HomeMy WebLinkAbout800549.tiff RESOLUTION RE: SUBMITTING TO THE QUALIFIED ELECTORS OF THE COUNTY OF WELD, STATE OF COLORADO, THE REPEAL AND RE-ENACTMENT OF SECTION 4-3 OF ARTICLE IV OF THE HOME RULE CHARTER FOR WELD COUNTY, COLORADO DELETING THE REQUIREMENT THAT THE DIRECTOR OF PUBLIC HEALTH BE A LICENSED MEDICAL DOCTOR AND ESTABLISHING THE POSITION OF CHIEF OF MEDICAL SERVICES. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board feels that it is in the best interests of Weld County that a certain provision of the Home Rule Charter for Weld County, Colorado be repealed and re-enacted with amend- ments, and WHEREAS, Section 30-11-506 , C.R. S. 1973 and Section 17-1 of Article XVII of the Home Rule Charter requires that a resolution be adopted by the Board submitting the proposed amendment to the qualified electors. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado: Section 1. At the next general election to be held on November 4 , 1980, there shall be submitted to the qualified electors of the County of Weld, State of Colorado, for their approval or rejection the following amendment to the Home Rule Charter for Weld County, Colorado, to-wit: Section 4-3 of Article IV of the Home Rule Charter for Weld County, Colorado is hereby amended to read as set forth in Exhibit "A" , a copy of which is attached hereto and incor- porated herein by reference. Section 2 . Each elector voting at said election and desirous of voting for or against said amendment shall cast his vote as provided by law either "Yes" or "No" on the proposition: "Shall Section 4-3 of Article IV of the Home Rule Charter for Weld County, Colorado be repealed and re-enacted with amendments to provide that the Director of Public Health need not be a medical 800549 doctor but must possess the Degree of Master of Public Health, and providing for the establishment of the Office of Chief of Medi- cal Services, and setting forth the duties of each such office?" Section 3 . The votes cast for the adoption or rejection of said amendment shall be canvassed and the result determined in the manner provided by law, and if a majority of the electors voting on the question shall have voted "Yes" , the said amendment shall become a part of the Weld County Home Rule Charter. Steinmark DATE PRESENTED: September 29 , 1980 EXHIBIT "A" Section 4 - 3 -- Department of Health Services (A) Division of Public Health (1) OFFICERS - APPOINTMENT - QUALIFICATIONS (a) THERE IS HEREBY ESTABLISHED THE OFFICES OF DIRECTOR OF PUBLIC HEALTH AND CHIEF OF MEDICAL SERVICES. SUCH OFFICERS SHALL BE APPOINTED BY THE BOARD UPON CONSULTA- TION WITH THE BOARD OF HEALTH. (b) THE DIRECTOR OF PUBLIC HEALTH SHALL SERVE AT THE PLEASURE OF THE BOARD, SHALL HOLD THE DEGREE OF MASTER OF PUBLIC HEALTH IF HE IS NOT A MEDICAL DOCTOR AND SHALL POS- SESS SUCH OTHER QUALIFICATIONS AS THE BOARD MAY REQUIRE. (c) THE CHIEF OF MEDICAL SERVICES SHALL SERVE AT THE PLEASURE OF THE BOARD, SHALL BE LICENSED OR ELIGIBLE FOR LICENSURE TO PRAC- TICE MEDICINE IN THE STATE OF COLORADO, AND SHALL POSSESS SUCH OTHER QUALIFICATIONS AS THE BOARD MAY REQUIRE. (d) THE OFFICES OF DIRECTOR OF PUBLIC HEALTH AND CHIEF OF MEDICAL SERVICES MAY BE FILLED BY THE SAME PERSON PROVIDED SAID PERSON MEETS THE QUALIFICATIONS OF EACH OFFICE SET FORTH HEREIN. (e) THE POSITION OF DIRECTOR OF PUBLIC HEALTH SHALL BE A FULL-TIME POSITION. (f) THE CHIEF OF MEDICAL SERVICES MAY BE EMPLOYED ON A PART-TIME OR FULL-TIME BASIS OR MAY BE EMPLOYED BY CONTRACT. (2) The Director of Public Health shall : (a) Have-all-petaers-ane-duties-new-preblded-er as-herea ter-atitheraed-tp-stae-law- er health-departments-in-Eelere4e- PERFORM ALL FUNCTIONS AND EXERCISE ALL POWERS RELATING TO COUNTY HEALTH DEPARTMENTS WHICH ARE NOW OR MAY HEREAFTER BE AUTHORIZED BY STATE LAW; PROVIDED, HOW- EVER, THAT FUNCTIONS WHICH, UNDER STATE STATUTE, REQUIRE LICENSURE AS A MEDICAL DOCTOR SHALL BE PERFORMED BY THE CHIEF OF MEDICAL SERVICES . (c) Cooperate and work jointly with the Commis- sioner assigned to the Department of Health Services on all county health related activities . (d) Make recommendations to the Board fer-the pnrpese-ef-helpng IN ORDER to eliminate and avoid the duplication of services in county health related areas . (e) Evaluate all health programs that affect Weld County . (f) Cooperate with the Commissioner assigned to the Department of Health Services, in order to plan, cooperate and contract with other county health agencies so that all SUCH programs benefit from the combined use of COUNTY facilities and staff . (g) Work with regional , state and federal authorities relating-to-pubi4 e-heeith-pre- grams IN ALL MATTERS PERTAINING TO PUBLIC HEALTH in Weld County. -2- (h) Report at least annually to the Board on all matters set forth above. (i) Perfotm such OTHER functions and duties as the Board shall direct. (2 . 1) THE CHIEF OF MEDICAL SERVICES SHALL: (a) PERFORM SUCH FUNCTIONS AND EXERCISE SUCH POWERS RELATING TO COUNTY HEALTH DEPARTMENTS AS STATE STATUTE SPECIFICALLY PROVIDES MUST BE PERFORMED OR EXERCISED BY A MEDICAL DOCTOR. (b) PERFORM SUCH OTHER FUNCTIONS AND DUTIES AS THE BOARD SHALL DIRECT. -3- Hello
