RE: APPROVAL OF ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT
WITH SIEGRIST CONTRUCTION COMPANY AND AUTHORIZATION FOR
CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners has been pre-
sented a Road Maintenance and Improvements Agreement between
Weld County and Siegrist Construction Company, and
WHEREAS , the terms and conditions of said agreement are as
stated in the agreement, a copy being attached hereto and in-
corporated herein by reference, and
WHEREAS , after study and review, the Board deems it ad-
visable and in the best interests of the citizens of Weld County
to approve said agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado , that the Road Maintenance
and Improvements Alreement between Weld County and Siegrist
Construction Company be, and hereby is , approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be,
and hereby is , authorized to sign said agreement.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 27th day of
August, A.D. , 1984 .

COUNTY OF WELD, STATE OF COLORADO
ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT
THIS AGREEMENT, made and entered into this 27th day of August
1984, by and between the COUNTY OF WELD, STATE OF COLORADO, hereinafter called
"County" and SIEGRIST CONSTRUCTION COMPANY, hereinafter called "Owner" , and
WHEREAS, the Owner has applied to the County for a Use by Special Review
Permit, Case No. U. S. R. - 636:84:32, for an open-cut gravel pit located in
Section 2, Township 2 North, Range 68 West of the 6th Principal Meridian, and
WHEREAS, the gravel pit will generate an increase in heavy truck traffic,
and
WHEREAS, the existing County roads that serve the gravel pit will require
increased maintenance and improvements due to the increase in heavy truck
traffic, and
WHEREAS, the County and the Owner have reviewed the proposed maintenance
and improvements conditions and acknowledge they will enhance the accessibility
and safety of the roads that serve the gravel pit.
NOW, THEREFORE, in consideration of the mutual covenants and conditions
hereinafter set forth, the County and Owner mutually agree as follows :
1. The designated haul route that services the gravel pit is Weld
County Road 242 from the gravel pit ingress/egress point west to
the I-25 frontage road, and Weld County Road 24 from the gravel
pit ingress/egress point west to the I-25 frontage road. These
haul route restrictions shall be posted by the Owner at the gravel
pit exits , visible to all users .
2. No truck traffic generated from the gravel pit will be permitted
east on Weld County Road 242, except for occasional loads necessitated
by physical restrictions.
3. Should the Owner use Weld County 242 as ingress and/or egress from
the pit, the Owner agrees to improve that portion of Weld County
Road 242 from the ingress/egress point west to the I-25 frontage
road . The improvements will consist of six (6) inches of class 6
aggregate base course and three (3) inches of hot bituminous pavement
grading EX, all 24 feet wide plus four (4) foot wide gravel shoulders .
4. The Owner will furnish the necessary base material , hot bituminous
pavement, equipment, and labor to construct the improvements .
5. The County will inspect and replace any culverts that are in a
deteriorated condition or require extensions prior to paving,
and will be responsible for any required utility relocations .
6. The Owner agrees to excavate and patch any damage on the above
mentioned designated haul routes that is created by heavy truck
traffic from the gravel pit over the life of access points onto
Weld County roads .
7. At any time in the future during the course of the permit when road
damage along the designated haul routes has increased beyond the
point that patching can reasonably restore the road, the Owner will
cooperate with the County in the reconstruction of those parts of
the haul route. The details of construction and the amount of
aggregate base course required will be determined by sampling and
testing of the existing road by the Weld County Engineering
Department.
8. The Owner further agrees that should the existing structures within
the subject property be removed and mining commences in accordance
with the mining plan in this area, the Owner will straighten the
alignment of Weld County Road 241 within the limits of the property.
The existing Road 241 may be mined by the Owner and required
fill for the new alignment obtained from the operations overburden,
subject to being free of high clay content and organic material .
The reconstructed road section shall be constructed full right-of-way
width plus buffer zones with embankment slopes in conformance with
the typical section as shown on the mining plan. The Owner will
place a minimum of six (6) inches of class 6 aggregate base course,
twenty-four feet in width on the newly aligned road. The County
will be responsible for any required utility relocations .
9. All construction materials and methods will be in accordance with
the State Department of Highways, Division of Highways, State of
Colorado, Standard Specifications for Road and Bridge Construction,
1981 .
10. The County will supply testing and inspection for the construction.
11 . Access from one side of Weld County Road 241 to the other side will
be limited to one location having adequate signt distance in all
directions . The Owner will install and maintain stop signs at all
exit points .
12. Both the Owner and the County will be relived of all the terms of
this agreement related to Weld County Road 241 should this road be
vacated by the County, except that the designated haul route
restriction to the east will remain in effect.
IN WITNESS WHEREOF, the parties hereto have duly executed the agreement
the day and year first above written.
