To: Whom It May Concern: Attached, please find a PUD Change of Zone application for the above described property. Included in the application submittal are the following items: • 7 copies plus the original Change of Zone Application Materials; • 7 copies plus the original Change of Zone Plat and cover sheet; • 7 Copies plus the original Specific Development Guide; • A certified List of the names, addresses and the corresponding parcel identification i-. numbers of property owners within five hundred feet of subject development. • A certified list of the names and addresses of mineral owners and lessees of mineral owners on or under the parcel of land; • A check in the amount of$2,000.00 for the PUD Change of Zone Review. The PUD Change of Zone proposes to modify the Bulk Requirement of the existing PUD R-1 Zoning to allow for a maximum building height not to exceed 40 feet. Due to the size of the homes being build, plus the requirement that the bottom of the foundation be I foot above the base flood elevation, creates a hardship in the design and construction. The additional height should have little or no impact on the surrounding properties. No other zoning changes are being requested. Specific Development Guide Components: COMPONENT FOUR-SITE DESIGN A. The PUD is a 75 acre parcel make up of a 46 acre lake, 18 home sites and approximately ten acres of open space, hiking trails and roadways. The bulk of the home sites are set back at least 1000' from the nearest public street and neighboring homes. Due to the property lying within the 100 year flood plane all homes are required to be built with the lowest floor(top of footing) being 1 foot above the base flood elevation. B. The Development is consistent with Weld County Comprehensive Plan which encourages planned and managed growth within the MUD area. R.Policy 6, in the Comprehensive Plan states that conservation of natural site features, such as topography, vegetation and water course should be considered in the project design. The incorporation of the existing lake into EXHIBIT 13 the overall design and use of the development is in direct compliance with this policy. Additionally, PUD Goal 2 states that creative approaches to land development should be encouraged which will result in environments of distinct identity and character. C. The proposed amendment, to the zoning bulk requirement, would increase the maximum height of any structure from the present limit of 30 feet to a maximum of 40 feet. No other changes to the R-1 zoning is proposed. Due to the size of the lots, and the distance from any other home sites out side the development,the extra height will not impact the neighborhood. D. The proposed uses within the PUD Zone District will be compatible with the surrounding land uses. The surrounding properties are zoned agricultural and when developed, as identified in the MUD Structural Land Use Map 2.1,will compliment the PUD, with low residential and open spaces uses. There are at least 3 other parcels in the area that are scheduled for mining which, when completed, will lend themselves to similar type development. E. The subject property is located with in the 100 year flood plane. A study was completed by Tuttle Applegate to determine the base flood elevation and a flood hazard permit has been issued. All homes must be built with the lowest floor being 1 foot above the base flood elevation. COMPONENT SEVEN -MUD INPACT. The PUD is within the MUD Plan area. The PUD adheres to the Structural Land Use Map 2.1, by implementing low intensity residential uses. The development is also consistent with the Structural Land Use Map by preserving the area identified as Limiting Site Factors as open space. COMPONENT EIGHT-INTERGOVERNMENTAL AGREEMENT INPACTS. The subject property lies within the IGA which has a height limit of 35 feet. Since there are no homes, or home sites lying close, in any direction of this property,the impact of the additional height would have little or no impact to the surrounding properties.
