A public hearing was conducted on October 17, 2001, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated September 28, 2001, and duly published October 3,
2001, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request
of L. Blake Nelson for a Site Specific Development Plan and Use by Special Review Permit#1302
for a Commercial Roping Arena in the A (Agricultural) Zone District. Lee Morrison, Assistant
County Attorney, made this a matter of record. Monica Mika, Director of Planning Services,
presented a brief summary of the proposal and entered the favorable recommendation of the
Planning Commission into the record as written. Ms. Mika gave a brief description of the location
of the site and surrounding uses. She stated seven referral agencies responded favorably or
proposed conditions of approval, three referral agencies did not respond, and no correspondence
has been received from the surrounding property owners. Ms. Mika stated the pending violation
case will be closed upon approval of this Use by Special Review Permit, and added the access
along the Firestone Trail and the issue of potable water have both been addressed by the
applicant. Ms. Mika stated the applicant is proposing to modify Development Standard #11 to
state,"The applicant shall provide bottled water or tap water for patrons." They are also requesting
Development Standard#21 be amended to allow operation on more than two evenings per week,
not to extend beyond 12:00 a.m. In response to Commissioner Jerke, Ms. Mika stated the narrow
area is an approved access and any questions regarding the access along the Firestone trail, can
be addressed by the applicant.

Responding to Chair Geile, Char Davis, Department of Public Health and Environment, stated a
simple Manure Management Plan is being required to ensure the applicant prevents any runoff
from the property. Ms. Davis stated because there are no permanent structures on the property,
the language for Development Standard #10 can be deleted. Don Carroll, Department of Public
Works, stated there is an access to the site from Weld County Road 26; however, during his site
inspection he noted there may be some complications in crossing the ditch. Mr. Carroll stated the
applicant currently uses the railroad right-of-way or the Firestone Trail to access the site. He stated
the applicant has indicated there is an agreement with the Town of Firestone granting them an
easement to access the site from the Firestone Trail, therefore, Condition of Approval#2.B can be
deleted.
Blake and Tammy Nelson, applicants, stated they currently provide portable toilets for use at the
property, and added the arena has been in use for approximately 20 years. Mr. Nelson stated they
do have a tap from the Weld Central Water District, and he would like the option of providing
bottled water or tap water if needed. He further stated there are occasions when they may need
to use the facility more than the normally scheduled evenings, and would still close operations at
12:00 a.m. Commissioner Long suggested deleting any reference to specific times and limiting the
operation to the weeks from the beginning in May to the end of September. Mr. Morrison clarified
there is an unsigned copy of the access agreement with the Town of Firestone in the file. Jackie
Johnson, attorney, stated the agreement has been executed and they are just waiting for a
recorded copy, which will be submitted.
No public testimony was offered concerning this matter. Ms. Davis suggested rather than deleting
Development Standard #10, it be amended to state, "Portable toilet facilities shall be provided for
family and participants using the roping arena."
Commissioner Masden moved to approve the request of L. Blake Nelson for a Site Specific
Development Plan and Use by Special Review Permit#1302 for a Commercial Roping Arena in
the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the
Planning Commission,with the Conditions of Approval and Development Standards as entered into
the record. His motion also included deleting Condition of Approval#2.B, amending Development
Standard #10 to state, "Portable toilet facilities shall be provided for family and participants using
the roping arena," amending Development Standard #11 to state, "The applicant shall provide
bottled water or tap water for patrons," and amending Development Standard #21 to state, "The
facility shall be limited to operating from the beginning of May through the end of September.
Hours of operation shall not extend beyond 12:00 a.m." The motion was seconded by
Commissioner Jerke, and it carried unanimously. There being no further discussion, the hearing
was completed at 10:25 a.m.
