HomeMy WebLinkAbout20012303.tiff RESOLUTION RE: APPROVE PARTIAL CANCELLATION AND RELEASE OF COLLATERAL FOR LIGHTHOUSE COVE, PHASE II - DONALD LAFAVER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated November 3, 2000, the Department of Planning Services staff did approve the application of Donald LaFaver, 2185 Pinedrop Lane, Golden, Colorado 80401, for a Planned Unit Development Final Plan, S #578, on the following described real estate, to wit: N1/2 NE1/4 of Section 16, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on January 8, 2001, the Board of County Commissioners of Weld County, Colorado, did approve an Improvements Agreement According to Policy Regarding Collateral for Improvements (Private Road Maintenance) for Lighthouse Cove Phase II, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Lighthouse Cove, LLC, do Donald LaFaver, with terms and conditions being as stated in said agreement, and accepted a Promissory Note, in the amount of$350,000.00, secured with a Deed of Trust, dated November 22, 2000, and WHEREAS, on June 18, 2001, the Board deemed it advisable to release the Promissory note, in the amount of$350,000.00, to be replaced with a Certified Check, in the amount of $306,902.90, which was consistent with the amount determined necessary by staff for the proposed improvements, and WHEREAS, staff from the Weld County Department of Public Works has conducted a visual inspection of the project and recommends cancellation and release of said collateral, with 15 percent of the paving cost to be retained for a one-year period, and WHEREAS, the Board of County Commissioners deems it advisable to cancel and release $295,675.40, with $11,227.50, to be held for the period of one year. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that collateral in the amount of$295,675.40 be, and hereby is, canceled and released. On August 6, 2001 Donald G. LaFaver (2185 Pinedrop Lane, Golden, Colorado) requested a partial release of Collateral in the amount of$295,675.40. The remaining amount of$11,227.50 is the equivalent of 15% of the paving cost ($74,850.00). The collateral posted was for improvements associated with Lighthouse Cove Phase II PUD (S- 578) located in part of the N2 NE4 of Section 16, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado and one mile south of State Highway 119 and west of and adjacent to WCR 7. Weld County Public Works Department recommends the release of the transportation collateral for site grading, street grading, street base,street paving, curb, gutter, sidewalks, and all but 15% of the paving item. In the Improvements Agreement, item#8.1.5 and 8.1.6, it states that 15% shall be retained for a period of one year. At the end of one year and if no distress or repairs are needed to the asphalt, the 15% collateral ($11,227.50) shall be released. All other non-transportation items shall be verified by Planning Services prior to release.
