Dear Cristie :
We have been in touch with Chris Gathman and Lee Morrison, thanking
them for their efforts on our request for a replat, known as Case
S-539.
Ivan and I want to also extend our thanks to the entire board. We
were greatly impressed with the preparedness of the board and the
open-minded manner in which all of you dealt with what we can only
describe as a mess created by us , Nelson, Haley, Patterson and Quirk
and the Planning Commission back about 1972. I should mention our
builder as well ! The builder should not have used part of the farm
to give us a driveway, we should not have built the barn encroach-
ing on Lot 16 , and NHPQ should not have stuck Lot 17 with the road
maintenance for all of eternity, and the County should have pointed
all this out to all of us at the time ! Suffice it to say, we have
all learned a great deal about some of the pitfalls in the meantime.
We are in the process of trying to eliminate Lot 17 ' s responsibility
for road maintenance of a road it no longer abuts and has no reason
to use by offering to pay the legal expenses of establishing a Home-
owners ' Association and escrowing $500. 00 toward the costs of main-
tenance, as well as giving them the road.
We cannot adequately express our appreciation for how you all do
your job and willingness to give assistance within your powers to
do so to help us clean this up. As you may know, we have asked
for a continuance to go before the Commissioners to give us time
to do this and adjust how it may impact the Replat so we don' t have
to again come before the Planning Board for some other adjustment.

This is to confirm the request we made to you by telephone yesturday
asking for a continuance on our application identified as Case No.
S-539 .
Our main concern regards our attempt via our attorney, Charles
Connell, to resolve the requirement regarding Lot 17, our resi-
dence, to be responsible for the maintenance of Appy Road and
Appaloosa Lane. Apparently, some of the residents of Gilbaugh' s
Appaloosa Acres , Lots 1-14 and 15A and 15B had contacted John
Barry regarding the establishment of a Homeowners ' Association.
We have agreed to pay the costs of establishing a Non-Profit Corp.
and Homeowners ' Association as well as a $500. 00 contribution to
an Escrow for road maintenance if in fact they sign on, which is
intended to transfer the road maintenance as well as the ownership
of the above described road to those homeowners.
We have taken everything Mr. Connell requested to his office. We
believe Mr. Rick Troxel, one of the homeowners is currently in the
process of getting the necessary signatures from the other home-
owners to get this ready for preparing the legal documents to
accomplish this transfer.
Please advise us as to any-outside perimeters for a continuance that
we need to be made aware of. Likewise, we will keep you informed
as to the status of our efforts. We feel our property is basically
unsaleable to any prospective purchaser if they are required to
maintain a road they don' t abut and have no need to use.
Thank you so much for your efforts to date on this application.
We feel that completing this properly could have some impact on our
application and needs to be addressed first.

Apaloosa Acres)
The applicants for case S-539, Ivan & Joanne Gilbaugh, along with the Department of
Planning Services are requesting a continuance of this case for up to 6 months due to the
following reason:
1) The applicants (owners of Lot 17 - Gilbaugh's Apaloosa Acres) currently are responsible for
maintaining Appy Road within the Apaloosa Acres subdivision. The applicants are currently
working with other property owners within the Apaloosa Acres subdivision to establish a
homeowner's association that will maintain Appy Road. The applicants would like to address
this issue prior to the hearing because it affects the potential saleability of Lot 17 which could
impact this pending application.

I think they need to be charged another$20 for an extra legal publication, as well as $10 for postage for
an additional mailing not normally done, if that doesn't cause a problem.

At the December 6, 2000 Commissioners meeting. The applicants for S-539 (4th amended plat for
Apaloosa Acres) requested to have their hearing date continued until June 6, 2000. I have since been
contacted by the applicants and they have apparently resolved the issues for which they had requested
the continuance. They would like to reschedule the hearing for an earlier date.
Can this be done?
If so, what needs to be done to accomplish this?
