The Hazardous Materials and Waste Management Division of the Colorado Department of Public Health and Environment(the
Division)has completed its review of StrgMo.LLC's application for a Class III composting facility in Weld County. The physical
address of the StroMo site is 21970 WCR 30,Hudson,CO 80642.
The application was reviewed to determine its compliance with the requirements of the Act(30-20-100 et seq.)and with the
regulations promulgated thereunder 6 CCR 1007-2(the Regulations). Pursuant to Section 14.1.5(C)of the Regulations the
proposed composting operation meets the definition of a Class III facility. A Class III composting facility does not require a
certificate of designation. However,a design and operations plan and financial assurance are required.
The Division has the following conditions of approval:

The Weld County Department of Public Health and Environment has reviewed this application. We
recommend for approval of the compost facility with numerous recommended conditions and
standards. We have attempted to simplify our referral by separating the proposed conditions into
conditions of approval and development standards.
The following are recommended to be conditions of approval:
Prior to recording the plat:
1. The facility shall provide evidence to the Weld County Planning and Health Departments
that an appropriate financial assurance mechanism has been secured in accordance with the
Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2).

2. The facility shall demonstrate that the stormwater system and retention pond liner were
constructed in accordance with the materials provided in the facility's Design and Operations
Plan. The Plan was received by the Departments of Planning Services and Public Health and
Environment on February 6,2001. At a minimum,the facility shall submit as-built drawings
of the drainage and collection features and a report describing the seepage rate of any
retention structure. Evidence shall be submitted for review and approval to both the Weld
County Department of Public Health and Environment and the Colorado Department of
Public Health and Environment. The applicant shall also provide the proposed seepage rate
testing schedule,to both Departments,prior to conducting seepage rate Department of Public
Health and Environment testing on the retention pond liner.
The following are recommended to be development standards:
1) The facility shall comply with the Regulations Pertaining to Solid Waste Disposal Sites and
Facilities(6 CCR 1007-2)Regulations promulgated Pursuant to the Solid Waste Act,Section
30, Article 20, Part 1, C.R.S., as amended.

2) The facility shall operate in accordance with the submitted Design and Operations Plan. The
Plan was received into the Weld County Departments of Planning Services and Public Health
and Environment on February 6, 2001.
3) The facility shall be operated in a manner that controls fugitive dust. The facility shall
operate in accordance with the Management Plan,for Nuisance Control provided in the
facility's Design and Operations Plan. Additional dust abatement measures shall be
implemented at the request of the Weld County Department of Public Health and
Environment in the event it is determined that dust from the facility is creating a nuisance
condition.
4) The facility shall operated in a manner that controls flies. The facility shall operate in
accordance with the Management Plan for Nuisance Control provided in the facility's
Design and Operations Plan. Additional fly control measures shall be implemented at the
request of the Weld County Department of Public Health and Environment in the event that
flies are in such a number to be considered a nuisance condition. The plan shall also be
implemented in the event the Weld County Department of Public Health and Environment
receives a significant number of fly complaints (associated with facility) and, in the
judgement of the Weld County flealth Officer, there exists a fly condition requiring
abatement.
5) The facility shall be operated in a manner that controls odor. The facility shall operate in
accordance with the Management Plan for Nuisance Control provided in the facility's
Design and Operations Plan. Odors detected off site shall not equal or exceed the level of
fifteen-to-one dilution threshold,as measured pursuant to Regulation 2 of the Colorado Air
Pollution Control Regulations. Additional odor abatement measures shall be implemented
at the request of the Weld County Health Department in the event odor levels detected off
site of the facility meet or exceed the level of fifteen-to-one dilution threshold or, in the
judgement of the Weld County Health Officer, there exists an odor condition requiring
abatement.
6) The facility shall adhere to the maximum permissible noise levels allowed in the Industrial
Zone as delineated in 25-12-103 Colorado Revised Statutes, as amended.
7) The Special Review Permit site and facility shall be operated in compliance with any
required Air Emission Permit issued to the facility by the Air Pollution Control Division of
the Colorado Department of Public Health and Environment.
8) No permanent disposal of wastes shall be permitted at this site. Any solid waste as defined
in the Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2)
received or generated at the site must be removed and disposed of at an approved sanitary

landfill.
9) Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
10) All liquid and solid wastes shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
1 l) The facility shall receive and process only those materials that are described in the facility's
Design and Operations Plan. The Weld County Department of Public Health and
Environment,Weld County Department of Planning Services,and the Colorado Department
of Public Health and Environment shall be notified in writing of any additional materials
proposed for composting. Written approval to proceed with composting shall be obtained
from the Weld County Department of Public Health and Environment and Colorado
Department of Public Health and Environment prior to receipt of the new material.
Submitted information shall include operational procedures and storage procedures.
12) A metal sign shall be posted at the facility entrance. The sign shall be a minimum of three
feet in width and four feet in length. The sign shall state the following:
(a) Name of operation.
(b) Type of facility.
(c) Emergency phone numbers of the facility operator.
11) An individual sewage disposal system is required for any future structure that would require
a septic system and shall be installed according to the Weld County Individual Sewage
Disposal Regulations. A vault system shall be acceptable. If a vault is installed, pumping
records shall be kept for review. A portable toilet facility shall be provided and maintained
on site until such time as a permanent Individual Sewage Disposal System is installed.
12) The facility shall maintain the stormwater collection system.
13) The facility shall comply with the groundwater monitoring plan provided in the facility's
Design and Operations Plan. All groundwater monitoring reports shall be submitted to the
Weld County Department of Public Health and Environment and the Colorado Department
of Public Health and Environment. The first report shall include at a minimum the
following:well installation and completion logs,potentiometric groundwater elevation map,
and groundwater quality data.
14) The facility shall have adequate equipment to dewater each retention structure. Each
retention structure shall be dewatered to a level that restores the full runoff storage capacity

within the 15-day period following each storm event.
15) All raw,uncomposted material stockpiles shall be placed in windrows within 72 hours upon
receipt at the facility. This is not meant to include the temporary stockpiling of finished
compost. In the event processing units, other than windrows, are to be incorporated at the
site, a detailed description of the unit and processing requirements shall be provided to the
Weld County Department of Public Health and Environment for review and approval. The
description shall include literature and other examples that demonstrate the unit is an
effective composting process.
16) This facility shall comply with the health laws, standards, rules, and regulations of the
Colorado Department of Public Health and Environment, the Water Quality Control
Commission, the Air Pollution Control Division, and all applicable local laws and
ordinances.

Dear Mr. Moser:
This letter summarizes the discussions which occurred during our meeting of Friday, March 10,
2000, at the Weld County Department of Public Health and Environment. Those in attendance
included you, myself, Ron Ditson of Wes Moser and Sons, Inc., Cliff Roberts of Chemical
Applications & Engineering, and Cindi Etcheverry of the Weld County Department of Public
Health and Environment (WCDPHE).
The purpose of this meeting was to discuss the operation of the existing composting facility on
property owned by Wes Moser & Sons, Inc., located at WCR's 30 and 49. As we discussed, the
current operation of this facility, at this location, is a violation of both the Weld County Zoning
Ordinance and the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as
amended.
As you may recall, you proposed to phase out the composting operation, and make application
for a new composting site, rather than applying for the appropriate permits necessary to operate
at the current location. As we discussed, the WCDPHE is not opposed to this proposal. Our lack
of opposition is based upon the conditions and commitments which we agreed upon in this
meeting. Those conditions and commitments are as follows:
1) You have committed to submitting Certificate of Designation and Use by Special Review
permit applications for a composting facility at an alternative location. You have
committed to submitting these applications no later than March 31, 2000. During our
meeting you indicated that you are currently in the process of purchasing the piece of
property where the new facility will be located.. You also provided us a copy of the
contract concerning the purchase of this property. The location of the property is
described as the West 1/2 of Section 26, and the East 1/2 of section 27, Township 3
North, Range 65 West of the 6th P.M., Weld County, Colorado.

2) You have committed to removing all manure/compost from the site no later than
September 30, 2000. We discussed that some flexibility may be allowed on this date
provided you are making a "good faith" effort to permit the alternative facility.
3) Continued processing of manure/compost will be allowed providing that the size of the
facility will not get larger than its current size. Only cow manure and bulking agents,
such as sawdust and straw, shall be composted at this site.
4) You have committed to preventing any surface water which has come into contact with
the manure/compost from leaving the site. Since we are heading into spring, we
recommend that you assure that the facility can retain the run-off from a 25-year, 24-hour
storm.
5) You have committed to controlling flies originating from the site. You also committed to
providing additional fly control if requested by the WCDPHE.
6) You have committed to controlling dust originating from the site. You also committed to
providing additional dust control if requested by the WCDPHE.
7) You have committed to controlling odors originating from the site. You also committed
to providing additional odor control if requested by the WCDPHE.
8) You have committed to working with, and communicating with your neighbors to keep
them informed, as appropriate.
9) You have committed to contact both the Weld County Department of Planning Services
and the WCDPHE should you not be able to comply with any of the above conditions
and commitments.
I hope that this letter accurately summarizes our meeting. Please acknowledge, in writing, within
5 days of receipt of this letter, that you agree with the terms and your conimitments in this letter.

Dear Ms. Chester:
At your request we have reviewed this application. The materials we have reviewed
included the Questionnaire and plat submitted by the applicant and various U.S.
Geological Survey, and C.G.S. geological maps. We also made a field inspection of the
site.
The proposed site is located in a very sparsely populated area which is advantageous in
that it should reduce possible nuisance impacts to others from the proposed operation.
The site is underlain by a windblown medium sand deposit with minor content of
granules and small gravel clasts. Depth of the sand and any underlying alluvial deposits is
unknown but is probably at least several tens of feet thick as the site is shown to be
within an ancient buried stream channel identified as the "Beebe Draw Paleo Channel"
on U.S. Geological Survey Map 1-855-O. There is presumably a shallow aquifer in the
area because center-pivot irrigated agriculture is common on the adjacent lands. Beneath
the wind-deposited sands and channel deposits. shale and sandstone beds of the 1_aramie
Formation are the expectable bedrock.
There are two geology-related issues that do not appear to have been addressed as yet.
These are described and discussed below.
1) The presence of a shallow aquifer at the site needs to be technically addressed and
evaluated for possible ground water contamination impacts. The surface soil as seen
and as described by the SCS Soil Survey cited by the applicant is extemely
permeable. This very extensive facility will generate storm runoff and incident
precipitation that could combine with the large volume of manure being processed to
generate a heavily contaminated liquid phase that might quickly percolate downward

to the water table. This aspect should be evaluated by appropriate professional
engineers for the applicant and the results reviewed by Weld County Environmental
Health and the Colorado Department of Health and Environment.
2) This site is within a gas field and the site is crossed by at least two buried pipelines.
The possible safety and operational impacts between the gas production and
distribution facilities and the proposed operation need to be evaluated and reported to
Weld County.

The Weld County Public Works Department has reviewed this proposal. This project falls under the purview of
the Weld County Use by Special Review Standards. Our comments and requirements are as follows:
COMMENTS:
Access to the facility will be from WCR 30. It is designated on the Weld County Transportation Plan Map as a
collector status road, which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-
way. This road is maintained by Weld County.
Our traffic records indicate that 239 vehicles used this portion of road in a 24-hour period. The last count was
taken October 14, 1996.
The access from WCR 30 has adequate sight distance on and off the road. There is an oil tank battery south of
he road, but it does not restrict the sight distance at the intersection. The existing gravel access road to the
composite site is wide enough to accommodate two-way traffic.
REQUIREMENTS:
The section of the haul road adjacent to the cattle feeding operation shall require additional gravel and dust control
prior to entering the composite facility. Dust control shall be maintained year around adjacent to the feeding
operation.
The access road is in good shape, but shall be graded and drained to provide an all-weather access to the facility.
Additional gravel shall be placed as needed.
The Weld County Public Works Department recommends approval of this USR.

In consultation with the Natural Resources Conservation Service (NRCS) ,
we have reviewed the above referenced case and have the following
comments .
SOILS/LIMITATIONS: The soils are classified as Valent sand with slopes
varying from 0-9% . The applicant furnished a copy of the soils map and
is aware of he soils . The major limitation for the intended use would be
the high susceptibility to wind erosion. Compost piles should help to
control this erosion potential .
PRIME FARMLANDS: The Valent sand is not considered as `prime farmland' .
SOIL EROSION POTENTIAL: Surface runoff is generally slow and percolation
is good thus providing for limited erosion potential from water . The
Valent soil is, however, highly susceptible to wind erosion. Care should
be exercised so as to not have large open, unprotected areas .
OTHER:
The District welcomes the opportunity to review and comment on proposals
such as this . Conservation and wise use of our natural resources are

RE: Application for Class III Composting Facility
Dear Mr. Moser:
The Solid Waste Unit of the Hazardous Materials and Waste Management Division (the Division)
has completed its review of the August 3, 2000 STROMO, LLC application for a Class III
composting facility located in Weld County. Mr. Cliff Roberts with Chemical Applications &
Engineering, Inc. prepared the application. The application was reviewed to determine
compliance with the solid waste regulations 6 CCR1007-2 (Regulations) specifically, Section 14.
The Division has the following comments regarding the application:
1. As you are aware, a Class Ill facility does not require a certificate of designation. However,
financial assurance and a design and operations plan are required.
2. Please provide the owner's name, address and telephone number for contact in case of an
emergency.
3. - The application indicates raw manure will be temporarily stockpiled onsite or placed directly
in windrows. Raw manure should be placed in windows as soon as practicable to minimize
nuisance conditions. Specify the maximum time raw manure will be stored prior to placement
in a window.
4. Page 7 states there is a "nearby well"to the proposed composting site. Has the depth to
groundwater been measured in this well? Is this the 'stock well' identified on the USR site
map? If not, submit a revised site map that shows the location and identifies the"nearby
well".
5. A copy of the approved fire protection plan must be provided for inclusion in our records for
the facility.
6. Please specify the distance of"designated/linear intervals"for window sampling.
Approximately, what size are the windrows?
7. The composting process may produce nuisance conditions, mainly odors and flies. Provide
additional detail on how the composting process will be managed to control odors and flies,
both onsite and offsite. In addition, if nuisance conditions occur what actions will be taken to
correct the problem?

8. Page 7 states the storm water retention pond is located on the northeast corner of the site,
however, page 4 states the retention pond is located on the northwest corner. Please clarify.
9. Although page 9 provides a brief discussion for permanent closure of the site, the
Regulations require implementation of the closure plan when the facility ceases operations
for 180 days or more. Please review Section 14.6 for closure plan requirements and include
procedures in the facility's design and operations plan that addresses these requirements.
10. Mr. Roberts' discussion regarding the storm water control features, page 5, did not include
the following requirements:
a) all leachate/storm water detention structures must be constructed of low
permeability materials that achieve a hydraulic conductivity less than or equal
to 1 X 10-5 cm/sec; and
b) leachate/storm water collection structures shall be dewater within 15 days of
a storm event so that the full runoff storage capacity is restored and the
hydraulic head is removed; and
c) the surface water control system must prevent storm water flow onto the
facility during the 25-year, 24-hour storm event.
These conclude the Division's comments regarding the STROMO application for a Class III
composting facility. We will not continue our technical review of the application until a written
response is received for each of the aforementioned comments.
Although the Division does not impose a fee at the time the application is submitted, there will be
a charge for staff time spent reviewing the application and preparing the final recommendation.
Currently, the charge is $72.47 per hour and my preliminary estimate is 15 to 20 hours for this
project. An invoice will be sent to the applicant upon completion of the review.
