The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest, and gravel roads;odor from animal confinement, silage, and manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. 1 ilD Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient that urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 4. The applicant shall submit a Mylar plat and a paper copy of the Mylar plat to the Weld County Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County Code. The plat shall be submitted within sixty (60) days from the date of approval by the Weld County Department of Planning Services. The applicant shall be responsible for paying the recording fee. 5. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to meet any one of these conditions within 60 days of approval, then this case will be forwarded to the Weld County Board of County Commissioners with a staff recommendation for denial. As per discussions with the Health Dept. and you, (a few months ago) we have relocated the proposed lot line between Lot A and Lot B again and made sure to have enough room for septic systems. Water Supply Statement Domestic water is to be provided by the Little Thompson Water District (please see attached commitment letter)to both Lots A and B. Water lines existing in the immediate area will allow for easier installation of domestic taps. These taps will be purchased at the time construction is approved. No irrigation water exists within the property. 2. Sewage Disposal Statement No sewage disposal systems are present on the property. Both Lots A and B will utilize proposed individual septic disposal systems. Septic systems will be installed in compliance with requirements and regulations of the A(Agricultural)Zone District and the Weld County Health Department at the time construction is approved. 3. Description of Property Use The Approximate 15.5 acres of land under consideration has no existing structures. Much of the property is a lake. The remaining ground of this property is currently used to grow hay without the benefit of irrigation water. 4. Reason for R.E./Lot Use Explanation Only a few acres of the subject property are used agriculturally. Must of the property lies within a lake; it is not suitable to grow hay. Several houses border the land. It is felt that this property is best suited for residential purposes. Advantages for this proposal include the compatibility with surrounding land uses, convenience of existing utility lines, short range to major activity centers, and the property does not have a large crop yield. The intention is to divide the 15.5 acres into roughly two equal sided lots to match the size of the surrounding residential properties. 5. Location, Size, & Present Use of Area Situated within the Southwest Quarter of Section 6, Township 4 North, Range 68 West of the 6th P.M. County of Weld; the property is approximately 15.5 acres in size. The property is p P Y PP Y p P Y located approximately 4 miles Southeast of Loveland on WCR 1 and near WCR 48. Johnstown is approximately 7 miles to the east. No structures exist on the property, but hay is grown. In the local vicinity there are a number of residential dwellings and farm practices. 6. Unique Physical Characteristics There are no unique physical characteristics on the property • • 7. Setback and Offset Statement All proposed structures are to meet the minimum setback and offset requirements as regulated within the Agricultural Zone District. 8. Conservation Easement Statement The owners do not wish to place a conservation easement on their property at this time. 9. Building Envelope Statement The owners do not wish to place a building envelope on the site at this time. However, should the County request that a building envelope be sited on either Lot A or B, it will be designated with the final plat. 10. Weld County Comprehensive Plan Consistency This proposal conforms to the Comprehensive Plan and is consistent with Chapter 22 of the Weld County Code by creating a small residential lot that will benefit the surrounding area. The similar residential land use of the surrounding properties and the smaller size of the proposed site make this proposal in agreement with effective and orderly planning. 11. Compatibility with Surrounding Land Uses The proposed residential use of this property coincides with the surrounding land use in the area. Residential houses are immediate this site. Typical styles of the area are one or two story frame houses with minor sheds or outbuildings used for yard care and small-scale farming. 12. Consistency with Intent of District This proposal will not interfere with agricultural work, production or activities in the surrounding area. Although hay is grown on the property, the yield is very low. The land would benefit a family desiring a rural lifestyle more than any commercial agricultural practice; therefore, it is consistent with the Agricultural Districts intent. 13. Consistency with Efficient and Orderly Development This proposal safeguards the interest of the public with a new development that does not take away from the natural beauty of the county, in addition with the safety of fire and rescue, and the conveniences of utilities, such as public water supply, electric and telephone. It will not hinder any of the surrounding farming operations by keeping existing irrigation for the needs of the existing farms and ranches and preserving all of the surrounding farm producers. We feel this proposal is consistent with efficient and orderly development as defined in the Weld County Subdivision Ordinance, Section 13 and Chapters 22 and 23 of the Weld County Code. In addition to the original comments, the following conditions are recommended to be part of any approval: The exhibit map presented to WCDPH&E March 19, 2002, indicates proposed septic areas. The Department is recommending that two septic envelopes per lot shall be recorded on the plat. The lot owner shall not place any permanent landscaping, structures, dirt mounds or other items that would interfere with the construction, maintenance, or function of the fields in the primary and secondary envelope areas. Please note, septic envelopes shall meet the minimum 100 foot setback from the maximum fill line of the lake. Because of seasonal fluctuations in lake elevation this set back requirement shall be measured at peak water levels. The applicant should be aware that no variances are allowed on new construction. oepamer WO GRE R el"*1 DNA* M:\ENVIRONMENTAL HEALTH SERVICES\PLANNING\RE-3157 additional comments.rtf s Memorandum TO: Chris Gathman, W.C. A Weld County Septic Permit is required for the proposed home septic systems and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 2. Prior to the release of building permits on lots A and B, the lot owners shall verify with the nearest Town/City or Sanitation District to determine the location of the nearest sewer line. In accordance with the Weld County Code, if a sewer line exists within 400 feet of the property and the sewer provider is willing to serve the proposed structure, a septic permit cannot be granted by the Weld County Department of Public Health and Environment. Additionally, please note the following: 1) The Weld County Health Department, Environmental Protection Services, recommends the applicant to set aside an area for a septic system replacement envelope on both lots. 2) Topographic or physical features of the proposed lot, such as ravines, ditches, streams, lakes, etc. may limit the area available for a new or replacement septic system. Prior to recording the plat the Division recommends that the applicant review the County Code pertaining to Septic Systems to assure that any installed septic system will comply with all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to allow the installation of a septic system the lot may be need to be enlarged. SE C.6, /4 T4N, R68W WELD COUNTY, CO , The District provides water service within its service area as defined by the District. The provision of water service by extension of existing water lines of the District to the above property and the installation of taps for lots is done under the terms of the Rules and Regulations of the District established by the Board of the District from time to time. You may obtain a copy of the Rules and Regulations from the District. This letter outlines the provisions of the Rules and Regulations, however this letter does not change any provisions of the Rules and Regulations. The Board of the District may alter and amend the Rules and Regulations at any time, and the provisions of this letter are subject to alteration and amendment based on changes in the Rules and Regulations of the District. We currently have a 10" diameter water line located along Weld County Road 1 with additional capacity available Therefore, we can commit to provide service to the above property, subject to the limitations in this letter, for one standard residential 5/8" X 3/4" water tap per lot; and the following additional limitations on the provision of water service are: 1. In August of 1993 the Little Thompson Board implemented a "system impact" fee of $1050 per lot for all lots to be added to the system. This is due upon application for the taps. 2. All improvements to District facilities required to provide service will be the financial responsibility of the developer in accordance with the District Rules and Regulations. All improvements must conform to District Specifications. 3. If a fire hydrant is required for the subdivision there is a $2,000 fire hydrant fee that needs to be paid prior to installation of the fire hydrant. You will be responsible for any improvements needed to meet the required fire flows in your subdivision. 4. You will be required to provide the needed water lines in the proposed subdivision. 5. The design, installation and total cost of the project will be the responsibility of the developer. This commitment letter will expire two years from the date of this letter if the taps have not been purchased, paid for and installed by that date of expiration. The current fee for the domestic 5/8" X 3/4" tap is $14,000.00. YOU ARE HEREBY ADVISED THAT THE RULES, REGULATIONS AND TARIFFS OF THE DISTRICT ARE SUBJECT TO CHANGE WITHOUT NOTICE; AND THIS LETTER IS ISSUED WITH THE SPECIFIC LIMITATION THAT THE DISTRICT MAY CHANGE THE RULES, REGULATIONS AND TARIFFS APPLICABLE TO THE ABOVE PROPERTY AT ANY TIME WITHOUT NOTICE TO YOU OR ANY PERSON. If you have questions, please contact me. Regards Michael T. Cook District Engineer Hello
