March 31, 2000 Weld County Department of Planning Services Mr. Kim Ogle, Planner 1555 N. 17th Ave. Greeley, CO 80631 RE: Weld County Referral - Carlson Farms Estates Dear Mr. Ogle: The Greeley-Weld County Airport Authority (Authority) has reviewed the Weld County Referral received on March 27th, 2000 in reference to a Change of Zone for Minor Subdivision to Estate Zone District for Carlson Farms Estates. The following information and comments are provided by the Authority. 1. The proposed development is located approximately 1 mile from the western boundary of the Greeley-Weld County Airport, and approximately 1.2 miles from the approach end of Runway 9 at the airport. Runway 9 is presently the predominant and preferred use runway at the airport. 2. The proposed development is within the boundaries of the Airport Zoning Overlay District and the Runway 9 Critical Zone. Both of these areas have been adopted by Weld County through the approval of resolutions by the Weld County Board of County Commissioners. Most notably, the Runway 9 Critical Zone in which this proposed development is located was established in 1978, through the adoption of the Airport Master Plan. More recently, the Airport Master Plan Update Study, which also depicted the boundaries of this critical zone on the airport Land Use Plan, was approved by resolution of the Board of County Commissioners on January 11th, 1994. 3. The Authority is currently in the process of a PUD re-zoning effort on the airport. While zoned PUD since 1992, a PUD Change of Zone to C-3 through 1-3 uses on all airport property was approved by the Weld County Planning Commission, and subsequently the Board of County Commissioners in 1999. The PUD Final Plat is scheduled to be submitted in mid 2000. Mr. Kim Ogle March 31, 2000 Page 2 4. The development proposed would have no impact on the Airport Zoning Overlay District, as this district exits primarily to limit the height of objects around the airport that could interfere with the airport's navigable airspace. The height of objects typical to the proposed development would likely not penetrate this protected airspace. 5. The development proposed would have a negative impact on the Runway 9 Critical Zone. The critical zone is located and configured in strict accordance with Federal Aviation Administration (FAA) Regulations, and was established as a condition of Federal Grant Assurances that Weld County is subject to. These assurances .are specifically written to ensure that a government jurisdiction which accepts federal funds for improvements to a public airport enacts the necessary zoning restrictions around such airport to eliminate the possibility of any future non-compatible land uses that could have negative impacts on the airport. 6. The FAA includes residential uses, as well as schools and churches, in its lis° of non-compatible land uses around public airports. 7. The reason these uses are considered non-compatible within a runway critical zone is due to the existing and/or long term negative impacts that aircraft operations have on such properties. The fact that an airports existence precedes that of any non- compatible land use has not historically been legal cause for dismissal of a nuisance lawsuit against any airport in the United States, hence the FAA s requirement for appropriate zoning restrictions to eliminate any possibility of such nuisance claim lawsuits that could affect the viability of the airport through curtailed flight procedures. 8. The location within the critical zone of the proposed development is underneath and/or near the intersection of two primary aircraft traffic pattern corridors. The development is directly beneath the existing and future final approach path for existing Runway 9, and near the intersection of the downwind leg for the airports new primary runway currently under construction, which is scheduled to open in 2000. Regardless of which runway is active at the airport at any given time, almost every aircraft landing or taking off from the airport will directly overfly this proposed development. The airport currently reports its annual aircraft operations at 165,000 landings and takeoffs per year. Mr. Kim Ogle March 31, 2000 Page 3 The Greeley-Weld County Airport Authority recommends that Weld County deny the request for a Change of Zone to an Estate Zone District, as the development would establish a land use which is non-compatible with the Land Use Plan of the Greeley-Mid County Airport,which has been adopted by Weld County. The current zoning of the airport property, and the plans for commercial and industrial uses as a result of the current airport expansion program add to the non-compatibility of the proposed development. In the event that Weld County approved of this Change of Zone request, it would be strongly encouraged that such approval be conditional upon the granting of an Avigation Easement over the entire PUD from the property owner(s) and/or developer to the Authority. While such an easement would assist in protecting the airport from future nuisance claims, it would however still permit a non-compatible land use in one of the airport's critical zones. It should be noted that the recommendation of the Authority contained herein is based solely upon the non-compatible residential use currently being proposed. The Authority is not objectionable to compatible land use development, which would include most commercial and industrial uses, and in fact encourages such development in this proximity to the airport. P ' OJECT BACKGROUND AND OVERVIEW: The proposal is for a change of zone from the Agriculture district to a Planned U nit Development (PUD) district to allow a seven-lot residential development in unincorporated Weld County. Lots two through six range in size from 1.6 to 1.9 acres in area. Lot one is 4.1 acres and lot seven is 2.2 acres in area. Outlot "A" is to provide 3.7 acres of private co.-rumor area for the dcvt: opment. Lot one contains an existing house and has direct access to WCR 6:2. Lots two through six are proposed to have access on a private gravel road that parallels WCR 62. Lot seven would have direct access to WCR 41.5. Water is to be supplied by the North Weld Water District. Sewer service would be provided by private septic systems (Attachments C & I)) This is the second step of this development application. The first step consisted of a sketch plan. That plan was reviewed by the City of Greeley at the staff level. That review found that the proposed sketch plan did not meet the recommended density standards for the unincorporated areas around the City of Greeley of one unit per ten acres. In addition, it was found that the subdivision would be difficult to incorporate into future urban growth due to the size and configuration of the lots, the use of private septic systems and the private access road (Attachment E). Runway Critical Areas - Residential uses should not be permitted within this area.. Staff Comment: The property is in the Greeley-Weld County Airport runway critical area as identified on the 1980 Weld County Airpon: Environment Assessment for the year 2000. The Comprehensive Plan states that the airport is an important part of the transportation system for the Greeley-Weld County area and functions as an important component of the regional economy. The airport has recently sought to increase its role in this economy through runway and building expansion, so there is a need to carefully plan land uses to avoid incompatible development in the area around the airport. The Comprehensive Plan states that residential uses should not be allowed in the runway critical areas. Commercial and industrial uses can be allowed in this area only by a special permit. The proposed residential zoning does not conform with this provision of the Comprehensive Plan. ADMINIS I'I4ATIVE REVIEW TEAM: The Administrative Review Team informally reviewed this item on March 15, 2000. The Union Colony Fire Authority concurred with the Comprehensive Plan's prohibition on residential development in the runway critical area. The Fire Authority also sist d that the property was outside the response time agreement area and if the proposal is approved the homes must be sprinklered. Additionally, the Fire Authority stated that the roadway must be paved or improved with a six-inch lift of type six road base. The Public Works Department stated the additional right-of-way must be dedicated instead of reserved. PLANNING STAFF RECOMMENDATION: Planning staff recommends that the Planning Commission find that the Carlson Farms Estates PUD change of zone application for a residential development is located iti the City of Greeley's Long Range Expected Growth Area and within the Greeley-Weld County Airport runway critical area, that the proposal is not consistent with the City's Comprehensive Plan, and recommend that the Weld County Board of County Commissioners deny this request. Summary 3 Carlson 'NCR The subject property is located in the City of Greeley's Long Range Expected Growth Area (LREGA). The LREGA includes those lands anticipated to accommodate the City of Greeley's urban development over the next two to three decades. The property is also in the Greeley-Weld County Airport runway critical area as identified on the 1980 Weld County Airport Environment Assessment for the year 2000 (Attachment B). It its the practice of the City of Greeley Planning Commission to review Weld County requests principally for conformance with the City's Comprehensive Plan policies. Specific design issues are addressed only to the degree necessary to ensure consistency with the City's Comprehensive Plan and Development Code. Z-541 NAME: Carlson Farms Estates The Weld County Health Department has reviewed this proposal. A member of our staff has also observed the site. The application has satisfied PUD Ordinance No. 197 in regard to water and sewer service. Water will be provided by the North Weld County Water District and sewer will be provided by septic systems. The proposed lot sizes (minimum of 1.62 acres) and the overall density of one septic system pe 2.5 acres meets current Departmental policy. In a memo concerning this sketch plan dated October 4, 1999 the Department requested that pi inary and secondary septic system envelopes be designated on each lot and that there be language included in the development covenants for the preservation and/or protection of the second abs )rptior field envelope for future use. Additionally, both septic envelopes must meet current minimum setbacks to irrigation ditches (100 feet) and drainage swales (25 feet), The Department recommends that the following conditions be a part of any condition 1. The applicant shall obtain water service from the North Weld County Water District. 2. Primary and secondary septic system envelopes snail be designated on each lot. Each ern elope must meet minimum current setbacks as specified in the Weld County Individual Sewage Disposal System Regulations. 3. Our comments and requirements are as fol ows: External Roads: WCR 62 and 41 .5 are designated as local roads in the Weld County Comprehensive Transportation plan and the Greeley Transportation plan. Each road has The required 60 of right-of-way. The City of Greeley is, however is asking for an additional 20 feet for both streets as the nature of these roads may change. The developer will he required to make a reservation for this 20 feet on both 62 and 40.5. Internal Streets: Internal local streets require 60 feet of right-of-way. The frontage road alignment of the internal streets is not desirable and can only be allowed when adequate separation is provided. Adequate separation will include landscaping to prevent headlgnt glare and sufficient area for a passenger car to turn perpendicular to the external street at the future right-of-way line. All lots in a new subdivision should access off the internal system. Lots 1, 7 and A, do not meet this criteria. A realignment of the internal roadway system is desirable `he developer is encouraged to call the Public Works department to discuss alternatives. Drainage: The drainage statement was submitted. A complete drainage report meeting the VVe d County requirements will be required before the final plat can be signed. Traffic Report: A traffic impact study will not he required.
