RESOLUTION
2(A RE: ACTION OF THE BOARD CONCERNING SITE SPECIFIC DEVELOPMENT PLAN
`II AND USE BY SPECIAL REVIEW PERMIT#1324 FOR AN ASPHALT AND
CONCRETE BATCH FACILITY IN THE A(AGRICULTURAL) ZONE DISTRICT -
ASPHALT SPECIALTIES COMPANY, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 11th day
of July, 2001, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing
the application of Asphalt Specialties Company, Inc., 7321 East 88th Avenue, Henderson,
Colorado 80640, for a Site Specific Development Plan and Use by Special Review
Permit#1324 for an Asphalt and Concrete Batch Facility in the A (Agricultural) Zone District on
the following described real estate, to-wit:
Part of the N1/2 of the SW1/4 of Section 20,
Township 1 North, Range 66 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, said applicant was represented by Paul Banks, Banks and Gesso, LLC, at
said hearing, and
WHEREAS, Section 23-2-230 of the Weld County Code provides standards for review
of said Use by Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Weld County Planning Commission and all of the exhibits and evidence presented in this
matter and, having been fully informed, finds that this request shall be denied for the following
reasons:
1. It is the opinion of the Board of County Commissioners that the applicant has not
shown compliance with the Weld County Code as follows:
a. Section 22-2-60.F.1 -- It is the opinion of the Board of County
Commissioners that the proposal does not provide for public facilities and
services, especially roads to be developed, in a timely, orderly and
efficient manner to support the transition of agricultural land to urban
development.
b. Section 23-2-230.B.2 - - It is the opinion of the Board of County
Commissioners that the applicant has not demonstrated that the proposal
is consistent with the intent of the district in which it is located.
c. Section 23-2-230.B.3 - - It is the opinion of the Board of County
Commissioners that the applicant has not demonstrated that the uses

which would be permitted will be compatible with the existing surrounding
land uses.
d. Section 23-2-230.6.4 -- It is the opinion of the Board of County
Commissioners that the applicant has not demonstrated that the uses
which would be permitted will be compatible with the future development
of the surrounding area.
e. Section 22-3-50 -- It is the opinion of the Board of County
Commissioners that the proposal does not reflect the intent of the
County's transportation system to provide for the safe and efficient
movement of people and goods through the County.
f. Section 22-5-80.B.1-- It is the opinion of the Board of County
Commissioners that the proposal does not promote the reasonable and
orderly development of mineral resources since this proposal is not for
the recovery of a mineral resource.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of Asphalt Specialties Company, Inc., for a Site
Specific Development Plan and Use by Special Review Permit#1324 for an Asphalt and
Concrete Batch Facility in the A (Agricultural)Zone District on the hereinabove described parcel
of land be, and hereby is, denied.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 11th day of July, A.D., 2001.
