HomeMy WebLinkAbout20010026.tiff HEARING CERTIFICATION DOCKET NO. 2001-03 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1296 FOR A RETAIL/WHOLESALE GREENHOUSE IN THE A (AGRICULTURAL) ZONE DISTRICT - FAY AND MARY SHULTZ A public hearing was conducted on January 17, 2001, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner Glenn Vaad, Pro-Tern Commissioner William H. Jerke Commissioner David E. Long Commissioner Robert D. Masden Also present: Acting Clerk to the Board, Carol Harding Assistant County Attorney, Lee Morrison Planning Department representative, Monica Mika Health Department representative, Pam Smith Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated December 20, 2000, and duly published January 3, 2001, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request of Fay and Mary Shultz for a Site Specific Development Plan and Use by Special Review Permit #1296 for a Retail/Wholesale Greenhouse in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Monica Mika, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She stated the site is approximately 7 acres; the applicants are proposing use of the existing facilities on the site; the commercial enterprise will generate approximately 120 daily users; and the applicants are proposing to build a new principal residence in the future. She stated the application does comply with the Weld County Code, it has been submitted in conjunction with Amended Recorded Exemptions#172 and #2822, and it is compatible with existing surrounding land uses. Referral requests to the Towns of Johnstown and Milliken indicated no concerns, although the site is located in the future Urban Growth Boundary area of Johnstown. Ms. Mika stated the use will be a much more intense agricultural use than is currently existing. Ms. Mika indicated existing buildings on the Plot Plan, and stated the site is located on Weld County Road 54. Ms. Mika stated a letter received from the applicant, Exhibit F, requests the current residence be allowed to either become part of the business as an office or retail area, or used for employee housing, and the applicant indicated a building envelope for the future principal residence. She stated there were no comments or concerns received from surrounding property owners. Responding to Chair Geile, Don Carroll, Department of Public Works, stated curb blocks are requested by the County whenever an open parking lot, is proposed, to act as a stop for cars near buildings or barrow pits. Mr. Carroll also indicated Weld County Road 54 is a Collector road and the right-of-way is presently 60 feet wide; therefore, Condition of Approval #4.D requires the applicant to reserve an additional 10 feet for future build out of the road. He stated the west access point is at a 45-degree angle,therefore, Public Works has requested the eastern access be utilized / /� 2001-0026 pc • pi. IF! Mr. Carroll also stated Weld County Road 54 has an Average Daily Traffic Count of 154 vehicles in a 24-hour period. Responding to Chair Geile, Pam Smith, Department of Public Health and Environment,stated Development Standards#6 and#12 do not conflict,and Mr. Morrison clarified that #6 deals with materials no longer, being disposed of and #12 deals with those materials which are still in use. Responding to Commissioners Vaad and Masden,Mr.Carroll stated there is a 4-way Stop at Weld County Road 17 and 54, and he is unaware of any additional signage being planned for Weld County Road 54. Fay Shultz,applicant, responded to Commissioner Vaad that customers can get into the site easily without disturbing traffic, although Mr. Shultz did state that reducing the speed limit would help resolve any problems that might occur. He said the entrance is 30 feet wide,and it can be widened if necessary; however, it is currently wide enough for a semi-trailer to enter. Responding to Commissioner Jerke, Mr. Shultz stated they expect approximately 25 percent of the business to be retail and 75 percent wholesale to begin with, however, they are hoping in the future to evolve to more retail as the business develops. No public testimony was offered concerning this matter. Ms. Mika recommended deletion of Conditions of Approval #3.D and #4.B, and amending the first sentence of #4.A to state, "The existing residence is proposed to be either a future retail site or an accessory residential structure." Responding to Chair Geile, Mr. Shultz stated he has no problems with the changes and is in agreement with the Conditions of Approval and Development Standards. Commissioner Vaad moved to approve the request of Fay and Mary Shultz for a Site Specific Development Plan and Use by Special Review Permit #1296 for a Retail/Wholesale Greenhouse in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record and the changes recommended above. The motion was seconded by Commissioner Masden, and it carried unanimously. This Certification was approved on the 22nd day of January 2001.
