HomeMy WebLinkAbout20012958 RESOLUTION RE: GRANT AMENDED CHANGE OF ZONE #522 TO MODIFY THE USES ALLOWED IN THE PUD (PLANNED UNIT DEVELOPMENT) ZONE DISTRICT AS APPROVED BY RESOLUTION #991203, DATED MAY 19, 1999, TO CHANGE THE MAXIMUM BUILDING HEIGHT FROM 30 FEET TO 40 FEET - DONALD LAFAVER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 19th day of May, 1999, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Donald LaFaver and Charles Miles, Jr., % Tuttle Applegate, Inc., 11990 Grant Street, Suite #304, Denver, Colorado 80233, for Change of Zone #522 from the A (Agricultural) Zone District to PUD (Planned Unit Development) District for eighteen (18) lots with R-1 (Residential) uses on the following described real estate, to-wit: Lot B of Recorded Exemption #2330, being part of the N1/2 NE1/4 of Section 16, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, on May 19, 1999, the Board conditionally approved the request of Donald LaFaver and Charles Miles, Jr., for Change of Zone #522 from the A (Agricultural) Zone District to PUD (Planned Unit Development) District for eighteen (18) lots with R-1 (Residential) uses, and WHEREAS, Donald LaFaver has submitted a request to modify the uses allowed in the PUD (Planned Unit Development) Zone District as approved by Resolution #991203, dated May 19, 1999, to change the maximum building height from 30 feet to 40 feet, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendation of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. A modification to increase the building height requirements from 30 to 40 feet in this Planned Unit Development Zone District is not contrary to the intent of this district. All Conditions of Approval of previously approved Change of Zone #522, will remain applicable to this site. 2. The amended PUD remains in compliance with Sections 27-6-120.D.2.a through 27-6-120.D.2.g. 2001-2958 .` /2 - AA-4'e(it y /71/3(1, Li/7d PL1303 AMENDED CHANGE OF ZONE #522 - DONALD LAFAVER PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Donald LaFaver for Amended Change of Zone #522 to modify the uses allowed in the PUD (Planned Unit Development) Zone District as approved by Resolution #991203, dated May 19, 1999, to change the maximum building height from 30 feet to 40 feet on the hereinabove described parcel of land be, and hereby is, granted. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 14th day of November, A.D., 2001, to become effective seven (7) days hence.
