The Weld County Department of Public Works has reviewed this PUD change of Zone request. Comments made
during this phase of the application process may not be all inclusive,as other concerns or issues may arise during
the remaining application process.
COMMENTS:
External Roadways: WCR 53 is designated as a local road in the Comprehensive Transportation Plan. The
developer shall dedicated the 30 feet east of the section line with the plat to be recorded. The bus/mailbox pull
off will require additional right-of-way dedication. The developer has submitted a proposed layout to the Public
Works Department for review. It is acceptable. All landscaping in the intersection sight distance triangle must
be less than 3.5 feet high at maturity. Presently several trees and a 6 foot high monument sign are proposed to
be located in the sight distance triangle. They need to be located outside the sight distance triangle.
Internal Roadways: The developer has requested a waiver of the internal street paving requirement since the
external roadway is not paved.The Public Works Department concurs. The minimum roadway width is 26 feet
and the surface shall be 4 inches Aggregate Base Course, Class 6. A Stop Sign and street name sign will be
required at the intersection. The accesses to lots 4 and 5 will cross the irrigation tile line. The applicant has
proposed to replace a 40'section of the irrigation tile line with schedule 120 plastic pipe at each access, which
is acceptable. These locations should be clearly marked to insure construction traffic crosses only at these
locations and that accesses are built at these locations.
Storm Water: The developer should be careful when setting the roadway grades, because of possible
interference with the underground irrigation tile. The roadway borrow ditches may impact this irrigation system
if the roadway is set to low. A full drainage report will not be required for this project. The design of the irrigation
crossings will be evaluated with the roadway plans as part of the final plat process.
RECOMMENDATION: Approval
DEVELOPMENT CONDITIONS (If Approved):
❑ The internal roadway will be gravel, 26'wide with 4" of Aggregate Base Course, Class 6.
❑ The 30'of right-of-way along WCR 53 is to be dedicated to the County on the final plat along with right-of-
way for the bus/mailbox pull off.
❑ A stop sign and street name sign be placed at the intersection.
❑ Landscaping and signs within the intersection sight distance triangle shall be less than 3.5 feet.
❑ Accesses for Lots 4 and 5 shall have 40'plastic pipe sections to replace the existing tile irrigation line and
the locations shall be clearly marked.
❑ Roadway plan and profile plans shall be provided as part of the final plat submittal.

The Weld County Department of Public Health and Environment has reviewed this proposal.
The application has satisfied Chapter 27 of the Weld County Code in regard to water service. Water is
proposed to be provided by the North Weld County Water District. A water service agreement from North
Weld County Water District has been provided in the application materials.
The application has satisfied Chapter 27 of the Weld County Code in regard to sewer service.
Sewer will be provided by individual sewage disposal systems. The minimum proposed lot size of 4.72 acres
coupled with the overall density of one system per 6 acres meets the current Department policy.
The initial impact plan submitted in the application materials appears to address all impacts as required by
Section 27-6-40 of the Weld County Code.
The Department recommends that septic envelopes be preserved in a manner that will allow it's future use
in the development covenants. Specifically, the development covenants should address activities such as
landscaping (i.e. planting of trees and shrubs) and construction (i.e. auxiliary structures, dirt mounds, etc.)
should be expressly prohibited in the designated septic envelopes.
The Department recommends approval with the following conditions:
1. Water service shall be obtained from the North Weld County Water District.
2. A Weld County Septic Permit is required for each proposed septic system and shall be installed
according to the Weld County Individual Sewage Disposal System Regulations. Each septic system shall
be designed for site-specific conditions,including but not limited to maximum seasonal high groundwater,
poor soils, and shallow bedrock.
3. Language for the preservation and/or protection of the second absorption field envelope shall be placed
in the development covenants. The covenants shall state that activities such as landscaping(i.e.planting
of trees and shrubs)and construction(i.e.auxiliary structures,dirt mounds,etc.) are expressly prohibited
in the designated absorption field site.
4. The applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the
Colorado Department of Public Health and the Environment, if required. Silt fences shall be maintained
on the down gradient portion of the site during all parts of the construction phase of the project.
5. During development of the site, all land disturbance shall be conducted so that nuisance conditions are
not created. If dust emissions create nuisance conditions, at the request of the Weld County Health
Department, a fugitive dust control plan must be submitted.
6. In accordance with the Regulations of the Colorado Air Quality Control Commission any development
that disturbs more than 5 acres of land must incorporate all available and practical methods which are
technologically feasible and economically reasonable in order to minimize dust emissions.
7. If land development creates more than a 25 acre contiguous disturbance, or exceeds 6 months
induration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution
emissions notice, and apply for a permit from the Colorado Department of Public Health and
Environment.
8. "Weld County's Right to Farm" as provided in Appendix 22-E of the Weld County Code shall be placed
on any recorded plat.

The proposal is built around a private road access. The proposed name of Mason View
Drive is acceptable as it is not in use at any other location. The developer needs to be aware the
Sheriffs Office has significant limitations regarding traffic enforcement on private roads in the
event of speeding or other use which may not conform to traffic laws on public roads.
The road sign with name and address range needs to be prominently displayed at the
intersection with CR 53. All individual addresses must also be prominently displayed at the
individual residence access to aid emergency responders particularly during hours of darkness.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County Commissioners
or as indicated by growth not considered at the time the plan was developed. I have no other
comments on this proposal.

This letter is to confirm our understanding as to how your planned unit
development will affect the Eaton School District Re-2. As per our response to
the Weld County Planning Department, the District has established a formula to
calculate a land or cash amount in lieu of land dedication to be paid to the
District.
The amount due for this development is $3,405.00 or $681.00 per lot as shown in
the attached calculation. The amount will need to be remitted to the District
within one week of the date each lot is sold.

Dear Ms. Lockman:
We have reviewed the above referenced proposal to subdivide a 30.9-acre
parcel into 5 single-family residential lots. The proposed water source is the North Weld
County Water District (District) and a signed water service agreement was included. A
Water Supply Information Summary was not included in the referral materials.
The District will supply treated water to the development, charging fees for the
water supply on a per tap basis payable prior to activation of the tap. Based on current
records on file in this office, the District currently has an adequate uncommitted water
supply to provide the water associated with this project.
Pursuant to Section 30-28-136(1)(h)(II), C.R.S., the State Engineer offers the
opinion that the District has submitted sufficient evidence documenting that the proposed
water supply can be provided without causing material injury to existing water rights and
the supply is expected to be adequate.
