The Weld County Department of Planning Services has determined through an administrative review that
the standards of Section 24-8-40.B.1 through 24-8-40.B.6 of the Weld County Code have been met. This
Recorded Exemption is approved with the following conditions in accordance with information submitted in
the application and the policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. The plat shall be titled: Recorded Exemption No. 1481-04-2 RE- 3191. `./
B. In accordance with Chapter 8, Article II of the Weld County Code, Lot A shall be granted one
residential/agricultural access. Direct access from a public road shall be limited to one access
per legal parcel for residential use, no circle drives or additional accesses shall be granted.The
road shall be graded and drained to provide all weather access. Accesses shall be placed in
such a location as to have adequate sight distance in both directions, shall not be placed below
the crest of a hill or where physical obstructions are present.

C. Lot B shall use the existing agricultural /oil and gas /ditch road access points necessary for v
agricultural operations as no additional accesses shall be granted.
D. All approved accesses shall be clearly shown on the plat.The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required, a 15-inch Corrugated Metal Pipe(CMP)is Weld
County's minimum size. If the applicant chooses to place a larger culvert please contact the
Weld County Department of Public Works to adequately size the culvert.
E. Weld County Roads 14 and 89 are designated on the Weld County Transportation Plan Map
as local gravel roads, which require 60 feet of right-of-way at full build out. There is presently L
60 feet of right-of-way. A total of 30 feet from the centerline of Weld County Roads 14 and 89
shall be delineated right-of-way on the plat. These roads are maintained by Weld County.
F. The Applicant has proposed a well as the source of adequate water for the Lots. Property
owners are advised that the quantity of water available for usage may be limited to specific
uses, i.e., "Domestic Use Only," etc. Because each situation is unique, the Department of
Planning Services encourages property owners to contact the Office of the State Engineer,
Division of Water Resources (1313 Sherman Street, Room 818. Denver, Colorado 80203.
Phone 303-866-3581), to discuss each individual situation.
G. The applicant shall attempt to address the requirements(concerns)of the Southeast Weld Soil
Conservation District, as stated in the referral response received September 13, 2001. C
Evidence of such shall be submitted in writing to the Weld County Department of Planning
Services.
H. Lot A shall comply with the less than thirty-five(35)acre maximum lot size required by Section v
24-8-10.B of the Weld County Code.
The applicant shall provide the Weld County Department of Planning Services with a certificate
from the Weld County Treasurer showing no delinquent taxes exist for the original parcel.
J. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code,shall be constructed
within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. \'
Any construction within a 200-foot radius of any tank battery or 150-foot radius of any
wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld
County Code.
2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
3) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Exemption number.

4) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that Lots have an adequate water supply of sufficient "
quality, quantity and dependability.
5) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
6) Prior to the release of building permits on Lots, the Lot owner shall verify with the
nearest Town/City or Sanitation District to determine the location of the nearest sewer
line. In accordance with the Weld County Code, if a sewer line exists within 400 feet
of the property and the sewer provider is willing to serve the proposed structure, a
septic permit cannot be granted by the Weld County Department of Public Health and
Environment.
7) Potential purchasers should be aware that Lot A may not be eligible for a domestic well v
permit which allows for outside irrigation and/or the watering of stock animals. The
State of Colorado, Division of Water Resources issues all well permits

water standards as defined by the Colorado Department of Public Health and
Environment.The Weld County Department of Public Health and Environment strongly
encourages well users to test their drinking water prior to consumption and periodically
there after.
9) WELD COUNTY'S RIGHT TO FARM. Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with longstanding
agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area:
open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Without neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from •
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens,field work,harvest,and gravel roads;odors from animal confinement,silage,and
manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and
fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs
cannot simply be moved out of the way of residential development without threatening
the efficient delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and county roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not
provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after
a major snowstorm. Snow removal for roads within subdivisions are of the lowest
priority for public works or may be the private responsibility of the homeowners.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient that urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of
the farmer's livelihood. Parents are responsible for their children.
3. The applicant shall submit a Mylar plat to the Weld County Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in
accordance with the requirements of Section 24-8-70 of the Weld County Code. The plat shall be
submitted within sixty(60)days from the date of approval by the Weld County Department of Planning
Services. The applicant shall be responsible for paying the recording fee.
4. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to
meet any one of these conditions within 60 days of approval, then this case will be forwarded to the
Weld County Board of County Commissioners with a staff recommendation for denial.

Irrigation water: There is no irrigation water to this parcel in the form of ditch rights or irrigation
2. Sewer: A septic permit will be applied for as necesary with a building permit. There is no existing septic
system on the property.
3. The property consists of 80 acres of non prime farmground which currently lies fallow. There are no
existing improvements on the property.
4. The purpose of splitting the property into 2 separate parcels is to generate some greatly needed capital
while creating a home site that can still be farmed in order to maximize land use and to conform with Weld
County's Comprehensive Plan.
5. The entire 80 acre parcel is located 1/2 mile north of Hwy. 52 on WCR 89 and extends north to WCR 14.
It is currently non prime farmground and lies fallow.
6. In general the property is fairly level farmground, except for a ridge that runs from the northwest corner of
the property to the southeast corner.
7. Any new structure will conform to the requirements in the specific zone district.
8. There will not be a conservation easement placed on this property.
9. A building envelope will not be located on either parcel.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
Weld County Recorded Exemption Standards. Our comments and requirements are as follows:
COMMENTS:
WCR 14 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-
of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the
required setback is measured from the future right-of-way line.
WCR 89 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-
of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the

REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present. (Lot A)
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately
size your culvert. (Lot A)
A local residential/agricultural access shall be a minimum distance of 75 feet from an intersecting county or
roadway.
The applicant shall utilize the existing agricultural/residential access to this parcel. (Lot B)
The applicant shall complete a Weldt,County Road Access Information Sheet.

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic systems
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
2. Prior to the release of building permits on lot A and B, the lot owners shall verify
with the nearest Town/City or Sanitation District to determine the location of the
nearest sewer line. In accordance with the Weld County Code, if a sewer line
exists within 400 feet of the property and the sewer provider is willing to serve the
proposed structure, a septic permit cannot be granted by the Weld County
Department of Public Health and Environment.
Additionally, please note the following:
1) This application is proposing wells as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. domestic use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.

In consultation with the Natural Resources Conservation Service (NRCS), we have reviewed the above
referenced case and have the following comments:
SOILS/LIMITATIONS:
Septic Systems: Nunn loam has severe limitations because of restricted permeability. Ascalon sandy loam
has moderate limitations because of restricted permeability. Vona sandy loam has severe limitations because
of poor filtering capacity.
Houses: Nunn loam has severe limitations because of its shrink-swell potential.
Shallow Excavations: Nunn loam has moderate limitations because of its high clay content and potential for
cutbacks to cave in. Ascalon and Vona sandy loams have severe limitations because of their potential for
cutbacks to cave in.
PRIME FARMLANDS: None of this land is considered prime farmland because it is not irrigated.
SOIL EROSION POTENTIAL: The Ascalon and Vona sandy loams are considered highly erodible soils
and should be protected. Construction should be planned so as to disturb as little soil as possible and
measures should be taken to prevent soil movement offsite. Any areas that are disturbed should be stabilized
with perennial vegetation, gravel, or pavement once construction is complete.
OTHER: The applicant should contact Ron Broth, Vegetation Weed Management Specialist with the Weld
County Public Works Department at (970) 356-4000 X 3770 to develop a weed management plan. If this
land will no longer be farmed it should be protected from erosion with perennial vegetation. Contact the
NRCS for recommendations on adapted trees, shrubs and grasses.

THIS AGREEMENT entered into by and between Bertha I . Hlad Of
the County of Adams and State of Colorado hereinafter referred
to as the "Settlor" , and Bertha I . Hlad also of the said County
of Adams and State of Colorado hereinafter referred to as the
"Trustee" .
WITNESSETH:
WHEREAS the Settlor desires to place certain assets and
property in trust , said trust to be known as the Bertha I . Hlad
Trust , and
WHEREAS the Trustee is willing to administer such funds as
Trustee under the terms of these presents.
NOW THEREFORE intending to be legally bound hereby, the
Settlor and the Trustee do hereby covenant and agree as follows :
1 . The Settlor has executed a Declaration of Trust in which
the Trustee is named as beneficiary to receive certain assets
described in Schedule A attached hereto and made a part hereof .
The Settlor assigns , conveys , transfers and delivers to the
Trustee the property described in Schedule A. This property,
together with . y additions acceptable to the Trustee made by
the Settlor or any other person in any manner, and all death
benefits payable to the Trustee or the trust, shall constitute
the Trust Estate .
2 . The Trustee shall pay to the Settlor in convenient
monthly installments during his/her lifetime, the actual income
from the trust together with such sums from principal as the
Settlor shall request be paid from time to time. To the extent
that such payments shall have been less than the total annual
income , a special year-end distribution shall be made to the
Settlor . Payments herein designated as to be made to the
Settlor may, alternatively, be disbursed on his/her behalf.
3. The Trustee is authorized to pay to the Settlor or
expend on his/her behalf at any time, in addition to the income
distribution specified above, such sums from the principal of
the trust as he/she in his/her sole discretion shall deem
necessary or desirable for the comfort or well-being of the
Settlor.
4 . Upon the death of the Settlor, the Successor Trustee
shall , dispose of the then trust fund in accordance with the
provisions hereinafter set forth .
5 . If requested by the executor or administrator of the

Settlor' s estate, the Successor Trustee shall pay or reimburse
said executor or administrator for the amount of any ante mortem
claim, funeral expense and/or costs of administration which
shall be allowed in connection with the settlement of such
estate. In the absence of formal probate administration, the
Trustee shall pay those amounts which he/she determines to be
due and payable.
6. The Successor Trustee shall pay to the proper taxing
authority or reimburse the executor or administrator of the
Settlor ' s estate for the amount of any succession, estate ,
transfer or similar tax, whether State or Federal , which shall
be imposed lawfully upon the Settlor ' s taxable estate or upon
any beneficiary thereof as a result of the Settlor' s death. The
proceeds of employee death benefits or employee life insurance
policies on the Settlor ' s life shall not be used to pay death
taxes or otherwise be paid to the executor of the Settlor ' s
estate .
To the extent the Trust Estate holds United States Treasury
Bonds eligible for redemption at par in payment of the Federal
Estate Tax, the Trustee shall pay the Federal Estate Tax due by
reason of Settlor ' s death, submitting such bonds for redemption
to the extent necessary in payment of such tax.
7 . Thereafter , the Successor Trustee shall determine the
fair market value of the trust assets and make distribution of
such assets , as soon as possible, excepting transfers that would
cause a decline in the value of trust assets , but at least
within a reasonable period of time not to exceed one year, as
follows :
The Successor Trustee shall divide the balance of the trust
fund into as many equal parts as there shall be named
beneficiaries and shall pay one such part to each of the
following, in equal shares , or their issue per stirpes and shall
thereupon terminate the trust .
The share of any beneficiary who dies leaving no surviving
issue shall be divided equally among the remaining named
beneficiaries , or their issue per stirpes .

Violet M. Lindstrom, Daughter
Notwithstanding the above, in the event William D. Hlad
predeceases me and his wife Ina E. Hlad is living his share
shall go to her . If she is not living, the above paragraph for
distribution shall control .

If, during the lifetime of the Settlor, all beneficiaries
named and their issue shall have died, the Successor Trustee
shall pay the then trust fund to the Settlor' s heirs at law.
Notwithstanding the foregoing, if any beneficiary hereunder
shall not have attained the age of 21 years, the Successor
Trustee shall hold such beneficiary' s share of the trust assets
in continuing trust until such beneficiary shall have attained
the age of 21 years . Prior to the date upon which such
beneficiary attains the age of 21 years, the Successor Trustee
may apply or expend any or all of said beneficiary' s share of
the income or principal directly for the maintenance, education
and support of said beneficiary without the intervention of any
guardian and without application to any court. Such payments of
income or principal may, in the Successor Trustee' s sole
discretion , be made to the beneficiary or to said beneficiary' s
parents or to the person with whom the beneficiary is living ,
without any liability upon the Successor Trustee to see to the
application thereof. If such beneficiary survives the Settlor
but dies before attaining the age of 21 years, said trust assets
shall be distributed to hiss/her issue per stirpes or held in
trust for him/her/them if he/she/they have not attained 21 years
of age . If said beneficiary shall have no issue, then said
beneficiary' s share shall be distributed equally among the
remaining named beneficiary or beneficiaries or his/her/their
issue per stirpes or held in trust for him/her/them if
he/she/they have not attained 21 years of age.
8. If any provision of this instrument shall be unclear or
the subject of dispute among the parties to the trust, the
Trustee or the Successor Trustee , if the latter shall then be
actively serving , shall be fully authorized to construe such
provision , and any such determination by the Trustee or
Successor Trustee shall be final and binding upon all such
parties .
9. All interests of a beneficiary hereunder shall be
inalienable and free from anticipation, assignment , attachment,
pledge or control by creditors , or from a present or former
spouse of such beneficiary in any proceedings at law or in
equity.
10. This trust is created upon the understanding that the
issuer, custodian or transfer agent of any securities held
hereunder shall be under no liability whatsoever to see to the
proper administration of the trust, and that upon the transfer
of the right, title and interest in and to said securities, said
issuer, custodian or transfer agent shall conclusively treat the
transferee as the sole owner of said trust property and shall be
under no liability to see to the proper application of the
proceeds of such transfer.
11. The Trustee and any Successor Trustee shall have the
following powers in addition to those given them by law, to be

exercised in his/her sole discretion:
To sell , exchange , assign , lease, mortgage, pledge or borrow
upon and in any manner to deal with and dispose of all or any

to make distribution hereunder , and to invest the proceeds of
any sale or other disposition , liquidation or withdrawal , as
often as may be necessary in the discreticn of the Trustee
and/or the Successor Trustee , without being required to make
application for more specific authority to any court of law or
equity. In addition , my Trustee and/or any Successor Trustee
shall have all the powers conferred upon fiduciaries by the
Colorado Fiduciaries ' Powers Act , as it exists at the time of
the execution of this trust , which Act is incorporated in this
Trust by reference .
12. The trust herein created may be amended or revoked at
any time during the lifetime of the Settlor by written notice
from the Settlor to the Trustee . The Trustee may resign at any
time during the lifetime of the Settlor by written notice to the
Successor Trustee .
13. In the event of the Trustee' s physical or mental
incapacity, death , resignation or removal for cause, then the
Successor Trustee shall assume the responsibilities and
obligations of this trust agreement. The Settlor hereby
appoints Paul E. Hlad as Successor Trustee.
14 . The Trustee and the Successor Trustee are specifically
instructed by the Settlor to maintain the privacy and
confidentiality of this instrument and the trust created
hereunder , and are under no circumstances to divulge its terms
to any probate or other court or other public agency with the
exception of a tax authority.
15 . The Trustee and the Successor Trustee shall serve
without bond.
16. This trust Agreement shall be construed and enforced in
accordance with the laws of the State of Colorado.
