We have no objections to the proposal, however, the applicant shall insure that the facility have an adequate, convenient, sanitary toilet and sewage disposal system according to the Weld County Code 30-2-10, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The Environmental Health Services Division was unable to locate a septic permit for the septic system serving the existing structure. An individual sewage disposal system is required for the dog training facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as "development standards": 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended)shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a"solid waste" in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Animal and food wastes, bedding, debris, and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards and nuisances are minimized. Such waste shall be removed at least weekly, or more frequently, from the facility and hauled by a commercial hauler. 4. Fugitive dust shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 6. All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and handled in a safe manner. The City of Greeley Planning Staff has reviewed the application, and it was presented to the City of Greeley Planning Commission on May 8, 2001, at their regular meeting. The Planning Commission approved of Staffs recommendation of compliance with the Comprehensive Plan,and wish to forward the following comments to the Weld County Planning Commission. r The City of Greeley Comprehensive Plan outlines growth areas that the City can either currently serve or expects to serve in the long-term future. The application is located in the City's Urban Growth Area, and is located adjacent to the Strategic Employment Development Corridor along U.S. Highway 34 and State Road 257. The application is also located within the City's Entryway Master Plan area,and the property in question is classified in that plan as a"Rural,Open, Vacant" character zone. Development in this area should be sensitive to these long-term plans. City Staff reviewed the application at the Administrative Review Team meeting on April 30, 2001, and had concerns about access, signage, parking, and the type of use (see Attachment A). Based on the application submitted and Staffs analysis,the City of Greeley Planning Commission found that the Use by Special Review was in compliance with the Comprehensive Plan. They recommended approval to the Weld County Planning Commission with the conditions that signage be limited to one 33 square foot sign up to six feet tall adjacent to each highway,that parking areas be paved with asphalt or concrete for employees and visitors,that safe traffic flow in and out of the property will be provided in accordance with CDOT's requirements,and that a separate USR be applied for in the even that ownership changes or that the current owner wishes to include additional animal units in the use. ATTACHMENT A ADMINISTRATIVE REVIEW TEAM COMMENTS: The following comments were received from the Administrative Review Team on Monday, April 30, 2001: Public Works Transportation • Given the location of the entrance from U.S. 34 Business, and change in use, the following needs to be considered: 1. The impact of the entrance being in what appears to be an accel/decel movement (the accel from US 34, and decel to turn into the entrance)taking place in a through lane. 2. The need for an exclusive northbound right turn lane to turn into the property. 3. The distance the entrance is from the westbound off ramp leading to Highway 257. • A scaled site plan is needed showing US 34 Business, Highway 257, the entrance, and lot. CDOT will be involved in the entrance impact. Future traffic volume increases and the high speed of 257 traffic, and turn moves out of, and into the site are critical and need to be addressed as to adequacy of the present entrance and possible changes. Public Works Design/Review • Applicant should be advised of current plans to close Highway 257 Spur at Highway 257. Planning • Access off of Highway 257 needs to be improved. Separate ingress and egress could allow for proper traffic flow. • Parking areas need to be defined. According to the Development Code, kennels require 1 space for every 400 sq. ft. of gross floor area. No parking is shown on the site plan. • Applicant is required under the water tap agreement to annex if requested by the City. At this time,annexation is not required. Use of property of the kennel would be a more proper use than what would be allowed if the property was annexed. • Type of use would only be allowed in C-H, I-L, I-M, or I-H zone within the City Limits. If property is ever annexed, an moratorium on the use on that property would be appropriate. • All signage should be in conformance with the City's Development Code. The property sits in the primary entryway and signage should be treated according to the Entryway Master Plan. A 33 sq. ft. sign that was 6'tall would be acceptable on the frontage of both Highway 257 and Highway 34.
