The Weld County Department of Planning Services has determined through administrative review that the
standards of Section 24-8-40.B.1 through 24-8-40.B.6 of the Weld County Code have been met. This
Recorded Exemption is approved with the following conditions in accordance with information submitted in
the application and the policies of Weld County.

! according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. Septic
systems for Lot A and the SE-908 lot shall be installed according to permit numbers SP-0100392 and
SP-0100424.
The applicant has proposed a well as the source of adequate water for Lots A and B. Property owners
are advised that the quality of water available for usage maybe limited to specific uses,i.e.,"Domestic
Use Only," etc. Because each situation is unique, the Department of Planning Services encourages
property owners to contact the Office of the State Engineer, Division of Water Resources (1313
Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581), to discuss each

J 3. Topographic or physical features of the proposed Lot A, such as ravines, ditches, streams etc. may
limit the area available for a new or replacement septic system. Prior to recording the plat, the Weld
County Department of Public Health and Environment recommends that the applicant review the Weld
County Code pertaining to septic systems to assure that any installed septic system will comply with
all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to
allow the installation of a septic system, the lot may need to be enlarged.
1. Prior to recording the plat:
( A. \ Due to the prime agricultural soils on Lot B, the applicant shall submit a proposed building
envelope to the Department of Planning Services for review. Upon approval by the
Department of Planning Services, the building envelope shall be delineated on the plat. All
building envelopes shall take into consideration setbacks from oil/gas structures as required
by Section 23-6-10 of the Weld County Code.
B. The plat shall be titled: Recorded Exemption No. 0705 10 1 RE-3175.

l The applicant shall submit to the Weld County Department of Planning Services evidence that
/ any existing septic system meets all requirements of the Weld County Department of Public

applicant set aside an area for a septic replacement envelope on both Lots A and B.
D. In accordance with Chapter 8,Article II of the Weld County Code, Lots A and B shall be granted
one residential/agricultural access. Direct access from a public road shall be limited to one
access per legal parcel for residential use, no circle drives or additional accesses shall be
granted. The road shall be graded and drained to provide all weather access. Accesses shall
be placed in such a location as to have adequate sight distance in both directions, shall not be
placed below the crest of a hill or where physical obstructions are present and shall be a
minimum distance of 75 feet from any intersecting County or State roadway.
Lot A shall use the existing residential access point as no additional accesses shall be granted.
JF. Lot B shall use the existing agricultural/ oil and gas/ ditch road access points necessary for
agricultural operations as no additional accesses shall be granted.
JG. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe(CMP) is Weld
County's minimum size. If the applicant chooses to place a larger culvert please cfontsct the
Weld County Department of Public Works to adequately size the culvert.
Weld County Road 21 is designated on the Weld County Transportation Plan Map as a local
gravel road, which requires a 60-foot right-of-way at full build out. There is presently 60 feet of
right-of-way. A total of 30 feet from the centerline of Weld County Road 21 shall be delineated
right-of-way on the plat. This road is maintained by Weld County.
l.1 The applicant shall attempt to address the requirements (concerns) of the West Greeley Soil
Conservation District, as stated in the referral response received August 20, 2001. Evidence
of such shall be submitted in writing to the Weld County Department of Planning Services.
J.L ) The applicant shall attempt to address the requirements(concerns)of the Windsor/Severance
/ Fire Protection District,as stated in the referral response dated September 5, 2001. Evidence
of such shall be submitted in writing to the Weld County Department of Planning Services.
K. All vehicles located on the property must be operational with current license plates, or be
screened from all adjacent properties and public rights of way,or be removed from the property.
All other items considered to be part of a noncommercial junkyard must also be removed from
the property or screened from adjacent properties and public rights-of-way.
The applicant shall provide the Weld County Department of Planning Services with a certificate
from the Weld County Treasurer showing no delinquent taxes exist for the original parcel.
M. The following notes shall be placed on the plat:

requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed
within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead.
Any construction within a 200-foot radius of any tank battery or 150-foot radius of any
wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld
County Code.
/ 2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
3) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Recorded Exemption number.
� .i4) Prior to the release of building permits, the applicant shall submit evidence to the

9) The existing accessory buildings located approximately thirty-five feet west of Weld
County Road 21 shall comply with the definition of Accessory Building in Section 23-1-90
of the Weld County Code and maintain compliance with the following conditions:
a) Electricity is the only utility which will be connected to the structure.
b) The structure shall not be used on any basis as a dwelling or as overnight or
temporary housing for any person.
��10) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with longstanding
agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area:
open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Without neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens,field work, harvest,and gravel roads;odor from animal confinement, silage, and
manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and
fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs
cannot simply be moved out of the way of residential development without threatening
the efficient delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and county roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not
provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after
a major snowstorm. Snow removal for roads within subdivisions are of the lowest
priority for public works or may be the private responsibility of the homeowners.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient that urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of
the farmer's livelihood. Parents are responsible for their children.
5. Any proposed subdivision adjacent to or contained within this recorded exemption may be considered
to be urban scale development. Urban scale infrastructure may be required.
6. The applicant shall submit a Mylar plat and a paper copy of the Mylar plat to the Weld County
Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder.
The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County
Code. The plat shall be submitted within sixty(60)days from the date of approval by the Weld County
Department of Planning Services. The applicant shall be responsible for paying the recording fee.
7. The Weld County Department of Planning Staff's approval of this Recorded Exemption Applicationis
based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable tomeet any
one of these conditions within 60 days of approval,then this case will be forwarded to theWeld County
Board of County Commissioners with a staff recommendation for denial.

Subject: Timeline for Recorded Exemption applications
Dear Tom:
The Department of Planning Services is in receipt of your request to enable a property owner to
make application for a new Recorded Exemption prior to the date of eligibility. The property in
question is Lot B of Corrected Recorded Exemption 0705-10-1 RE-3175 having a recording
date of September 22, 2005. This plat was created to eliminate the existing Building Envelope
from the recorded document. No other changes were made as stated by Ed Berlier, PLS.
The first Recorded Exemption was recorded on February 21, 2002, by Peggy and Tom Honn,
current property owners of record. The request to proceed forward with an application prior to
the date of eligibility is addressed in Section 24-8-20.C.1 which states "Lot B of a two-lot
recorded exemption is eligible for future land exemption five (5) years from the date of
recording the exemption plat, in accordance with Section 24-8-40.M. Lot A of a two-lot
recorded exemption created prior to March 1, 2004, is eligible for a one-time-only future land
exemption. Lot A of a two-lot recorded exemption created after March 1, 2004, is not eligible
for a future land exemption." Section 24-8-40 addresses eligibility of a land exemption if the
parcel was created after March 1, 2004.
Given the determination by this office, the applicant or his assignees is eligible to make
application for a second Recorded Exemption on February 22, 2007. Should you have

SUBJECT: Amending building envelopes
You had indicated that objections were being raised regarding amending building envelopes.
While speaking with Ed Berlier, Land Surveyors of Colorado, I asked if he had any suggestions
to make the process easier. He agreed that the corrected plat was the best procedure. He felt it
was the best method in that the average person can find and understand the recorded plat. He
felt a separate recorded document was difficult for anyone but a title company to find.
I further asked what his office would charge for a corrected plat. He indicated it would cost
between $100 and $160.

Re: Corrected Recorded Exemption 3175
Dear Chris:
On April 16, 2004, the Planning staff determined that a building envelope could be
removed from RE 3175 with a Corrected Exemption plat. I have attempted to contact the
surveyor that prepared the original Recorded Exemption 3175. It appears that he is not
able to assist in preparing a Correction Exemption. I have checked with other surveyors
and have received estimates of an average of$1200.00 to prepare the document primarily
because of a requirement to survey the property. I find this an unreasonable cost burden
to remove a building envelope designation. At some time in the near future I will apply
for a building permit. As only one home can be built on the property, it would seem that
the building envelope would be inconsequential. I would be happy to record an affidavit
or similar instrument of reasonable nature to address this matter. Please assist me with
some direction to take to address this matter. I am hopeful that a simple and less costly
means to do this will be available. Thank you for your help.

Dear Mr. Anderson:
Attached are the septic system certificates for both
houses included in the exemption. Both properties have
individual water taps from North Weld Water District. Also, the
tax certificate for 2001 taxes.
We believe we have met the changes as requested on the
plats. One drive for each house. The building envelope was
revised to place it along WCR 21. Each property is accessed from
WCR 21 providing fire protection and water service is along the
road.
The old vehicles and mobile home have b en removed from
Lot A and SE 908. Please advise if there are any further
requirements.

This confirms my call to the planner on duty regarding
progress on the survey for the Drake property. Land Surveyors
have determined the half section is 319.35 acres. It has always
been described as the north half of the section in all records.
Your associate advised to have Mr. Belier reduce the 80
acres that are in the recorded exemption by . 65 of an acre and
show the other 3 parcels as 80 acres each.
We are also requesting another 30 days, until 1/7 .02 to
complete the survey, as more time may be needed to survey the
Water Supply & Storage ditch and the weather may be a factor.
Thanks for your assistance and consideration in this
matter of the estate of Ruth Drake.

Recorded Exemption Questionnaire
1 . Water:
The home property has a North Weld Water District tap that
serves and has served both houses at the home place for
many years. Letter from the District confirms the service.
The farm has irrigation that has been used on other Drake
properties for many years. Dennis Drake has used the water
on his farm in Sec. 2-7-67 and plans to transfer it to
that farm as it is more productive land.
2 . Sewage:
The small house at 40705 WCR 21 has an existing septic and
leach field. The old main house at 40675 WCR 21 needs a
new system and application for such system has been
submitted to the Weld County Health Dept. , a copy of that
application is attached.
3. Property Use:
There are approx. 11 acres of irrigated land, in the SE
corner of the 80 acres, that is into grassy hay. It has
been used for corn occasionally, however, is not of
sufficient size to be economically practical. The
remaining portion of the quarter is used for pasture.
4 . The approximately 4 acres where the improvements are located
was willed to Mrs. Drake' s grandson in the estate. This
includes 3+- acres where he lives and a 1 acre site with a
small house that is rented.
5 . The improvements are located on higher ground along WCR 21
in the SE4 of the N2 of Sec. 10, being 80 acres. The
exemption is sized to include the improvements.
6. The Water Supply and Storage main ditch crosses a portion of
the property. The shape of the recorded exemption is
submitted as suggested by County staff, so as not to cross
the ditch in designating the 80 acres.
7. The main house was built in 1890 and small house in 1925.
The main house is set back approx. 40' , the small house
35' .
8 . Owner has no plans for a conservation easement on the
property, however the remaining 76+- acres best
residential site in on high non-ag ground.
9. No building envelope was planned.
10. No intergovernmental agreements are know to applicant.
11. The surrounding area has a mixture of operating farms with
small residential acreage' s. The exemption fits in with
existing properties in the area.
12 . Applicant believes it is consistent with the code.

and historical development in this portion of the county.
These older structures are likely to be improved with new
owners and the main house will have a new septic and leach
field, as required. Historically these farms have small
residential sites split from the main farm, along the
county roads .
The property is into hay and pasture and does not have an
erosion problem. Such development provides residential

sites (3) that are typically used by families with 4-H
projects, other animals, utilizing pasture for livestock.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
Weld County Recorded Exemption Standards. Our comments and requirements are as follows:
COMMENTS:
WCR 21 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-
of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the
required setback is measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present. (Lot C, 76 acre parcel)
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately
size your culvert. (Lot C)
There shall be a minimum of 75 feet between access points to adjacent parcels.
Direct access from a public road shall be limited; only one access is allowed per legal residential parcel. No
circle drives will be allowed. In accordance with Chapter 8, Article II of the Weld County Code, this policy shall
apply to all new and existing accesses within the unincorporated areas of Weld County. Properties within
municipalities or other counties that access Weld County roads are also subject to this policy. (Lot C)
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.

— Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1. If the largest lot is ever developed, a Weld County Septic Permit will be required
for the proposed home septic system and shall be installed according to the Weld
County Individual Sewage Disposal Regulations. Septic systems for the other
two lots will be installed according to permit #'s SP-0100392 and SP-0100424.
Additionally, please note the following:
v 1) Our Department recommends the applicant to set aside an area for a septic
system replacement envelope.
V2) Topographic or physical features of the proposed lot, such as ravines, ditches,
streams, etc. may limit the area available for a new or replacement septic
system. Prior to recording the plat the Division recommends that the applicant
review the County Code pertaining to Septic Systems to assure that any installed
septic system will comply with all setback requirements found in the Code. In the
event the proposed lot is not of sufficient size to allow the installation of a septic
system the lot may be need to be enlarged.
