Lot B from Weld County Road 31, for the benefit of Lots A and B, shall be shown clearly on the plat. The joint access easement shall be dedicated for the use as shown using the language set forth in Section 11.7.1.12.5 of the Weld County Subdivision Ordinance. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Zoning Ordinance,the required setback is measured from the future right-of-way line. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Prior to the release of building permits,the applicant shall submit a recorded deed describing the lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 4) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that the lot has an adequate water supply of sufficient quality, quantity and dependability. 5) Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Weld County Ordinance 169A. 6) In accordance with Section 10.5.10 of the Weld County Subdivision Ordinance, the flag lot Configuration will be avoided where possible.The minimum width of a flag lot is 30 feet. 7) RIGHT TO FARM COVENANT: Weld County is one of the most productive agricultural counties in the United States. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure;smoke from ditch burning;flies and mosquitoes;the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved "out of the way"of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Weld County covers a land area of over 4,000 square miles in size(twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days aftera major snowstorm. *O(O:9 • • Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas,in many cases,will not be equivalent to municipal services. Children are exposed to different hazards in the country than in an urban or suburban setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important,not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 3. The applicant shall submit a Mylar plat to the Weld County Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60)days from the date of approval by the Weld County Department of Planning Services. Wells, Jr. In consultation with the Natural Resources Conservation Service (NRCS) , we have reviewed the above referenced case and have the following comments . SOILS/LIMITATIONS: The soil found on the proposed lot is classified as Olney loamy sand. These are deep, well drained soils with a loamy sand surface and a sandy clay loam subsurface. This soil has moderate permeability and water holding capacity. There are severe limitations for shallow excavations but only slight limitations for basements. The soil has moderate limitations for septic tank absorption fields, due to slow percolation. PRIME FARMLANDS: This soil is not considered as `prime farmland' . SOIL EROSION POTENTIAL: Water runoff is slow but the hazard from wind erosion is high. OTHER: Due to the close proximity of the irrigation canal, an on-site investigation is highly recommended before any construction is started.
