FOR A PUBLIC AND QUASI PUBLIC BUILDING (CHURCH) IN THE A(AGRICULTURAL)
ZONE DISTRICT - FOURWAY BAPTIST CHURCH
A public hearing was conducted on May 9, 2001, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 20, 2001, and duly published April 25, 2001,
in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request of
Fourway Baptist Church for a Site Specific Development Plan and Use by Special Review Permit
#1319 for a Public and Quasi Public Building (church) in the A (Agricultural) Zone District. Lee
Morrison, Assistant County Attorney, made this a matter of record. Chair Pro-tem Vaad advised
the applicant's representative, Thomas Haren, AgPro Environmental Services, I_LC, that the
applicant has the option of continuing this matter to a date when the full board will be present.
However, if they decide to proceed today, it will require three affirmative votes, or in the case of a
tie vote, Commissioner Geile will listen to the record and make the determining vote. Mr. Haren
indicated the applicant would like to proceed today.
Kim Ogle, Department of Planning Services, presented a brief description of the proposal, location
of the site, and surrounding uses. He stated the church will be serviced by an existing well and
septic system. Mr. Ogle stated five referral agencies offered comments, the Hudson Fire
Protection District did not respond, and he received no correspondence from the surrounding
property owners. Mr. Ogle entered the favorable recommendation of the Planning Commission
into the record as written, and in response to Commissioner Vaad, stated the nonpermitted mobile
home behind the church is used as a classroom; however, it will be removed or permitted when
construction begins.
Trevor Jiricek, Weld County Department of Public Health and Environment, stated the design of
the septic system does not comply with State policy regarding sizing. He explained the septic
system is designed for 250 people; however, the application indicates there could be as many as
400 people. Mr. Jiricek stated Development Standard#12 states once the congregation reaches
254, the church must upgrade the septic system to comply with State policies. In response to

Commissioner Vaad, Mr. Jiricek stated the systems should be designed to the maximum
anticipated load on any given day, regardless of whether the site is only used twice a week.
Responding to Commissioner Jerke, Mr. Jiricek explained standard septic systems do not factor
in showers, so the lack of showers at a church should not be a factor in downsizing a system. Don
Carroll, Department of Public Works, stated Weld County Roads 41 and 22 are designated as
collector status roads requiring 80 feet of right-of-way; however, there is only 60 feet at this time.
He further stated the roads are maintained by Weld County, and the current traffic counts indicate
276 on Weld County Road 22, and 1,617 on Weld County Road 41. Mr. Carroll stated the
conditions require the applicant to reserve an additional 10 feet of right-of-way for both roads.
Thomas Haren, AgPro Environmental Services, LLC, represented the applicant and stated
members of the congregation are present for questions. He thanked the staff and Planning
Commission for working with the applicant to come to a compromise regarding the septic system,
because this has been a long process. Mr. Haren stated some of the conditions being placed on
the applicant are the requirements of Weld County Health Department staff, not the State Health
Department. He further stated the applicant has resolved the initial concerns expressed by the
Department of Public Works.
No public testimony was offered concerning this matter.
In response to Commissioner Vaad, Mr. Haren stated at the Planning Commission hearing there
was a show of hands indicating a favorable response for the proposal. He further stated the letter,
dated April 2, 2001, was signed by various members supporting the application. Responding to
Commissioner Vaad, Mr. Haren stated he and the applicant have reviewed and agree with the
Conditions of Approval and Development Standards.
Commissioner Jerke moved to approve the request of Fourway Baptist Church for a Site Specific
Development Plan and Use by Special Review Permit#1319 for a Public and Quasi Public Building
(church) in the A (Agricultural)Zone District, based on the recommendations of the Planning staff
and the Planning Commission, with the Conditions of Approval and Development Standards as
entered into the record. The motion was seconded by Commissioner Masden, and it carried
unanimously.
