To whom it may concern:
As a neighbor of Busker Dairy, living within one mile of the dairy, I can offer only the
best recommendation for Busker Dairy. When deciding on a location for my house a
little over a year ago, I was fully aware of Busker Dairy and the complaints against
dairy farms in general. However, I found Busker Dairy to be committed to running a
clean operation. They worked hard to control flies and odor. At my home location, I
saw no reason and no substantiation for the complaints I had heard against dairy
farms. Knowing that I live in an agriculturally zoned area, I understand that I must
sometimes live with less then desirable conditions. This is part of living in the
"country". Again, I have seen no adverse affects attributable to Busker Dairy. The
Board of Commissioners must simply decide if they are pro-agriculture or not. A vote
for Busker Dairy's special use permit is a vote for agriculture in Weld County. I
sincerely hope the Board is committed to agriculture in Weld County.

Scott Busker is a fellow dairyman who lives three to four miles away
from me. I know he has applied to operate a larger dairy. Being a dairyman
myself, it is a constant challenge to remain competitive with the ever
changing cost of doing business. The Buskers are young and feel the need to
get larger to remain competitive in the diary business. The Buskers run a
very clean, well-organized dairy. He has been at the current size for several
years and I feel they are capable of handling and managing a larger dairy.

RE: Busker Dairy USR dairy expansion permit
To: Weld County Commissioners and Planning Committee
As a neighbor less than one mile from Busker Dairy, we at Bearson Dairy
are writing in support of the Busker Dairy USR expansion proposal. We
were granted a USR permit for 2500 cows on 160 acres approximately two
years ago. The Buskers' proposed expansion lies in an agriculturally zoned
area and is compatible with the surrounding agricultural uses such as my
dairy to the East and the turkey farms located less than a mile to the North of
his dairy, and the open farmland to the West of his dairy.
As a dairymen for over 30 years, we have seen many changes in the dairy
business. It is necessary for dairies to expand to remain competitive in
market place. Please help us preserve agriculture in Weld County and
approve the expansion of their family farm.

I am writing this letter in support of the potential expansion efforts for the Scott and Susan Busker Dairy in
Fort Lupton,CO.
I am a large animal veterinarian who deals exclusively with dairy farms. I have consulted extensively
across the US for the past 13 years. I specifically have been calling on the Busker Dairy as customers of
Monsanto Dairy Business for the past 1.5 years.
From the first time I drove up the tree lined lane of Busker Dairy,passed by a machine shed that was very
well maintained,and parked at the milk parlor that is totally landscaped with plants and shrubbery, I knew
that I was at no average dairy,but a very prosperous dairy with excellent animal husbandry. I knew
without ever touring the facility for the first time,that looking at the assets of Mr.and Mrs.Busker,that
they understood the importance of taking care of their animals,as it is their animals that make the food that
each of us are so tremendously blessed with in this country. Busker Dairy has tremendous coral
management,as well as facility maintenance. Scott and Susan understand the importance of these
principals in giving their animals a very quality environment in which to live and produce milk.
Dairy farms are an excellent economic resource to a community. Local jobs are created for people who do
everything from taking care of calves,to men and women who milk cows. Dairies also provide jobs for
forage and hay producers,machine and equipment repairmen,concrete companies,and banking and
finance communities,tractor and automobile dealerships. Money spent in an agricultural community turns
itself over 6-7 times,and allows a community to grow in infrastructure,community,and people. Dairy
expansion is not something that is limited to Colorado,but is occurring across the nation. As farms milk
more cows to stay competitive in feeding a growing world population,as well as to replace farms that are
retiring and/or farms that have no generational replacements,we need to be aware that not only do farms
help a community financially,but they also feed a hungry population. One-half of the world population
today lives on less than$1 U.S. dollar per day,while 8-10%of the world population goes to sleep at night
hungry. As the front range continues to grow in population,and the best and most fertile farm soils of
Colorado are put under concrete for track housing developments,I ask: Where will your food come from
for the 21'Century?
I highly recommend that the Weld County Commissioners and Planning Committee allow a farm family to

structures and knows what it takes to get optimum performance from his cows.

I am writing on behalf of Mr. Scott Busker. I wish to urge your support of his request for
a special use permit that enables his Fort Lupton dairy to expand.
DFA has long since recognized that the economic growth on Colorado's front range will
adversely impact our existing dairy farms that are interspersed from Denver to the
Wyoming border. The economies of scale are essential to the current and future
economic viability of agriculture. Dairy is certainly no exception.
DFA is in need of additional locally supplied milk production to satisfy the increased
demand for dairy products as a result of the tremendous population growth along the
front-range. DFA and its membership have committed significant investments in
numerous communities throughout Colorado. Those investments, as well as our
relationship with Leprino Foods in Fort Morgan,will continue to positively impact our
rural economies.
In closing, I urge the Commissioners to approve Mr. Busker's request for a special use

I am writing this letter on behalf of Busker Dairy. During the time I've known the Buskers,their dairy has
grown to be a progressive and successful operation. At their current size,the Buskers produce substantial
income for the county and provide employment for area residents. Allowing their operation to expand will
improve Busker's efficiency and help them to remain competitive players in the rapidly changing dairy
industry.
I understand that the Buskers have retained the services of Thomas Haren(Environmental Services,LLC)
and substantially reduced the size of their proposed expansion from 4,000 cows to the currently proposed
1,450 cows. Over the years,Weld County has typically been ranked in the top five counties in the United
States for agricultural income. Weld County's dairy producers contribute a significant portion of this total.
In order for our dairy operations to remain successful,they will need to the ability to expand and be at peak
efficiency. The Busker's modest expansion proposal will allow them to opportunity to continue to remain
competitive in the future.

every two weeks.
Mr. Busker's dairy is one of the cleanest most modern and well run dairies in the State of

for over thirty years and have visited virtually every dairy that has been in business for this

the industry. In my profession as a production medicine dairy consultant I travel through several
states and have had the chance to visit many farms. Most farms aspire to running their herd at the

Thank you for the opportunity to comment on the Busker Dairy Expansion USR 1356. I represent
a group of neighbors who live adjacent to the existing dairy, and who oppose the expansion
requested. Please relay these comments on to the Planning Commission well prior to the November
20, 2001 meeting.
I will focus my comments on a few specific aspects of the proposal as it relates to the
Comprehensive Plan and the Zoning Regulations. As we understand the application, it is being
handled as a Livestock Confinement Operation and as an Agricultural Service Establishment, being
a dairy.
We believe that the intensity of this use is incompatible with the existing neighborhood. Under
Section 22-2-60 of the Comprehensive Plan, compatible commercial and industrial uses are to be
encouraged in the agricultural zone, "...when the impact to surrounding properties is minimal..."
(Sec. 22-2-60.B I.A.Goal2). The original Busker Dairy was sold to the neighbors as a, "small family
dairy." The impacts of the existing dairy are substantial; more than doubling its size in a relatively
small area will push the impacts from odor, waste management, runoff and flies well beyond
endurance.
Combining a Use by Right and a Use by Special Review for a Single Use is Bad Policy
Though the dairy application and many of the calculations assume that the number of cows will be
1450, the real number of cows is 1990. Mr. Busker is apparently going to claim the right to house
540 animals as a use by right on adjacent acreage, even though they will be an integral part of the
dairy operation. It is proper to evaluate the impacts of 1990 cows, not 1450. There is but a single
use here: a dairy operation. Waste management, flies, odor and other issues arise from the dairy use
as a whole. EXHIBIT

The issue in this proceeding is not the 3500 animals applied for by Mr. Busker a few years ago, and
denied. The focus here should be the enlargement of the dairy herd and facilities from approximately
880 animals to 1990, 226% of the original number. This is not a small family dairy.
It is not Clear That Even 1990 Cows is the Correct Number
The neighbors recently presented photographic evidence to the County that Mr. Busker was
exceeding the allowed number of cows at the dairy site. (Complaint received August 8, 2001.) The
neighbors presented a recent, enlarged aerial photo clearly showing the number of confined cows.
It is unclear whether the County attempted to count the cows in the photograph, as the neighbors had,
to determine if Mr. Busker was in violation on the date of the photograph.
The County is apparently using the term"animal units"to count the number of cows on the property.
Animal Unit may mean the number of adult cows x 1.4, or a like number. In his application, Mr.
Busker appears to be using a number of animals based on a specified number of milking cows, calves
and dry cows, which is different from the number of"animal units". We do not care if Mr. Busker
has 199 calves or 205. The neighbors are very concerned that Mr. Busker's 1990 animal number
may actually be 1990 x 1.4, or 2786, including calves.
We actually believe that the actual count of animals of all types is the correct method, and that the
County should clearly specify in the Busker permit how the number of animals will be counted for
both compliance and enforcement.
The Expansion is Incompatible With Existing and Planned Uses in the Neighborhood
Individual neighbors have relayed their specific concerns to the County,including repeated outbreaks
of the fly problem, inadequate response to odor and other problems from the liquid waste lagoons
(which lagoons will be expanded), problems with the composting operation, and others. These
concerns include the transport of off-site generated manure to the composting operation. We do not
believe that the transport of off-site material to the Busker dairy is allowed. This would constitute
a separate commercial use of the property.
Most of the surrounding uses are residential. The residential use of this area has expanded in recent
years. Adjacent zoning also includes a kennel, which is a fly sensitive use, and a nursery.
Compatibility with the Neighborhood is a Concern Under Both the Statement of Intent and
Applicability of Division 4,Use by Special Review(Sec. 23-2-200.A),the Application Requirements
(Sec. 23-2-260.A.31.
As you are aware, both the Planning Commission and the County Commissioners have a specific
duty to determine that the applicant has demonstrated that, "..The uses which would be permitted
will be compatible with the existing surrounding land uses." (Secs. 23-2-220.A.3 and 23-2-230.B.3.)

That showing must also include a demonstration that there is adequate protection for the health,
safety and welfare of the inhabitants of the neighborhood and the County (220.A.7 and 230.B.7).
As you know, the applicant has the burden of proof on these issues.
The neighbors in this area are not fighting agriculture. Many make agricultural use of their own
properties. These neighbors are not complaining about odors from the neighbors cows or horses, or
someone parking their horse trailer in the wrong place. What they are fighting is the noise, odor,
flies and waste management problems associated with a 2000 cow dairy herd confined on a limited
acreage in close proximity to their homes. In reality, the waste management concerns of a 2000 cow
dairy herd are much like those of a small city, but with a big difference: the City would be required
to use scientific primary and secondary waste treatment, and would not openly compost the waste
from its citizens in untreated form. Here, there is no active treatment in the lagoons, and raw waste
is composted in the open, with the periodic fly problems. It is the diluted waste and urine from 2000
cows which is the source of many of the dairy's current problems; there is no proof that these will
be handled any better by more than doubling of the size of the dairy.
The Town of Firestone has opposed the application, and Frederick has expressed concerns. They
have reason to fear for their own future development if the expansion is allowed, for the same
reasons that the immediate neighbors do.
Waste management at the site must require more than a pro-forma recitation of basic goals and
standards. Applicant has not proposed enough specific conditions to remedy the problems at the site.
Any permit should contain specific standards for monitoring odor and flies, and should contain
specific, enforceable commitments from the applicant to act quickly to eliminate them. A 30-60 day
response period to an odor or fly problem is no remedy at all,though that might be just fine for other
types of problems not posing immediate health and safety risks. Applicant should be required to
commit to a specific response plan for odor and fly problems. This plan should include a scientific
basis for addressing treatment problems at the waste lagoons resulting in the release of strong or
offensive odors into the neighborhood.
The applicant should also include an emergency response plan to immediately address storm or other
conditions threatening a waste over-run or other failure of waste containment facilities.
More Minor Concerns
Lighting at the site should be required to be hooded, and a light management plan should be included
to reduce and minimize night-time glare. The addition of new facilities should not increase lighting
at the site which crosses the property line.
Additional berming and landscaping should be required, including the planting of trees of a
substantial size to minimize exposure of the neighbors to waste treatment and other areas.

Request to Forward Neighborhood Comments
The neighbors will undoubtedly raise additional concerns in their individual submittals. Though you
have requested all comment letters to be in your hands by November 1, almost three weeks before
the hearing, please use your best efforts to forward new comments to the Planning Commission to
allow a meaningful time to review them. Certainly, all comments received by the staff within the
next two weeks should be forwarded on to the Commission before the hearing. The neighbors
believe that all comments should be thoughtfully considered, and that this requires review by
Planning Commission members in advance of the meeting on November 20.

To Whom It May Concern:
This letter is written in an effort to cast our vote against
ANY expansion of the Busker dairy on WCR 17.
We have lived at 7923 WCR 14 since 1992. We live on the corner
of road 14 and road 17. We are very glad we live no closer
than 1 -1 /2 miles from the dairy. We do, however, live on the
route over which all or most of the traffic passes on the way
to and from the dairy. This corner was a quiet and peaceful
place when we moved here. From the moment the Busker dairy
opened it changed everything. For the following reasons we
want to cast a negative vote for any expansion of the dairy:
1 ) The odor from the dairy is constant. It varies from subtle
to overwhelming. The only relief we get is when a strong wind
blows directly from the south. The odor problem is a year round
issue,
2) The flies are a summer long irritation and health issue.
It is a constant battle both indoors and outdoors. The only
relief comes with frost in the Fall.
3) The traffic in and out of the dairy changed our corner into
a noisy, dusty, dangerous place. The dairy is a huge business .
This can be verified by the number of semi trucks that either
haul things in or out. The great majority of the traffic in
and out summarily ignore both stop signs and "ONE WAY" signs.
One of the regular semi haulers has NEVER stopped at the stop
sign nor has he/she obeyed the "ONE WAY" signs in exiting off
highway 52. Drivers go through the stop sign as if it doesn't
exist, at speed. The trucks shake our house as they pass, create
mountains of dust, and on two occasions we have had close calls
from this thoughtless and unlawful behavior. Of the many drivers
who come and go, ONE driver is thoughtful of us and this corner.
Any increase in the size of the dairy can only increase the
problems listed above for all of us who live anywhere near the
dairy or on the roads in and out. With a business that already
over uses the land, we urge you to deny any request for an
increase in size of the Busker dairy.

Dear Weld County Planners:
The Wimmer brothers are asking you to deny the Busker Dairy
expansion. For the second time .in three years, our neighbor to
the north, the Buskers, have essentially asked us to donate our
28 acre farm as art of a sacrifice zone surrounding his proposed
16 to 19 animal/acre dairy. We have no problem with the Buskers
operating a four animal/acre dairy along our north property line.
The dairy expansion under a usr permit will not eliminate a four
to five fold ,increase in dairy generated pollutants such as
flies 'dust, odors and noise. These problems are not compatible
with our neighborhood.
These quality of life threatening pollutants do not only
affect our backyard, but also our side and front yards. We have
two dwellings on our farm 1/8 mile south of the existing use by
right dairy. As a matter of fact, the entire residential area on
the south side of his proposed 80 acre site has six dwellings
owned by neighbors on Xp-30 acre sites. All were there ,prigr to
the Beaker' s original site selection of .their proposed Confixled
animal :uiiit farm.

Frederick and Firestone were only one mile, away and the nertt '.and
east boundaries all have dwellings around the dairy as well. '

areas: My house has been here since the homestead days and the
expanded dairy is located too close to it to avoid almost daily
problems. Since Weld County has no official buffer zone set
backs, I ask that you protect us and encourage other confined
animal unit operators to perform due diligence in their site

Ladies and Gentlemen:
The Town of Firestone supports active agricultural land uses in unincorporated
Weld County. As Firestone continues to expand within its Urban Growth
Boundary there is an ongoing effort to inform new residents and businesses
about the active agricultural land uses within the area. In spite of our efforts there
continues to be frustration from both the new residents and existing agricultural
users within the area regarding procedures to mitigate the inherent conflict
between the land uses.
Although the noted Case before you today is outside of the Firestone Urban
Growth Boundary it is in close proximity to it and also a planned development
that is in process which comprises approximately 1,400 dwelling units, with
portions of the development being in Section 29. We believe your approval of an
application that is approximately 4.5 times greater that the use by right density of
animal units is such close proximity to an urbanizing area is not appropriate.
Therefore, the Town respectfully requests that the density of the animal units be
lowered to a more compatible number given the location of this application. We
believe such reduction would be in the best interest of all parties concerned

When they go before the county to get
permission, more often than not they are met with

"They" complain all the time. So what's new? "They" buy a house near the
airport and complain about the noise and fumes. "They" Build a fancy house
down wind from the turkey farm and complain about the stench. I could go
on but "They" wouldn't even comprehend that it was "Them" I was talking
about. Any way, "We" all know this! "They" would not be happy if"They"
did not have "something" to complain about.
