443 RESOLUTION RE: ACTION OF BOARD CONCERNING MOBILE HOME PERMIT, ZPMH #2289 - HAIKO EICHLER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the request for Mobile Home Permit, ZPMH #2289, was submitted by Haiko Eichler, 18680 Weld County Road 3, Berthoud, Colorado 80513, for a second mobile home to be used as a Temporary Accessory to the Farm on property which is located in part on the following described real estate, to-wit: Part of the NW1/4 of Section 32, Township 4 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, after reviewing Department of Planning Services concerns and hearing the testimony presented, the Board determined that said request does not comply with Section 23-4-170 of the Weld County Code and shall be denied for the following reasons: 1. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with Section 23-4-170 of the Weld County Code. a. The mobile home is necessary for the effective and economic operation of the use and/or protection of the agricultural use. The Department of Planning Services has determined that there is not enough justification to warrant an additional mobile home on the site for farm use. The Weld County Comprehensive Plan, Section 22-260.1.1., states the minimum lot size in the Agricultural Zone District is 80 acres. This parcel size of forty(40)acres in size. Parcels less than the minimum lot size of eighty(80)acres generally are not used for agricultural operations. The site is currently dryland with no apparent crops and no animal units. The question as to whether or not a parcel of this size can house two dwelling structures is not under consideration. The applicant has failed to establish just cause for the issuance of this structure based on the information the Department of Planning has at this time. Furthermore,ZPMH-1023 for the first mobile home on the site also would be in question for the same reasons stated in ZPMH-2289, as the activity on the parcel does not warrant additional housing for accessory to the farm. 2001-3125 Should the Board of County Commissioners approved this request, the Department of Planning Services' staff recommends the following conditions be attached: 1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home on the property. 2. Prior to the occupancy of the mobile home, the mobile home shall be connected to an approved sewage system and a legal water supply. 3. The mobile home shall not be occupied until such time that the applicant has complied with Conditions 1 and 2 stated above. 4. The applicant shall submit documentation to justify ZPMH-1023 for the first accessory to the farm prior to release of the mobile home permit. 5. The mobile home will be occupied by persons principally employed at or principally engaged in the operation of the use where the mobile home is located. Accessory farm use of the mobile home shall be established and revalidated on an annual basis as follows: evidence shall be submitted by the applicant or property owner by the first of each year for review and acceptance by the Department of Planning Services verifying that the mobile home occupant is principally employed at or engaged in the farming operation on the subject property. The evidence shall consist of tax records,employment agreements or other documentation as determined suitable by the department of planning services. Failure to submit the required documentation may result in cessation of the allowance of the mobile home for temporary accessory farm use. 6. The mobile home will not be used as an income source by the applicant for rental to persons who are not principally employed upon the lot. 7. The property is in violation of Chapter 23 of the Weld County Code (Violation # 0100304). The applicant shall schedule a final inspection with the Weld County Zoning Compliance Officer and submit a copy of the closure letter indicating compliance with Chapter 23 of the Weld County Code. No building permits shall be released for this property until the violation is closed. 8. A Weld County Septic Permit is required for the proposed home septic system and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 9. WCR 3 is designated on the Transportation Plan Map as a local gravel road,which requires a 60- foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. 10. The applicant shall address the concerns of the Weld County Public Works regarding the three existing accesses for the parcel. 11. The applicant needs to provide adequate easement and right-of-way documentation, and identify proposed uses of the structures so that access needs may be adequately identified. 12. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development,the applicant/landowner shall be responsible for controlling the noxious weeds. 13. There are three access points to this parcel. The southern most access point accommodates the existing residence. The center access point accesses the proposed business building. The northern access point accesses the excavation for the new foundation, the existing mobile home, and a residence located farther back on the adjacent property. The applicant needs to provide adequate easement and right-of-way documentation, and identify proposed uses of the structures so that access needs may be adequately identified. If there is a business use associated with this parcel, it may require a Use by Special Review (USR) permit, or a home business status. If this is the case, the applicant should identify parking and access needs to this facility. This is at 18680 Weld County Road 3, Berthoud, Colorado 80513. Legal description: Part of the NW 1/4 of Section 32, Township 4 North, Range 68 West of the 6th P.M., Weld County, Colorado. We strongly object to allowing this permit for the following reasons: • The second Mobile Home cannot possibly be used as an accessory to the farm because there is no farm. Mr. Eichler may rent his ground, periodically through the year, to his neighbor who has some calves, but that is rental property not farm property. He does not own or care for the calves, nor does he raise any hav or other crops. Their neighbors, Mr. and Mrs. Harris and Harris' hired hand care for all of Harris' animals. • They have an old Mobile Home on the property now that is in violation of the zoning laws. It is not an accessory to a farm. Some of the people Eichler's have rented to in the last eight years are: an elderly woman (who was Mrs. Harris' mother), a man who worked full time at the post office, and we are not sure where their present renter works, but it is not on a farm. • Their current renter may be employed by the business they have located on their property. Their business is "Heritage Mail" which does printing and advertising for other business. We believe this business to also be a violation of the zoning laws. It is not in any way an agricultural business. • Mr. Eichler has disregarded many of the Weld County regulations. He has several junk cars on his property and uses his own pasture as an airport landing strip. His Business and Mobile Home are both in violation of Weld County zoning ordinances. Mr. Eichler started digging the basement for this Mobile Home without the necessary permits. He came to our home to inform us that he was building a home (didn't mention Mobile Home). He also told us that he would soon be adding yet another home — which would be four homes and that "Development"is coming, and we "may as well get used to it." • We ask you to please deny this application. I am now and have been for the last 25 years, engaged in the agricultural activity of feeding a small amount of cattle as well as raising nursery stock to the wholesale trade and direct mail marketing that nursery stock to the retail trade. I also occasionally purchase nursery stock from wholesalers to be mail marketed to the retail trade. I believe that we have been a good neighbor in our community and the signatures I collected in favor of my proposed use of the property is witness to that. We have no walk in retail trade out of our location, therefore are not contributing to any automobile and truck traffic, or present a parking problem. In order to properly conduct this business I obviously need some help and for the last 15 or so years I had such hired help living in the existing mobile home,defined as ZPMH-1023 in the Counties records. According to the letter I received on 10/24/01 from the Planning Services office,I need to re- justify its existence. Attached please find the employment contract of my current help,hired after the first of January 2001,which, I understand, is sufficient evidence. This young man was taken off the welfare rolls and is no longer a burden to the County or State taxpayers. He is not only"principally" employed, but he is exclusively employed by me. The second "Mobile Home" I am applying for is really not a Mobile Home at all, but a beautifully built, brand new Modular Home, undistinguishable from a conventional stick built home, that will be an asset to the neighborhood. The construction details and its appearance are attached to this package. Its setup and construction,of course,is based on the Commissions approval as well as procurement of all the proper building permits,to be applied for if and when I get the approval of the Commission. The employment contract between me and the gentleman hired to maintain equipment and machinery is also attached to this package. This gentleman and his wife are of retirement age and are looking for some supplemental income. As you can determine from said contracts, the compensation to both of my employees will not make them rich, therefore,giving them the opportunity to live on the job site is a very substantial [ E$IBIT afrnii Z289. benefit and a great help to continue doing my business as a substantial taxpayer in the County. Attached please also fint an attest of our family physician testifying to the fact that my wife no longer can lift the loads that have to be handled in the business because of severe back problems. Therefore the hiring of additional help has become mandatory. Denial of this application would place a tre- mendous hardship on my business and my family, and I hope you will agree. There are also a number of other benefits with this arrangement. For instance not having to commute to work every day saves a lot of gas and contributes to the conservation of our natural resources. Not having to commute during rush hour on I-25 , which is almost 24 hours a day, saves a lot of wear and tear on any ones psyche, which makes for a more productive employee and a happier citizen. Cutting down on traffic on our unpaved county roads further enhances the environ- ment by eliminating or reducing the clouds of airborne dust. I would also like to point out that in the 25 years I have enjoyed living in Weld County,I have always complied with the Counties Zoning, Building and Planning regulations regarding any build- ing projects undertaken on my property, and had nothing but positive interaction with County offi- cials. All of my construction has been nothing short of first class professional construction, in con- - trast to some of the shacks and other substandard buildings that have been erected on some other properties in the neighborhood.
