HomeMy WebLinkAbout20012830 HEARING CERTIFICATION DOCKET NO. 2001-75 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1353 FOR AN OIL AND GAS SUPPORT AND SERVICE FACILITY (NATURAL GAS COMPRESSOR STATION WITH ASSOCIATED INLET AND OUTLET PIPELINES) IN THE A(AGRICULTURAL) ZONE DISTRICT - HS GATHERING, LLC A public hearing was conducted on October 24, 2001, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner Glenn Vaad, Pro-Tem Commissioner William Jerke Commissioner David Long Commissioner Robert Masden Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Planning Department representative, Chris Gathman Health Department representative, Char Davis Public Works representative, Don Carroll Public Works representative, Drew Scheltinga The following business was transacted: I hereby certify that pursuant to a notice dated October 5, 2001, and duly published October 10, 2001, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request of HS Gathering, LLC, for Site Specific Development Plan and Use by Special Review Permit #1353 for an Oil and Gas Support and Service Facility (natural gas compressor station with associated inlet and outlet pipelines) in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Gathman gave a brief description of the location of the site and reviewed the reasons of approval as recommended by the Planning Commission. In response to Chair Geile, Mr. Gathman stated there are three other oil and gas processing facilities either adjacent to this site or in close proximity. Don Carroll, Department of Public Works, stated Weld County Road 22 is a collector status road, which is County maintained, and has a traffic count averaging 900 to 1,000 vehicles per day. In response to Commissioner Masden, Mr. Carroll stated the application indicates the site will require ten employees at full build out, and there is a site designated on the plat for the drop off/pick up of materials. Commissioner Masden questioned whether acceleration/deceleration lanes may be needed. Joe Ventola represented the current owner, Kerr-McGee, LLC. He stated this is an expansion of the existing facilities also owned by the applicant. He stated the amount of oil and gas products in the area exceeds what the existing facilities can handle. Mr. Ventola stated they dry and compress the natural gas for hauling, and added there are no other similar facilities within three or four miles owned by Kerr-McGee, LLC. He stated this will not be a production facility, it will be unmanned, operated from remote locations, and require only minimal staffing on rare occasions. 2001-2830 de; ALA ,VL,Aid PL1565 HEARING CERTIFICATION - HS GATHERING, LLC (USR#1353) PAGE 2 In response to Commissioner Masden, Matt Miller, Kerr-McGee, LLC, stated this facility will have an equal capacity to that of their other compressing stations to help handle the amounts of material being produced. Mr. Miller stated the site permitted under Use by Special Review Permit#1291 is adjacent to the proposed site and will be a liquid processing facility and the byproducts will be hauled from there. Mr. Ventola reiterated this is an expansion of the existing facilities to allow for a higher capacity; however,it required a separate permit because it is located on a separate parcel. In response to Chair Geile, Mr. Ventola stated this gas product comes form the Wattenberg Field, and they do not anticipate adding any more compressor stations in the area within the next ten years, with the exception of adding compressors to this particular site. Mr. Ventola stated the adjacent sites were originally owned by two different companies and permitted under separate permits; however, they are now owned by Kerr-McGee. He stated the three parcels basically create one operation under different permit boundaries. He further stated they will not need additional transmission lines for this site, and he concurred that this proposal will reduce the pressure and create more products at the other sites. Bob Warner,surrounding property owner,questioned whether there will be any sound compressors to help mitigate the noise. In response to Chair Geile, Mr. Warner indicated the locations of the residences in the area. He stated the noise from the existing operations is annoying and it would be helpful if the situation could be mitigated prior to approving an additional site. Mr.Warner stated when the applicant purchased the property they agreed to provide vegetative cover and trees to reduce wind erosion,which he has not seen. He also expressed concern with the increase in traffic on Weld County Road 37 between Roads 20 and 22, which is an unpaved portion of road. Mr. Warner stated the existing traffic often exceeds the speed limit, does not heed Stop signs, and causes dust. Responding to Mr. Warner, Chair Geile gave a brief explanation of the notification process and the bid process used to annually select a legal newspaper. There being no further comments, Chair Geile closed public testimony. Mr. Ventola stated this is an industrial area, they will have silencers over the exhausts which are directed toward the center of property to help mitigate noise. He stated they are required to comply with the Development Standards which restrict the noise generated by the site, and require landscaping for erosion control. Mr. Ventola reiterated this is an expansion of the existing plant facilities located adjacent to this site, there will be one additional driveway, and they will use the existing employees to operate the facility. In response to Chair Geile, Mr. Gathman stated the applicant is not required to submit a landscaping plan; however, they are required to attempt to address the comments of the Platte Valley Soil Conservation District. He stated the Weld County Management Specialist has reviewed the plan and the applicant has agreed to his recommendations. In response to Chair Geile, Mr. Ventola stated he and the applicant have reviewed and agree with the Conditions of Approval and Development Standards. Commissioner Masden moved to approve the request of HS Gathering, LLC, for a Site Specific Development Plan and Use by Special Review Permit #1353 for an Oil and Gas Support and Service Facility (natural gas compressor station with associated inlet and outlet pipelines) in the A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record.The motion was seconded by Commissioner Jerke. Upon a request for Clerk's clarification, Mr. Ventola stated Kerr-McGee, LLC, has purchased the property from HS Gathering; however, the deed still reflects HS Gathering, LLC. Commissioner Jerke suggested the Resolution be 2001-2830 PL1565 HEARING CERTIFICATION - HS GATHERING, LLC (USR#1353) PAGE 3 amended to reflect HS Gathering, LLC, or its successors. Commissioners Masden and Jerke concurred to amend the motion as discussed. The motion carried unanimously. There being no further discussion, the hearing was completed at 10:55 a.m. This Certification was approved on the 29th day of October 2001.
