Subject: Enviro-Cycle, LLC—Third Quarter Inspection
Ms. Etcheveny,
We are in receipt of your letter dated August 3, 2001. As I indicated in my voice-
mail to you, this letter was never sent to the address indicated on the letter(P.O. Box 117,
LaSalle, Colorado 80645). Instead,this letter was sent via facsimile to Mr. Cervi in
Sterling, Colorado on or around August 8, 2001. In order to ensure a prompt response to
your inquiries, please send copies of all such correspondence to my attention at Enviro-
Cycle.
In your August 3 letter, you indicated that Enviro-Cycle was in substantial
compliance with the teens of its permit with Weld County. However, you asked that
action be taken regarding two specific items. Each of these items is addressed below:
First, you asked that Enviro-Cycle "provide evidence" that a drum of D-576
Demulsifier"is being stored according to the manufacturer recommendations." On
Tuesday August 7th, I contacted Eudora,the manufacturer of the D-576 Demulsifier,
regarding the storage conditions for this product. Appended is a letter I received from
Eudora in response to my inquiry. As you can see, we are in compliance with the
"manufacturer recommendations" concerning the storage of this product. Please let me
know if you contend otherwise.
Second, your letter sets forth a request on behalf of Bethany Salzman of the
Department of Planning Services regarding"what changes(in detail) had been made to
the facility." I have attempted on several occasions to contact Ms. Salzman regarding
any issues the Department of Planning Services may have with regard to the facility. On
August 13, 2001, I spoke with Ms. Salzman about your request. During this
conversation, Ms. Salzman stated that Enviro-Cycles had provided all requested
information and that no additional information was required. Unless we hear from you to
the contrary, we will handle all further discussions regarding this matter directly with Ms.
Salzman.

In addition to the above, the Quarterly Report dated August 1, 2001 states that
there were "no records on site" regarding the approximate number of barrels of brine per
day taken in by Enviro-Cycle. This statement is not accurate. The tickets maintained by
Enviro-Cycle for each load of brine demonstrate the approximate number to barrels of
brine per day taken in at the facility. Please let us know if you would like to inspect these
records.
Although not addressed in your recent letter, we also would like to confirm a few
matters raised during our recent discussion regarding Enviro-Cycle's hours of operation.
During this discussion, you agreed that it is acceptable for Enviro-Cycle to unload trucks
that are inside Enviro-Cycle's facility before 7:00 p.m. so long as Enviro-Cycle closes the
gates and does not allow any additional trucks to enter the facility after 7:00 p.m. You
stated that this practice is consistent with the practices of landfills in Weld County. In
order to demonstrate our compliance with the aforementioned, we are keeping a log of all
the trucks that enter the facility after 6:30 p.m., and recording the time they entered and
the time that they left.

Re; Questions on proper storage of D-576 demulsifler.
This product is a flammable liquid. It should be stored away from open flames or other
heat or spark generating sources. The exposure of atmospheric sunlight to the container
will have no effects on the product or the performance of the product. The location and
placement of this product at your facility should not cause any environmental or
hazardous complications.
