526 - CHARLES KIRBY
WHEREAS , the Board of County Commissioners of Weld County,
Colorado , pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners , on January 13 ,
1983, approved Recorded Exemption No . 526 for Charles Kirby con-
cerning property described as Part of the WINE-1/4 , Section 17 ,
Township 6 ;North, Range 67 West of the 6th P .M. , Weld County,
Colorado, and
WHEREAS, the Board of County Commissioners , on August 10 ,
1983 , approved an amendment to Recorded Exemption No . 526 , and
WHEREAS, Charles Kirby is now requesting that Recorded
Exemption No. 526 be amended a second time to increase the size
of Lot B to 20 . 043 acres and decrease the size of Lot A to 52 . 3
acres , more or less , and
WHEREAS , the the Board of County Commissioners has studied
said request for a second amendment to Recorded Exemption No .
526 and deems it advisable to approve same .
NOW, THEREFORE , BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the second amendment
to Recorded Exemption No. 526 for Charles Kirby be, and hereby
is , approved.
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder . The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the
Weld County Subdivision Regulations . The plat shall be sub-
mitted within ninety days from the date of approval by the Board
of County Commissioners .

Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Charles W. Kirby for a second amendment to a recorded
exemption. The parcel of land on which this request is being made is
described as part of the Nl NE1, Section 17, T6N, R67W of the 6th P.M. ,
Weld County, Colorado.
The request is to amend the plat so that the smaller parcel (Lot B) will be
increased by approximately 3 acres to 20.043 acres in size. Lot A will
decrease in size from 55.4 acres to 52.3 acres more or less. The owners of
Lot A would like the additional acreage to expand their farm operation.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The impact on surrounding land uses does not appear to be
significantly different than the original or first amended
request. The original request was approved on January 13, 1982.
The first amended request was approved on August 10, 1983.
2. The request complies with Section 9-2E of the Subdivision
Regulations.

The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements
of Section 9-2C. (4) of the Weld County Subdivision Regulations. The
plat shall be submitted within ninety (90) days from the date of
approval by the Board of County Commissioners.

COMMENTS:
The Kirby property (Lot A) is a combination of a cattle feedlot, irrigated
pasture, and hayfield for the cattle operation. Improvements on the property
include an extensive set of corrals, six (6) outbuildings, silage pit, and
silos. The storage of farm equipment is also included on the property. The
land is relatively flat and it has access to Colorado Highway 257. The
Steinmiller property (Lot B) is characterized by a white iron pipe and wire
fence. It has a residence, a horse barn, and the acreage is used for horse
pasture. Lot B also has access to State Highway 257, a paved road.

No. 0807-17-1-RE526 (Kirby)
Gentlemen:
On or about August 10, 1983, the Board of County Commissioners of Weld
County approved an Amended Recorded Exemption on behalf of William Kirby,
RE526. Pursuant to said Recorded Exemption two parcels of land were created,
Parcel "A" being 55.4 acres and Parcel "B" being 16.926 acres. A copy of the
Amended Recorded Exemption survey plat is attached to this letter as Exhibit
"A"
Subsequent to the approval and recording of the plat, Mr. Kirby (the owner
of Lot A) and Mr. and Mrs. Steinmiller (the owners of Lot B) have agreed to
revise the two parcels by reducing the size of Lot A and increasing the size of
Lot B. The agreement has come about due to the inconvenience of the previous
survey line between Lot A and Lot B due to a ditch and fence, as well as the
need of additional acreage on Lot B for agricultural related activities.
A new mylar survey plat of these revised parcels as well as 10 copies of
the mylar is attached as Exhibit "B". Please note that there is no new parcel
created, the only change is that Lot A has now been reduced by 3 acres with
the new Lot A size being 52.3 acres; Lot B has now been increased by
approximately 3 acres with Lot B going from 16.926 acres to the proposed 20.043
acres. Also attached are all application documents and check for $100.00.
As this is not a major or significant change but is rather a minor change
of a boundary line we would request your approval of this Second Amended
Recorded Exemption. If there is any additional information which you need or
should you have any questions, please feel free to contact this office.
